HomeMy Public PortalAbout008-1983 - Correcting The Code of OrdinancesORDINANCE NO. 8-1983 AN ORDINANCE CORRECTING THE 1982 S-2 SUPPLEMENT TO ORDINANCE NO. 72-1980, OTHERWISE KNOWN AS THE CODE OF ORDINANCES OF THE CITY OF RICHMOND, INDIANA. WHEREAS, American Legal Publishing Company of Cincinnati, Ohio in codifying the 1982 S-2 Supplement to Ordinance No. 72-1980 did not follow certain organizational and chapter numbering procedure in codifying Ordinance No. 54-1981, Sewage and Wastewater Treatment, and Ordinance No. 49-1981, User Charges; and WHEREAS, the above recited ordinances did not in fact totally repeal Chapter 50 as originally place in the Municipal Code by Ordinance No. 72-1980 which chapter was omitted from the 1982 S-2 Supplement in Ordinance No. 8-1982; and WHEREAS, American Legal Publishing Company has now completed the supplement by replacing Chapter 50 and including therein the totality of Ordinance No. 49-1981 and Ordinance No. 54-1981 as two new chapters in Title V of the Municipal Code, being Chapters 53 and 54; and WHEREAS, Indiana Code 36-1-5-1 et seq. empowers and authorizes the Common Council to revise, amend, restate and codify all ordinances and to incorporate said ordinances into one book form; and WHEREAS, it is the intent of the Common Council of the City of Richmond, Indiana to accept such corrections to its codified ordinances and hereby determines and declares that such revisions are a restatement and re-enactment of its original adopting Ordinance No. 72-1980 and amendment to Ordinance No. 8-1982. NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that: SECTION 1. The enactment of new sections as submitted by the American Legal Publishing Company of Cincinnati, Ohio are incorporated herein by reference as if fully written. SECTION 2. The re-enactment of Chapter 50 of the Municipal Code as submitted by the American Legal Publishing Company of Cincinnati, Ohio is incorporated herein by reference as if fully written. SECTION 3. These corrections to the City of Richmond, Code of Ordinance (Ordinance No. 72-1980) as reviewed and approved by the Common Council are hereby adopted. SECTION 4. This ordinance shall take effect and be in full force from and after its adoption and due authentication by the President of the Common Council, the Clerk of the City of Richmond and the Mayor of the City of Richmond, Indiana and the Clerk of the City of Richmond, Indiana is hereby ordered to file in the Office of the Clerk two (2) copies of the revised code for public inspection. 2 - r PASSED and ADOPTED this _ .; day of �I,:.,C-,ems r 1983, by the Common Council of the City of Richmond, Indiana. DICKMAN MAYOR February 15, 1983 Mr. Kenneth Mills, President Members of Common Council and Ms. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Re -codification of Ordinance No. 49-1981 and Ordinance No. 54-1981 and re-enactment of Ordinance No. 2858-1973 (Chapter 50 of the Municipal Code) Dear Mr. Mills, Members of Common Council and Ms. Trimble: The Sanitary Department has complained that the Sewer Rate Ordinance No. 49-1981 and the Sewer Usage Ordinance No. 54- 1981 were not correctly codified into the city code by Ordinance No. 8-1982 which incorporated these two ordinances. The American Legal Publishing Company of Cincinnati, Ohio, the codifier, combined these two ordinances into one code section and in doing so eliminated the old Chapter 50 being Ordinance No. 2858-1973. We have been advised by the Sanitary Department that the sewer rate ordinance and the sewer use ordinance were intentionally drafted to insure that the definitions and provisions would not be confused and that enforcement would be independent of each other.
