TOWN BOARD
JUNE 7, 2000
The regular meeting of the Town Board was called to order at 7:30 p.m. Board present
were Mayor Soles, Klancke, Wirsing, Larson, Manly, Shapiro and Rantz. Staff present
were Reid, Durbin, Winter and Havens.
Klancke made a motion approving the minutes of the 5/17 and 5/31 meetings, 2nd Rantz,
carried.
OPEN FORUM

UPDATES
Chamber
Catherine Ross gave the events update and handed out various brochures.
Housing Authority
. Ross gave an update regarding the Fox Run project.
PUBLIC HEARINGS
EAST MOUNTAIN FILING #1- FINAL PLAT
EAST MOUNTAIN FILING #1-FINAL PLAN DEVELOPMENT PLAN
Wirsing made a motion to open the public hearing on East Mountain Filing #1 final plat
and East Mountain FiUng #1 FPDP and to review the plats at the same time, 2nd Shapiro,
carried.
Reid reviewed the filings and summarized the outstanding issues. McGowan
commented on the issues that are outstanding.
Jack Bestall reviewed the project and commented on the outstanding issues.
Rantz and Larson voiced concern about the old bridge being used for all of the beginning
construction. Traffic control and safety are of major concern. Bestall spoke to the
control measures they will have in place to control the use of the road and insure safety.
Bestall submitted a letter from St. Bernard's Church that states Maryvale is working on
traffic control etc. related to the activities that the church will be having.
Shapiro made a motion to close the public hearing, 2nd Wirsing, carried.

. Wirsing made a motion to approve the East Mountain Filing #1 Major Subdivision Plat'/
East Mountain Filing #1 Final Plan Development Plan with the following conditions:
1. A completed subdivision improvement agreement as approved by the Town
Board.
2. A prepaid system development fee agreement as approved by the Town Board.
3. Offsite public improvement easements as approved by the Town Attorney.
4. The easement provided by the Urban is either broadened to include utilities or
the utilities are moved within the boundaries of lots 46 and 47.
5. The executable water deed is provided and approved by the Town Board.
6. If we have not received the soil sample for lot 4ElO prior to final plat
recording, a plat note will be added stating that "Lot 4ElO is intended to be used
as the site for a water storage tank. If this site is unsuitable for a water storage
tank site, an alternative site shall be found and a correction note to this final plat
shall be filed." If we do receive the soil sample prior to recording and it shows
the lot 4ElO as unsuitable, an alternative site will be shown on the final recorded
plat and plan.
. 7. The intersection of Local Road A with Local Road A be redesigned to meet
Fraser's subdivision regulations and mountain roadway standards approved for
East Mountain Filing #1.
8. Lots 4El - 4ElO shall be conveyed by final plat recording.
9. Planning area 4E shall be conveyed by Oct. 31, 2000.
10. Final construction design and detail shall be approved by Fraser's Town
Engineer or Water Engineer prior to any construction but not as a requirement of
plat recording.
11. The linear park deed given and approved by the Town Board.
12. Easements provided for water and sewer located outside of dedicated rights-
of-way shall be kept clear. of vertical vegetation and shall be aCcessible by vehicle
or heavy equipment. (This can be identified as a plat/plan note.)
13. All technical changes to the plat/plan as discussed by Fraser's Town Board,
Planning Commission, and staff are changed on the final recorded documents.
. 14. Consultant fees not covered by the planning fees already paid by the
applicant shall be paid (by the applicant).

ACTION ITEMS
Safeway representatives asked the Board to reconsider a sign variance for the new store.
After full discussion Board denied request.
Representatives of the Fraser Drug asked for a sign variance. After full discussion,
Wirsing moved to deny a variance, 2nd Rantz, carried.
Reid reviewed the Phase II paving project and the costs of the project. The costs are
more than expected and Reid advised how the costs could be handle~ in the budget.
Rantz made a motion to approve change order #5, phase 11 of the paving project at a cost
of $1,050,000, 2nd Manly, carried. ,
DISCUSSION ITEMS
Grand County Water and Sani. District has asked for an extension of time to complete the
construction of the plant. Klancke made a motion to extend the timeframe to March of
2002 with the condition that the dirt piles get spread and reseeded by Aug. 31, 2000, 2nd
Rantz, carried.
. STAFF CHOICE
The Town has an agreement with Joe Fuqua, operator of the Fraser Sanitation District, to
serve as the Town's water licensee.
Learning Center has permission to use the Town paint roller.
Reid will be attending CML conference next week.
WPW is happy with the silt fencing installed along the 2nd access to Safeway.
GCWQQ has preformed the core samples on the 2nd access road, and the results were not
a matter of concern.
Jim Hoy will be installing more bronzes at the History Park in a couple of weeks.
BOARD CHOICE
Snowmelt facility and storage of snow still need to be worked on.
Retreat should be scheduled.

Context
The sulJject property is located in a residential area with a variety of housing types
including both single family detached and townhomes. It is located at t~e end of the _ ,:
street where the landscape transitions to a more natural character. The owner intends to
maintain that natural landscape character with the landscape plan, however, a detailed,
. landscape plan has not been provided. .

