The regular meeting of the City Council was called to order by Mayor Merritt at 7:30 P. M. Elder Calkins of the 7th Day Advent - 2. ist Church, 9664 Broadway, Temple City, gave the Invocation. 3. Mayor Merritt then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: Present: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt Absent: Councilmen -None Also Present: City Attorney Shatford & City Manager Woollett 5. APPROVAL OF MINUTES: Councilman Nunamaker moved to approve the minutes of the regular meeting of May 11 and the adjourned meeting of May 18, 1964, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6, RESOLUTION NO. 64 -370: APPROVAL OF ZONE VARIANCE CASE #64 -86 City Manager Woollett read title to Resolution No. 64 -370 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANT- ING ZONE VARIANCE REQUEST OF HAROLD E. KREEBLE IN ZONE VARIANCE CASE NO. 64 -36. Councilman Harker moved to waive further reading and to adopt Resolution No. 64 -370, Councilman Tyrell seconded, and carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None PUBLIC HEARING: 7:30 P. M: PROPOSED SIDEWALKS: Double Drive west side Daines Dr. to Grand Ave. Asst. City Manager Koski presented the petitions, #1 Double Dr. west side, Freer to Grand representing 1131 ft. with signatures representing 687 ft., or 60.7 %, #2 Daines Dr. to Freer, west side of Double Drive, total footage 1094 ft, with signatures represent• ing 791 ft., or 72.3 %. Councilman Nunamaker moved to open the Public Hearing, Councilman Dickason seconded, and carried. The Mayor asked if anyone wished to speak against the improvement. The following people protested the installation: Thomas Foster of 5115 Double Dr., Bernard Como, of 5123 Double Drive, Mr. Kram- er of 5041 Double Drive, Mrs. Jean Angelacos of 5103 Double Dr., Wm. Eddy of 5111 Double Drive, Mr. Leslie Patton, 5433 Double Dr,, Mrs. Sanders, 5341 Double Dr" Len rose, of 5031 Double Dr., Mr. Boore of 5451 Doubly: Dr., Robt. O'Connor of 5221 -5241 Double Dr., J. L. Scherer of 5005 Double Dr. Mrs. Dorothy Lanpheres stated she had lived on Double Dr. 22 yrs. and was very much in favor of the improvement Councilman Tyrell moved to close the Public Hearing, Councilman Harker seconded, and carried. The City Attorney advised the petition was adequate as it stands. On basis of petition it goes to Public Hearing. Councilman Tyrell felt it should have a solid 60% to institute proceedings, and also felt the sidewalks should be put in when the street is. Councilman Nunamaker could see no objection and felt they should have sidewalks. There was considerable discussion amongst the Councilmen. Councilman Nunamaker moved to determine the projects to be in the public interest, to approve expenditure of funds for this purpose, and instruct the Supt. of Streets to cause the work: to be done on both blocks on the west side'.of Double Drive, Daines Drive to Freer, and Freer to Grand, Councilman Dickason seconded the motion, roll call vote to carry as follows: 615 Council Minutes, May 25, 1564, page 2 AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen - Tyrell ABSENT: Councilmen -None The Mayor called a five minute recess. PUBLIC HEARING: SIDEWALKS: LIVE OAK AVE., north side, Cambury to Baldwin Ave. Asst. City Manager Koski presented the petition for sidewalks representing 549 ft. of the block lineal footage of 893 ft. or 61.47 %. He also noted the Notice of Protest submitted on May 22 the total number of property owners represented 547 ft. or 61.2 %, with several persons signing both petitions. Councilman Nunamaker moved to open the Public Hearing, Councilman► Harker seconded, and carried. Mayor Merritt asked if anyone wished to speak in favor of the improvement. The following people came forward and spoke in favor of the improvement: Mrs. Florence Abbey of 9503 Live Oak, Mr. Peterson of 9936 Live Oak, M. ,ti►. Brose of 9528 Live Oak, John P. Deignan of 9932 Live Oak, Mrs. Miller of 9908 Live Oak. The following people spoke against the installation: Mr. Stil- wagon spoke at length against the installation. The question was brought up about signing the petition for the improvement and then the same people signing a protest against it. The City Attorney advised that once they sign the petition in favor of the proposal it comes before the City Council. He