HomeMy Public PortalAbout013-1983 - Amending Chapter 154 - Zoning - 1915 Chester BlvdAMENDED GENERAL ORDINANCE NO. 13-1983 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1.968, COMMONLY KNOkVN AS THE ZONING ORDINANCE' OF 1HE CITY OP RICHMOND, INDTANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1915 CHESTER BOULEVARD FROM R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT TO C-1 SU LIMITED COMMERCIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A COMMERCIAL DEVELOPMENT UNIT PROJECT. WHEREAS, The Zoning Map which is part of Ordinance No. 2325-1968 designates and des- cribes as R-3 One -to -Eight Family Residence District the property located at 1915 Chester Boulevard; and, WHEREAS, It is the intent and purpose hereof to change the zoning classification of said property from R-3 One -to -Eight Family Residence District to C-1 SU Limited Commercial Special Use District and to authorize the Special Use of said property as a commercial development unit project; and, WHEREAS, pursuant to Articles 45 and 48 of Chapter 154 of the Municipal Code, the Richmond City Plan Commission has conducted a public hearing on the pre- liminary plan of the subject Commercial Development Unit Project; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commis- sion the 22nd day of March, 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was seven (7) to zero (0) in favor of recommending the passage of Ordinance No. 13-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-1 SU Limited Commercial Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. The following described real estate situated in the City of Richmond, Indiana, to wit: Being a part of the Northwest Quarter of Section 28, Township 14 North, Range 1 West in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at a cross cut in the west line of the Northwest Quarter of said Section 28, said point being 165.20 feet south, 0 degrees, 55 minutes, and 10 seconds west of a cross found at the northwest corner of said Northwest Quarter, and running thence, from said beginning point, south 88 degrees, 49 minutes, and 50 seconds east, parallel with the north line of said Northwest Quarter, 1092.08 feet to an iron pipe found; thence south 0 degrees, 59 minutes, and 47 seconds west 145.01 feet and 50 seconds west 1091.88 feet to a cross cut on the west line of said Northwest Quarter; thence north 0 degrees, 5S minutes, and 10 seconds east, along said west line, 146.92 feet to the place of beginning, containing an area of 3.659 acres, there being 0.135 acres in the right-of-way of Unitm. States High- way Number 27. SECTION 2. That as provided in Articles 30, 45 and 48 of Chapter 154 of the Muni- cipal Code, the following described use of the above described real estate is allowed as a Special use as a commercial development unit project. SECTION 3. As a condition of the aforesaid Special Use and as an additional re- striction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The site plan accompanying the petition shall be marked Exhibit A and made a part of the Ordinance. b. The record plan depicting the project boundary and necessary easements shall be marked Exhibit B and made a part of the Ordinance. c. The land uses permitted within the Commercial Development Unit Project shall be limited to 1M�� Administrative, or Professional offices. Medical dental d. There shall be established a 100' setback from the east property line of the project. 'Phis setback area shall be left in its natural state to serve as a buffer area to protect adjoining property owners. No building, construction or other type of development shall occur within this setback area. e. The following conditions shall be met prior to the time an Improvement Location Permit is issued: (1) The owner shall execute and record all necessary casements. (2) The owner shall submit to the City Plan Director legal doctunen- tation of his right to use the private drive of the property ad- joining to the north until such time as this private drive shall be dedicated and accepted by the City of Richmond, Indiana. SECTION 4. That pursuant to Article 45.051 of Chapter 154 of the Muncipal Code, the minimum site area of the Commercial Development Unit Project shall be reduced from five (5) acres to 3.659 acres and also the minimum distance from 50 feet to 20 feet in only those instances as shown and in accor- dance with the Site Plan, Exhibit A of this Ordinance. SECTION S. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Dickman ATTEST: r. � ( (_" . ,- _ t - `t City Clerk CITY PLAN COMMISSION RICHMOND, INDIANA ).Oslo March 30, 1983 Mr. Kenneth Mills, President Members of Common Council and Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 13-1983 Plan Commission Case No. PUD-83-3 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, March 22, 1985, on the petition of Harold and Wanda Wood, Owners, Gayle Gardner, Agent; requesting a rezoning from the R-3 One -to -Eight Family Residence Dis- trict to C-1 SU the Limited Commercial Special Use District and requesting that a Special Use be granted for a Commercial Development Unit Project on property located at 1915 Chester Boulevard. The proposed project is an office development consisting of three (3) struc- tures to be occupied by five (5) physicians. Fifteen (15) notices of public hearing were sent to surrounding property owners with one (1) returned in favor of the project and two (2) returned in opposi- tion to the project. During the public hearing no one spoke in opposition to the request. The Plan Commission determined the proposed project meets or exceeds all the requirements of the Zoning Ordinance and, therefore, voted seven (7) to zero (0) to recommend that Ordinance No. 13-1983 be approved as written with the conditions in Section 3 of the Ordinance. ctfully submit ed, LD-T- W-� Robert B.
