HomeMy Public PortalAboutResolution 15-06 Urban Renewal Boundary ExpansionRESOLUTION NO. 15-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY, STATE OF IDAHO, DETERMINING THAT SIX (6) PARCELS ADJACENT TO THE EXISTING RAILROAD AVENUE URBAN RENEWAL AREA ARE A DETERIORATED OR DETERIORATING AREA AS DEFINED BY IDAHO CODE §§50- 2018(8) & (9), AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on May 10, 1990, by Resolution No. 6-90, the City of McCall empowered an Urban Renewal Agency pursuant to Idaho Code Title 50, Chapters 20 & 29; and WHEREAS, by Ordinance No. 567, the City of McCall appointed a Board of Commissioners for the McCall Urban Renewal Agency which Agency has been renamed the McCall Redevelopment Agency by virtue of Resolution No. 16-90; and WHEREAS, the Agency has examined the existing Railroad Avenue Urban Renewal Area and six adjacent parcels for the purpose of determining whether the six parcels are deteriorated or deteriorating areas as defined under Idaho Code §§50-2018(8) & (9); and WHEREAS, the Agency has recommended to the City Council, based on a report by Michelle Groenevelt, the City of McCall Community Development Director, regarding the eligibility of the six parcels as deteriorated and/or deteriorating areas within the City; and WHEREAS, pursuant to Idaho Code §50-2008, an urban renewal project may not be planned or initiated unless the local governing body has, by resolution, determined such area to be a deteriorated or deteriorating area, or a combination thereof, and has designated such area as appropriate for an urban renewal project; and WHEREAS, the Agency has recommended to the City Council that these six parcels be added to the existing Railroad Avenue Urban Renewal Plan as updated by the Agency and the City Council of the City of McCall in 2006; and WHEREAS, the six parcels shall not be added to the existing revenue allocation area but shall simply be added to the urban renewal area and Urban Renewal Plan. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO, AS FOLLOWS: 1. That the Urban Renewal Project Area identified in attachments #1 & #2 to this Resolution (hereinafter the "six -parcel area") has the following characteristics: A. There is substantial number of deteriorated or deteriorating structures within the area. B. There is a predominance of defective or inadequate street layout in the area. Various sections of the existing streets adjacent to the parcels which have not been rehabilitated, including Lenora Street, are in a deteriorated condition, do not have the sidewalks that are needed to assure safe pedestrian traffic, nor is there a curb and gutter system to control street access. D. Sanitary services and water delivery system in the project area are currently inadequate and, hence, may result in unsanitary and unsafe conditions. E. There is a diversity of property ownership and lot layout in the area, exemplified by commercially zoned property in areas that were previously subdivided into thirty foot lots, multiple ownership of lots in a single block or half block area, making it difficult to assemble suitable development parcels. F. Lot layout in the project area is inadequate in relation to size, accessibility and usefulness. G. The area lacks adequate on -street or off-street parking facilities for the public and private development which has occurred and which would be contemplated under current zoning. 2. As a result of these conditions, the six parcels are underutilized and underdeveloped. Additionally, such conditions arrest the sound growth of the community and constitute an economic liability. Downtown expansion has been hampered by the area's inadequate public infrastructure. The area generates more demands for municipal services than it can pay for through property and other taxes; and the conditions create a menace or danger to the public welfare in terms of fire protection, safety of pedestrians and vehicular traffic, and impact on users of the sewer and water systems. 3. That the area is determined to be a deteriorated area as defined in Idaho Code §50-2018(8) and a deteriorating area as defined in Idaho Code §50-2018(9). 4. That, based on the conditions described above, and pursuant to Idaho Code §50- 2008(a), the area is determined to be appropriate to be added to the existing Railroad Avenue Urban Renewal Project. 5. That upon its preparation and receipt, the supplement to the Railroad Avenue Urban Renewal Plan shall be submitted to the McCall Planning & Zoning Commission for its review and recommendation as to the conformity of the supplement with the Comprehensive Plan of the City of McCall, which recommendation shall be submitted to the McCall City Council with thirty (30) days after the Commission's receipt thereof. 6. The proposed supplement to the 2006 updated Urban Renewal Plan for Railroad Avenue will not substantially change the 1990 plan, nor will it substantially change the 2006 updated plan in that the six parcels are immediately adjacent and contiguous to the existing Page 2 of 5 Resolution 15-06 Urban Renewal Boundary Expansion March 26, 2015 boundaries and will not be added to the revenue allocation area set out in the 1990 plan and continued unaltered in the 2006 updated plan. 7. That this Resolution constitutes the necessary action of the City Council under the Urban Renewal law and the 1990 plan and the 2006 updated plan for adding six deteriorated or deteriorating parcels to the urban renewal project area and urban renewal plan. 8. This Resolution shall be in full force and effect immediately upon its adoption and approval. PASSED by the City Council of the City of McCall this 26 day of March, 2015.