stated he would like to research and study this petition. He asked Mr. Koski if those signing both were removed from the original pe- tition what the percentage would be and was advised 3U%. He ad- vised they just say "protest" and do not ask withdrawal. Mrs. Marigo, 9942 Live Oak, has her property in escrow, protested the installation. G. M. Cody, 9953 Live Oak, stated he signed origin- al petition but was now opposed, Mrs. Espinosa of 9838 Live Oak was opposed, John Espinosa of same address was also opposed, Mr. Schilling, 9548 Live Oak, Fred Andrews of 9966 Live Oak, Mrs. Schilling of 9948 Live Oak were all opposed. Councilman Nunamaker moved to close the Public Hearing, Councilman Tyrell seconded, and carried. The City Attorney recommended this be held over until the next regular meeting in order for him to re- search petition and protest. Following discussion by the Council it was moved by Councilman Harker that the Public Hearing be re- opened and carried over until the next regular meeting of the Council, Councilman Dickason seconded, and carried by the follow- ing called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None The Mayor declared a five minute recess. PUBLIC HEARING: ZONE VARIANCE CASE NO. 63 -71 PROPOSED CONVALESCENT HOS- PITAL, NORTH4EST CORNER TEMPLE CITY BLVD. AND BROADWAY- Frederick Garside. City Attorney Shatford advised this has come on in the middle of the transition from the old laws and the new laws, and that he had written an opinion on the basis of what has come up before the Planning Commission. He advised it would be proper to hear from the applicant and his counsel and to hear from any people who are interested in behalf of applicant and those who are opposed. Councilman Dickason moved to open the Public Hearing, Councilman Harker seconded, and carried. City Manager Woollett presented the factual report on the case. Mr. Shaw, Attorney for Mr. Garside, spoke in his behalf regard- ing the proposed convalescent hospital. He presented letters from Drs. Richard Hart, Pyott, May, Ellis, Atilla, all favoring the hospital at this location. Mr. Garside spoke in his behalf. The following spoke in favor of the applicant; Marjorie Schaub of 5526 Temple City Blvd., L. Scott of 9525 Broadway, Mr. Tel- ford of 95565 Daines Dr., F. J. Stack of 5471 Golden West, James Lawyer of 9621 Broadway, Mrs. Geo. Reel of 5752 Temple City Blvd, The following spoke against the applicant's request: Geo. Nettle of 9533 Broadway, Richard Ingalls of 9556 Broadway, Verna West - ridge of 5560 Broadway, Ralph Morris of 5512 Temple City Blvd. 616 Council Minutes, May 25, 1964, page 3 Councilman Nunamaker moved to close the Public Hearing, Council- man Dickason seconded, and carried. Councilman Nunamaker advised as a Councilman he could not over- ride the decision of the Planning Commission. Under the new laws would have to be R -4 and the properties involved are R -3 and R -2 and R -1, which would be three different type of variance If the variance were allowed we would not be upholding the vari- ance law, and he was against granting the variance. Councilman Dickason felt this should have come in as a zone change rather than a variance, and on that basis would have to vote against it. Councilman Tyrell felt the proposed unit would be of greater advantage than apartments with respect to policing, parking and school problems. Mayor Merritt felt those favoring the request, at least a good many of them, were a considerable distance further away than those opposed to this, and for this and other reasons would not favor the variance. Councilman Tyrell felt it should be a zone change request rather than a variance and the City Attorney advised the variance request was proper and the City would have more control than a zone change. Councilman Nunamaker moved to deny the request of the applicant, Mayor Merritt seconded, roll call vote as follows: AYES: Councilmen - Nunamaker, Merritt NOES: Councilmen - Dickason, Tyrell ABSTAINING: Councilman- Harker The variance request was denied due to a lack of a majority vote. NEW BUSINESS: 7. PRESENTATION 1964-65 BUDGET: City Manager Woollett presented the proposed 1964 -65 budget and recommended the Council set the first public hearing for 7:30 P. M. on June 13, 1964, in the large meeting room in the City Hall, to which all Councilmen agreed. 