HomeMy Public PortalAbout015-1983 - Amending Chapter 154 - Zoning - 4611 and 4619 National Rd WGENERAL ORDINANCE NO. 15-1983 AN ORDINANCE ANIFNDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, CON24ONLY KNOWN AS THE ZONING ORDTNANCE OF THE CITY OF RIC[MND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR 'PEIE REZONING OF PROPERTY LOCATED AT 4611 AND 4619 NATIONAL ROAD WEST FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-1 LIMITED CONT4ERCIAL DISTRICT. WHEREAS, the Zoning Map which is part of Ordiannce No. 2325-1968 designates and des- cribes as R-2 Single Family Residence District the property located at 4611 and 4619 National Road West; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-2 Single Family Residence District to C-1 Limited Com- mercial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 22nd day of March, 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was seven (7) to zero (0) in favor of recommending the passage of Ordinance No. 15-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to C-1 Limited Commercial District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. The following described real estate situated in Center Township, Wayne County, State of Indiana, to wit: Lots 5, 6, 7 and 8 in the Herman F. Pilgrim Addition. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 15-1983 Plan Commission Case No. PC-83-2 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, March 22, 1983, on the petition of McClellian and Brenda Smith, Owners, requesting to rezone property at 4611 and 4619 National Road West from R-2 Single Family Residence District to C-1 Limited Commercial District. Twelve (12) notices of public hearing were sent to surrounding property owners with none returned in favor of or in opposition to the request. During the public hearing no one spoke in opposition to the request. The Plan Commission voted seven (7) to zero (0) to recommend the passage of Ordinance No. 15-1983, and pursuant to I.C. 36-7-4-607 determined the following: 1. The property in question is adjacent to M-2 and C-4 zoning districts and is located along a major thoroughfare. 2. The long term land use development for the area is commer- cial rather than residential and the requested rezoning would be a logical extension of the existing commercial district. 3. The intent of the C-1 Zoning District is to permit the location of commercial uses adjacent to a residential district without detracting from the quality of life or property values of the residential area. es fully submitte Robert B.
