WHEREAS, Twehous Excavating Co., Inc.. has become the apparent lowest and best bidder on the Belmont Stormwater (600BIk) project/ NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The bid of Twehous Excavating Co., Inc., is declared to be the lowest and best bid and is hereby accepted. Section 2. The Mayor and City Clerk are hereby authorized to execute an agreement with Twehous Excavating Co., Inc., for the Belmont Stormwater (600Blk) project. Section 3. The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. Section 4. McCarty Street •Jefferson City, Missouri 65101 • P 573-634-6410 • F 573-634-6562 • wewv.ieffcitvmo.orq Date: August 11, 2015 To: City Council From: David Bange, P.E., City Engineer Subject: Belmont Stormwater Project Staff has selected Twehous Excavating as the bidder submitting the bid that is in the best interest of the City and is recommending them as the contractor to construct the Belmont Stormwater Project. Upon receiving and tabulating the bids staff noticed a number of items submitted by the low bidder were significantly lower than what was expected. We contacted the low bidder and discussed this issue with him. He acknowledged that he had made an error and that his concrete prices were only one ninth of what he had intended them to be. This mistake equates to approximately $50,000. In subsequent conversations with the lower bidder he voiced a desire to withdraw his bid, but this being the first time he submitted a bid for work with the City he felt that doing so would reflect poorly on him, and after reflection decided not to withdraw. While the low bidder's references gave positive reviews it does not appear as if he has done work that is the same as what is require for this contact. Given this reality, the bidder's stated desire to get out of the contract and the knowledge that the contractor will start the project in financial difficulty, it does not seem prudent to recommend the low bidder. In addition the second low bidder submitted a bid that is less than the engineer's estimate and is a contractor that is known to do produce a quality product in a timely and orderly fashion. It is for these reasons that Staff is recommending the bid from Twehous Excavating.
