HomeMy Public PortalAbout010-1983 - Amending Chapter 154 - Zoning - 507 West Eaton PikeGENERAL ORDINANCE NO. 10-1983 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 507 WEST EATON PIKE FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 desig- nates and describes as R-2 One -Family Residence District, the property located at 507 West Eaton Pike in Wayne County, Indiana; and, WHEREAS, it is the intent and purpose hereof to change the zoning classi- fication of said property from R-2 One -Family Residence District to C-4 General Business District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 23rd day of February, 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. WHEREAS, the vote of the Richmond City Plan Commission was nine (9) to zero (0) in favor of recommending the passage of Ordinance No. 10-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to C-4 General Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. The following described real estate situated in Wayne County, State of Indiana, to -wit: Being a part of the Southeast Quarter of Section 36, Township 14 North, Range 1 West, in Wayne Township, Wayne County, Indiana, and more particularly described below: Commencing at the southwest corner of said quarter; thence north 0 degrees 01 minute 55 seconds east 152.46 feet; thence south 73 degrees 57 minutes 05 seconds east 351.32 feet; thence north 17 degrees 57 minutes 05 seconds west 168.26 feet; thence south 88 degrees 12 minutes 10 seconds east 37.31 feet to a point in the east right-of-way line of the PennCentral Railroad and the place of beginning of this description: Thence south 88 degrees 12 minutes 10 seconds east 756.880 feet to a point in the west right-of-way line of U.S. Highway #35; thence north 28 degrees 43 minutes 20 seconds west along said west right-of-way line 348.230 feet; thence north 88 degrees 12 minutes 10 seconds west 701.730 feet to a point in the east right-of-way line of said PennCentral Railroad; thence south 20 degrees 16 minutes 59 seconds east, along the chord of a 5764.58 feet radius curve to the right an arc distance of 323.771 feet to the place of begin- ning, containing an area of 5.011 acres, more or less. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required.
