AUTHORIZING EMERGENT REPAIRS TO THE CARTERET
INDUSTRIAL ROAD/MIDDLESEX AVENUE
WHEREAS, the Borough Engineer has advised the Governing Body that an
approximately five hundred foot (500') section of the Carteret Industrial Road, also
commonly know as Middlesex Avenue has completely failed; and
WHEREAS, the Borough Engineer has informed the Governing Body that said failure
posses immediate threat to the public health and safety of the traveling public; and
WHEREAS, due to said emergent conditions the Borough needs to provide for the repair
of said roadway; and
WHEREAS, the New Jersey Department of Transportation has provided partial funding
assistance to make said repairs immediately; and
WHEREAS, the Borough needs to authorize the Borough Engineer to solicit formal bid
proposals outside of the requirements of the Public Contracts Laws; and
WHEREAS, the Public Contracts Laws allows for such deviation in emergency
situations.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the Borough Engineer hereby is authorized and directed to solicit formal
proposals, and (recommend an award of a contract for) the emergent repairs to
Industrial Road/Middlesex Avenue as soon as possible.
2. That the Governing Body hereby awards the contract for said emergent repairs
based upon the Borough Engineer's recommendation.
3. That a copy of this Resolution be forwarded to the Borough Engineer, Borough
Attorney and Purchasing Department.

and certified as a true copy of the
original on April 23, 2004.
