Additionally, all Planning Commission meetings are tape-recorded and are available to the public for listening at the Town Center Offices from 8:30am — 2:00 pm, Monday through Friday, by contacting the Planning Office at 970/827-5645 302 Pine St. Minturn, CO 81645. As a Pre -Meeting Work session item, the Planning Commission met at the Town Hall and traveled to 246 Main St. No direction or discussions were made as a result of the Site Visit. Those in attendance at the Site Visit were: Chair Lynn Teach, Jeff Armistead, Greg Gastineau and Greg Sparhawk. Regular Session — 6:30 pm 1. Call to Order Chair L. Teach called the meeting to order at 6:30pm • Roll Call Those present: Chair Lynn Teach, Jeff Armistead, Greg Gastineau, Greg Sparhawk, Lauren Dickie and Burke Harrington. Note: due to a full attendance of commissioners, Lauren Dickie does not rote today, as an alternate member. ® Pledge ofAllegiance 2. Approval of Minutes o February 28, 2018 Changes: Correct Lynn T.'s comment on Item 7 regarding the chain link fences. Motion by Jeff A., second by Greg S. to approve the minutes of February 28, 2018 as amended. Motion passed 5-0. None 4. Boneyard Conservation Easement —complete with EVLT 8. 2009 Community Master Plan —update Fall 2018? 9. 2015 IBC International Building Code — (this falls under the building dept. — not planning) Grants: $45,000 Fishing is Fun Grant - for the River Access Trail Program — application due 3/1/2018 $45,000 GOCO Grant — application due 3/1/2018 — pay for CE of Boneyard with EVL 7. 246 Main Street — Design Review Janet H. introduced the property owner, Mr. Terry Palmos and his Designer, Mr. Michael Pukas. The Public Hearing was opened. Janet H. outlined the project as demolishing the existing nonconforming shed and replacing it with a two-bedroom accessory dwelling facing Eagle Street. She outlined the proposal and addressed her written report supplemented with several pages of additional notes and designs. She noted the original submittal does not meet the code but the applicant has submitted an "Option 2" which does. Based on the original submittal Staff is recommending denial due to inadequate space for snow storage for two parking spaces. Applicant Mr. Tent' Palmos spoke stating he had been notified by the Minturn Code Enforcement Officer of an unsafe structure. He stated he had intended to tear it down and replace it with a garage and/or apartment. Mr. Michael Pukas spoke to the application. He had submitted the original application as preliminary, taken the Planner's concerns and modified the application to address her concerns. He stated that, once he submitted the changes which addressed the parking, snow storage, and other issues, the Planner had rejected them stating that the original submittal is what had been accepted; however, she allowed the "Option 2" to be considered if the Planning Commission was agreeable. Discussion ensued that the eve overhang extended into the setback fronting Eagle Street but that the roof sloped back and snow and water would therefore shed into the back yard, that the snow storage would block the steps into the back yard, and would also be contained using both walls along each side of the building which could damage the building. It was noted a large tree prevents the unit from being pushed further back in to the rear yard. Discussion ensued as to the parallel parking proposed and how that would negatively affect the town snowplow operations on Eagle St. Janet H. stated that there is being considered text changes in the code which could be used to address and clarify some of the issues; she noted those changes had not been approved by the Town Council. Public Comment: An email was submitted by Janet H. from Mr. Ben Finn, 242 Main St, stating his opposition to the proposal. As included in attachment A. Mr. Lynn Kanakis, 248 Main St, was opposed to the proposal if it shed snow on to his property or if it interfered with the ability for the Town to address snow removal on Eagle St. The Public Hearing was closed. Planning Commission Comments: Jeff A. asked if the new accessory unit would be utilized as a family stay or as a vacation STR. Mr. Palmos replied it probably wouldn't be used as a vacation rental property. Jeff A. stated that the difficulty with the 5% storage on paper, is often hard to take into action. He established it was a challenging motion since it meets the code requirements, but when it comes to removing snow during the winter, it doesn't seem very practical. Burke H. liked the structure design. Asked if they would be willing to push the structure a few feet back. Because it didn't look very functional as it is. He brought up the fact of the front door being too close to the parking space. Also inquired about the snow storage area. Lauren D. asked about how far he would go in the set back. Concerned whether the roof sheds snow into the setback. Her opinion on it, by the way the PW department and town staff interpreted the project, then she would deny it. Lynn T. appreciated the applicant brought a plan B, since with the snow plowing issues in town, usually some parking spaces are lost. She uttered that Public Works would do its best on removing the snow in the streets and would definitely work with any resident in order to assist. Greg S. agreed with Burke H. on the front door opening to the inside, he believed it would be more convenient to move it a foot back. He didn't have a problem with the 5% storage required nor with the extra 18" roof over -hang. He also enjoyed the architectural feature on the design. Greg G. liked the project design, as it's an appropriate structure for the town's style. He said as it is a private construction, it is complicated to deny the project. Not really concerned about where the property owner pushes his own snow. He appreciated an option B, nevertheless wouldn't deny option A. Jeff A. agreed with Mr. Pukas about the way the 5% snow storage requirement is expressed in the code, could sound peculiar to some. He supports plan B with the modification of snow removal and storage needed. Greg S. stated they need a 3' landing by the front door. Thus, they would need to move the door backwards, as the landing can't be on a parking spot. Mr. Palmos explained he doesn't have a problem with building the door 3' behind. Planning Commission went over the materials proposed. Motion by Jeff A., second by Lynn T. to approve the design review application for 246 Main St. with the following conditions as presented in Option 2 as presented. Motion passed 4-1. (Nay Greg S.) Conditions: • Modification to create snow storage on the north side of the lot by shrinking the square footage of the building as presented in the second set of drawings presented. • Resolving as required by the adopted Int'l Building Code (2009) the front door issue of stepping out in to a parked car/parking space on Eagle St. Recess at 8:10pm Meeting back to order at 8:15pm 8. Holy Cross Power Lines — Holy Cross Advisory Group Janet H. noted the Holy Cross Energy proposal calls for a high voltage powerline, 65 feet tall. Currently there are 3 proposed routes and currently the Town of Minturn is serviced by Excel energy not Holy Cross. Janet H. described the map of town where Holy Cross energy is proposing to cross power lines, and the locations where they would be buried in the ground. The power lines certainly would cross Battle Mountain, who are not satisfied with the proposal at all. 9. Future Meetings: • March 28, 2018 • April 11, 2018 • April 25, 2018 10. Adjournment. Motion by Greg G., second by Jeff A. to adjourn the meeting at 8:30pm. Motion passed 5-0. Work Session Note: Work session began at 8:30pm and ended at 8:40pm • Chapter 16 Draft — Review changes Janet H. reviewed conceptual changes she is considering for the ongoing Chapter 16 review. She will bring these ideas back at a later Planning Commission meeting for full discussion.