Zoning
The subject property is zoned R-2 Medium Density Residential. This district allows as a
permitted use a building that contains no more than four dwelling units on a single parcel
of land.
The minimum yard requirements in this district are as follows:
Front 20 feet
Side 7 feet
Rear 10 feet
The proposed resubdivision provides adequate site area such that the first new building
would comply with these setback requirements. The applicant must confirm, however, if
the rear yard setback for the existing house will comply with the rear yard setback
requirement of 10 feet, or if a non-conforming setback is being established. The Planning
Commission was not supportive of the creation of a new non-conformity. Additionally, it
is recommended that the owner demonstrate that the remaining two lots are appropriately
sized for future development. Staff would not support variances on these lots in the
future if they were not sized by the applicant appropriately to accommodate the
additional two townhome buildings.
. The building height requirements (max 35 feet) will be confirmed prior to issuance of a
building permit. The proposed building would exceed the minimum building footprint
requirement of 500 square feet.
Engineering
Engineering review has not yet been completed as the applicant has not provided grading,
drainage, or erosion control plans. The site does not appear to present any unusual
engineering challenges, however, guidance from the Board on these requirements would
be appropriate. Technically, Town Codes require full submittal of such plans for
subdivisions, though the applicant expresses concerns about completion of these plans.
Though removed from the final submission, previous plans included a note "natural
drainage" along with an arrow to address the drainage plan requirements.
I have also discussed an off site drainage and access matter with the owner that requires
additional consideration. These issues result from the fact that Eisenhower in front of the
property includes both gravel and paved improvements. Staff needs some direction from
the Board regarding pursuit of these improvements.
Legal
. The applicants attorney has responded to the Town Attorney comments, however, our
review of that response is forthcoming. No major concerns are anticipated.

Fire District Comments
The Fire District has indicated that for emergency access, the two way drive will require
a minimum width of 24 feet. Additionally, a hammerhead or some other means of turn-
around movement for larger vehicles will be required with the development of lot 2/3.
Comments
The commission discussed two issues that appear to be unaddressed by town code. The
proposed plat includes one lot that has no direct access to a public street. It will be
necessary to establish an access easement across lot 2 to arrive at lot three. This should
be discouraged due to the conflicts that often result. Additionally, the plat includes a
"flag lot." (lot 4) This is often discouraged, and the subdivision ordinance only notes
that "lots with unusual configurations will be discouraged, unless topography or other
physical limitations of the property suggest otherwise." I anticipate further discussion of
this matter relative to future development with the commission.
In an effort to maintain the existing house, lot 4 does not have sufficient frontage. The
. zoning ordinance requires a minimum lot width of 50 feet, approximately 35 is provided
by lot 4. As the plan is seeking to maintain the existing house, per planning commission
direction, and the code does not require any frontage (note lot 3), it seems inappropriate
to require revisions. Perhaps we should address this in our code? Again, I anticipate
further commission discussion for future development.
The applicant has building elevations that he will present for your consideration. The
design consists primarily of wood siding, a simple pitched roof, decks, and some minor
log work.
The applicant has not provided a landscape plan. Board direction on this requirement is
appreciated as the applicant feels it is reasonable to note that on the plan "natural
vegetation." Although this note has been deleted from the final submission.
Some minor refinement to the plat of resubdivision is required. The access easements
across lots 2 and 3 are not complete. Lot 1 includes a utility easement that is isolated in
the middle of the lot, it appears that the intent is that tbe access easement is a "utility and
access" easement. The access easement is not a ROW (right of way) as it is not
anticipate to be a public street. The plat should be referred to as a final plat of
resubdivision, not an amended final plat.
Note that the future development of lot 3 must include relocation of an existing power
line.

Recommendation
Staff is generally comfortable with this proposal, though there are a series of items that
remain to be addressed. The applicant is anxious to move forward and hopes to address
the remaining technical issues after Board approval. Accordingly, a suggested motion for
conditional approval is provided for your consideration.
I move that we approve, the final plat of resubdivision of Lots 1, 2, and 3 Block 3
Workshire Acres and the final plat for Byers Peek Townhomes of Fraser subject to the
following conditions:
The existing house located on the newly created lot 4 must comply with the rear
yard setback requirement of 10 feet.
The driveway width of 24 feet shall continue through to lots 2 and 3.
Additionally, a hammerhead or some other means of turn-around movement for
larger vehicles will be required with the development of lot 2 or lot 3.
. The future development of lot 3 shall require the relocation of the existing
power line.
Address the plat notes and details as outlined in the staff report.
Inclusion of unit addressing on the final plat prior to recordation (addresses to
be provided by staff)
Payment of all appropriate fees.,
Compliance with the requirements of the Town Engineer and Town Attorney
Provision of an acceptable Subdivision Improvement Agreement.
Provision of a detailed Landscape plan, drainage plan, grading plan, and
erosion control plan.