8. GAS TAX FUNDS: 1964 -65 FISCAL YEAR: The City Manager presented the project statements for gas tax funds for the year and recommended their approval and adoption of Resolutions No. 64 -374 and 64 -375. Councilman Tyrell moved to adopt both Resolutions, Councilman Nunamaker seconded, and carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 9. AGREEMENT FOR IMPROVEMENT, DOUBLE DRIVE -LIVE OAK TO GRAND AVE. City Manager Woollett advised this Agreement gives authority to the County to act for us in the above improvement and recommend- ed approval and that the Mayor and City Clerk be instructed to sign on behalf of the City. Councilman Tyrell so moved, Coun- cilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 10. PROPOSED ANNEXATION TO LIGHTING MAINTENANCE DISTRICT #1395. City Manager Woollett advised this was the ',Weber tract to be annexed and recommended the Council grant consent and jurisdic- tion to the County of Los Angeles in the matter of annexation of said property to County Lighting Maintenance District #1395. Councilman Dickason so moved, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 11. SET PUBLIC HEARING: CURB & GUTTER City Manager Woollett recommended the Council set a public hear- ing for curb and gutter on Halifax, the west side, Daines Dr. to Olive, for June 8, 1964, at 7:30 P. M. Councilman Tyrell so moved, Councilman Dickason seconded and carried. 12. RESOLUTION NO. 64 -369: warrants and demands. Councilman Nuna- maker moved to adopt Resolution No. 64 -369, warrants and demands 617 Council Minutes, May 25, 1964, page 4 Nos. 5100 through No. 5131 in the sum of $25,275.22, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 13. COMMUNICATIONS: a. The City Manager presented a letter from the Chamber of Com- merce requesting permission to place tables on sidewalks from 10 AM to 8 PM for annual sidewalk sale on May 29, be- tween Primrose and Camellia. He recommended approval contin- gent upon insurance coverage. Councilman Nunamaker so moved, Councilman Harker seconded, and carried. b. Proclamation for May 24 -30 as Realtor Week. Mayor Merritt presented the proclamation for approval. Councilman Tyrell moved to so proclaim, Councilman Nunamaker seconded, carried. c. REQUEST FOR CHARITABLE SOLICITATION PERMITS: 1. Boy Scout Troop #171 for car wash at Rays Service Station June 6, 8 AM to 4 PM. 2. Key. Club, car wash, Rays Service Station, May 30, 9 AM to 5 PM. Councilman Tyrell moved to grant request #1, Councilman Nunamak- er seconded, and carried. Councilman Nunamaker moved to grant request #2, Councilman Dickason seconded, and carried. d. Boundary Commission: proposed annexation #25, City of Rosemead. Councilman Nunamaker moved to receive and file, Councilman Ty- rell seconded and carried. 1 4 . TIME FOR THOSE I N THE AUDIENCE ;!HO WISH TO SPEAK: Carl Ludlow, representing the Businessmens Committee of the Chamber of Commerce, requested the City to provide space for the Man in Space show scheduled for early June. He was desirous of having the show on Temple City Blvd. or Las Tunas Dr. This show is for three days June 11, 12, and 13. A lengthy discussion followed and it was suggested Mr. Ludlow contact the Alpha Beta market and see if a part of their parking lot on Temple City Blvd. could be used. The City Manager will check with the Traffic Engineer and present a recommendation at the Council Meeting on June 1. 15. MATTERS FROM CITY OFFICIALS: The City Manager presented Resolution No. 64 -371 appointing part . time recreation employees. Councilman Tyrell moved to adopt, Councilman Nunamaker seconded, roll call vote to carry as fol- lows: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None The City Manager presented Resolution No. 64 -372, approving . prohibited parking on the west side of Rosemead Blvd. north of Longden Ave. in conjunction with State Highway signal modifica- tion and channelization. Councilman Tyrell moved to approve, Councilman Nunamaker seconded, roll call to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford requested on Parking District #2 that the Council raise the purchase price from $27,500 to not to exceed $29,000. on Lot 254, Tract 6561, 5944 N. Primrose, based on the fact that it would be to the City's advantage rather than condemnation.
