AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNiCTP.AL CODE, BEING ORDINANCE NO. 2325-1968,
COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED TINE
3, 1968, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY GENERALLY BOUNDED BY THE COR-
PORATION LIMITS, WEST EATON PIKE, ROBY LANE AND THE, N$W RAILROAD FROM R-2 SINGLE FAMILY
RESIDENCE DISTRICT AND A-1 AGRICULTURAL DISIRICI' TO C-4 GENERAL BUSINESS DISTRICT.
WHEREAS, The Zoning Map which is part of Ordinance No. 2325-1968 designates and
describes as R-2 Single Family Residence District and A-1 Agricultural
District the property generally bounded by the Corporation Limits, West
Eaton Pike, Roby Lane and the N$W Railroad; and,
WHEREAS, the above referenced property is shown and designated on a map attached to
this Ordinance and marked Exhibit "A" hereof and by reference made a part
hereof; and
1*1EREA9, it is the intent and purpose hereof to change the zoning classification
of said property from R-2 Single Family Residence District and A-1
Agricultural District to C-4 General Business District as designated on
the map marked Exhibit "A"; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commis-
sion the 22nd day of March, 1983, at which time remonstrances were heard
from all parties interested in or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was seven (7) to zero (0) in
favor of recommending the passage of Ordinance No. 14-1983.
NOW THEREFORE BE 11' ORDAINED by the Common Council of the City of Richmond, Indiana,
as follows:
SECTION 1. That the map, marked Exhibit "A" designating the area to be rezoned from
R-2 Single Family Residence District and A-1 Agricultural District to C-4
General Business District is hereby made a part of Ordinance No. 14-1983.
SECTION 2. That the zoning classification of the above described property be, and
the same is hereby changed to C-4 General Business District as designated
and described in Exhibit "A" hereof and that said property be regulated in
accordance with the Zoning Ordinance of the City of Richmond, Indiana, and
all amendments thereto.
SECTION 3. This Ordinance shall be in full force and effect from and after its
passage and approval as by law required.
PASSED AND ADOPTED by the Common Council of the City of Richmond, Indiana, this
day of 1983. _

Dear Mr. Mills, Members of Common Council and Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on Tuesday, March
22, 1983, on its own initiative, requesting to rezone certain property located
on West Eaton Pike from R-2 Single Family Residence District to C-4 General
Business District. The property in question is generally bounded by the Cor-
poration Limits, West Eaton Pike, Roby Lane and the N&W Railroad. Exhibit "A'
of Ordinance No. 14-1983, is a map which specifically designates the area pro-
posed to be rezoned.
Thirteen (13) notices of public hearing were sent to adjoining property owners
with none returned in favor of or in opposition to the request. During the
public hearing, Mr. Wiley Foust, who owns a portion of the property proposed
to be rezoned, questioned the Plan Commission concerning the affect the re-
zoning would have on his property.
The Plan Commission voted seven (7) to zero (0) to recommend the adoption of
Ordinance No. 14-1983, and pursuant to I.C. 36-7-4-607 determined the following:
1. The Master Plan designation for the property is General
Business which corresponds to the C-4 'Zoning District.
2. Historically, the property has been occupied by C-4 non-
conforming uses and the rezoning would reflect the actual
use of the property and would be compatible with adjacent
land use and zoning.
3. The proposed rezoning would not adversely affect surround-
ing property values or prevent the use of adjacent pro-
perty for a use already permitted.
