The City of Moab will hold a Special City Council Meeting on Friday, October 27, 2017 at 12:15 PM.
The purpose of this meeting will be:
1-1 Approval of the Granting of Local Consent for a Package Agency Contract for the Moab
Brewery, d.b.a. Moab Brewers LLC Located at 686 South Main Street
1-2 Approval of Proposed Resolution #59-2017 —A Resolution Authorizing the Mayor on
Behalf of the City of Moab to Sign a Memorandum of Understanding with Utah State
University and Grand County Regarding the Proposed USU Branch Campus Development
The meeting will begin in the Council Chambers at the City Center, 217 East Center Street, Moab, Utah.

Background/Summary:
This applicant was previously issued a manufacturing license from the
Department of Alcoholic Beverage Control for their expanded location at 690
South Main Street D.B.A. Moab Distillery. In order to sell the vodka from the
distillery at their 686 South Main Street location, the DABC is requiring
another Local Consent.
Options: Approve, deny, or modify.
Staff Recommendation: City staff recommends approval of this Local
Consent.
Recommended Motion: "I move to approve the Local Consent for a Package
Liquor Agency for Moab Brewers L.L.C."

Title: Resolution authorizing Mayor to sign Memorandum of Understanding
with USU and Grand County regarding the USU Campus Development

Recommended Motion: I move to adopt a resolution authorizing the Mayor
on behalf of the City of Moab to sign a memorandum of understanding with
Utah State University and Grand County regarding the proposed USU Branch
Campus development.
Background/Summary:
This MOU provides assurances to the County and the City that USU is
committed to the development of the new branch campus complex across
from the Millcreek Drive intersection. Signing this MOU enables the County
and the City to move forward in the process to secure funding for the jointly -
funded road and utility infrastructure project that connects U.S. 191 with the
new campus location.
This document is a preliminary expression of the Parties' general intentions,
and it is understood that no party shall have any contractual obligations to the
others with respect to the matters referred herein unless and until a definitive
agreement has been fully executed and delivered accordingly.
CITY OF MOAB RESOLUTION NO. 59-2017, A RESOLUTION AUTHORIZING THE
MAYOR ON BEHALF OF THE CITY OF MOAB TO SIGN A MEMORANDUM OF
UNDERSTANDING WITH UTAH STATE UNIVERSITY AND GRAND COUNTY
REGARDING THE PROPOSED USU BRANCH CAMPUS DEVELOPMENT
The Council authorizes the Mayor to sign the attached Memorandum of
Understanding with Utah State University and Grand County that memorializes the
parties' expectations for timing for construction planning and fundraising with
regard to the proposed development of USU's new branch campus.
It is understood that this memorandum of understanding is a preliminary
expression of the Parties' general intentions. The Parties intend that no Party shall
have any contractual obligations to the others with respect to the matters referred
to in the Memorandum unless and until a definitive agreement has been fully
executed and delivered by the Parties.
The foregoing resolution is approved and adopted by action of the Moab City
Council, as set forth below. This resolution shall take effect immediately.

Memorandum of Understanding
Between Utah State University, Grand County, and the City of Moab
Regarding the Proposed New USU Moab Campus
The purpose of this letter is to confirm the mutual understandings and intentions of the City of
Moab ("City") and Grand County, Utah ("County") and Utah State University ("USU')
regarding the proposed construction project in Moab, Utah. As we have discussed, the City, the
County, and USU intend to move forward with the proposed campus project based on the
following terms and conditions:
1. That USU agrees to begin the planning, programming, and design phases for construction
of a $10 million building on the intended future Moab campus. USU commits to $5
million of funding for this project, on or before the end of 2020, with the understanding
that a minimum of $5 million additional funds will be raised by the community for
construction of the facility. It is understood that a significant portion of the USU
commitment of $5 million will come from the sale of the existing USU Moab Center
buildings and property;
2. That USU supports the exploration of reasonable growth pertaining to programming and
curriculum in accordance with their rural education mission and in alignment with
County and City economic development goals;
3. That the City and the County agree to invest in the reasonable road and utility
infrastructure necessary to allow USU to fulfill their obligations in Section 1.
4. This letter of intent will expire on December 31 st, 2018.
