RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES
CONTRACT FOR ARCHITECTURAL CONSULTING
SERVICES WITH JOHN L. LEBDUSKA
WHEREAS, on January 18, 2001 the Governing Body passed Resolution #01-24
awarding a professional services contract to John L. Lebduska to provide forensic
architecturaI services and to serve as an expert witness on behalf of the Borough in the
matter of Wanskus v. the Borough of Carteret; and
WHEREAS, the authorization provided for pursuant to Resolution #01-24 was set at an
amount not to exceed $5;000.00 billable in accordance with the approved contract; and
WHEREAS, the initial authorization provided for pursuant to the aforementioned
resolution has been expended; and
WHEREAS, the Borough requires additional architectural consulting services to be
performed by John L. Lebduska in regard to the matter of Wanskus v. the Borough of
Carteret; and
WHEREAS, the Chief Financial Officer has certified that funds are available for said
purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret that the authorization for John L. Lebduska provided for pursuant to
Resolution #01-24 is hereby increased to a maximum amount of $10,000.00 billable.
BE IT FURTHER RESOLVED, that this award is made without competitive bids as a
professional services contract pursuant to N.J.S.A. 40A: 11-5(1)(a).
