HomeMy Public PortalAbout11-17-2008PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, NOVEMBER 17, 2008 The Common Council of the City of Richmond, Indiana met in regular session Monday, November 17, 2008 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GOODWIN President Parker presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. APPROVAL OF MINUTES Councilor Pappin moved to approve the minutes of the meeting of November 3, 2008, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ Mayor Hutton introduced Sam Lahanis as the new Superintendent of the Sanitary District. COMMUNICATION FROM THE MAYOR • Ms. Hutton thanked the employees of the Street Department for their efforts "over and above" the call of duty for removing huge trees from the Gorge. • A copy of the United Way Survey was distributed to each Councilor. This survey will be on the City web site soon. • Information from the National Cities and Towns conference was shared. Legislators need to be encouraged to vote for the plan to create jobs. ■ The Depot District will begin their Tuesday Christmas celebrations December 2 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Councilor Quinn asked about the process for the demolition of unsafe buildings. Mayor Hutton responded the contracts are awarded to the lowest and best bid on each house and paid from the Unsafe Building Fund which is funded through Economic Development Income Tax and Tax Increment Finance monies. Minutes of the October 30 and November 6, 2008 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None Common Council Minutes November 17, 2008 Page 2 of 3 MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 81, 82 and 86 -2008 on first reading by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. ORDINANCE NO. 81 -2008 - AN APPROPRIATION ORDINANCE AMENDING THE 2008 BUDGET The Clerk read Ordinance No. 81 -2008 on first reading by title only. Presented by Police Chief Kris Wolski, this ordinance would authorize a transfer of funds within the 2008 Police Department budget line item for Fleet Gas and Oil. Councilor Wissel moved to advance Ordinance No. 81 -2008 to second reading and to suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 81 -2008 on second reading by title only. Council President Parker declared Ordinance No. 81 -2008 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 81 -2008, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 81 -2008 to third and final reading and suspend the rules and read by title only, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 81 -2008 on third reading by title only. Ordinance No. 81 -2008 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 82 -2008 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS The Clerk read Ordinance No. 82 -2008 on first reading by title only Presented by City Controller, Tammy Glenn, this Ordinance would authorize the appropriation of additional sums of money to the 2008 Budget as follows: General Fund - Police Department ($170,000); General Fund -Human Resources ($35,000); General Fund -Board of Works ($200,000); Cumulative Capital Development ($70,000) and Richmond Municipal Airport ($7,000). Councilor Wissel moved to advance Ordinance No. 82 -2008 to second reading and to suspend the rules and read by title only, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 82 -2008 on second reading by title only. Council President Parker declared Ordinance No. 82 -2008 on second reading and public hearing. Speaking in favor were Police Chief Wolski, Fire Chief Crawley and Airport Manager, Rodney Mayse. There being no comments against the Ordinance, Councilor Pappin moved for engrossment of Ordinance No. 82 -2008, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 82 -2008 to third and final reading and suspend the rules and read by title only, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 82 -2008 on third reading by title only Common Council Minutes November 17, 2008 Page 3 of 3 Ordinance No. 82 -2008 was adopted with an 8 -1 roll call vote. Dissenting was Councilor Quinn. ORDINANCE NO. 86 -2008 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (J.M. Hutton) The Clerk read Ordinance No. 86 -2008 on first reading by title only. Presented by Councilor Wissel, this Ordinance is a request of J.M. Hutton & Co., Inc. for a for a ten -year tax abatement on equipment valued at $738,427. Ordinance No. 86 -2008 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 75 -2008 — AN ORDINANCE AUTHORIZING THE RECOVERY OF COSTS FOR EMERGENCY MEDICAL SERVICES PROVIDED BY THE RICHMOND FIRE DEPARTMENT; ESTABLISHING FEE SCHEDULES; AND APPROVING APPROPRIATIONS OF FEE PAYMENTS The Clerk read Ordinance No. 75 -2008 on second reading by title only. This Ordinance would allow the City of Richmond to bill responsible parties or their insurance companies for emergency ambulance response services that are provided by the Richmond Fire Department. Councilor Miller moved to amend section 80.04(b) by deleting (2) sea; or, supported by Councilor Pappin. Upon a vote viva voce, the motion passed. Council President Parker declared Ordinance No. 75 -2008 as amended on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 75 -2008 as amended, supported by Councilor Quinn. Upon a vote viva voce, the motion failed. Dissenting were Councilors Elstro, Wissel, Miller, Parker, Welch and Pappin. Ordinance No. 75 -2008 as amended was held on second reading until December 15, 2008. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
