Chairman Scrivner called the meeting to order at 7:30 a.m. A quorum was present at this time.
The following guests were present: Mayor Carrie Tergin, Councilman Mark Schrieber, Cary Gampher
with Architects Alliance, Kevin Rome, Michael Henderson, Gassner, and Kevin Pigford with Lincoln
University, Bill Ambrose, Steve Walker, Vicki Schildmeyer, Wayne Lee, and Madeleine Leroux (News

2. Approval of the June 18, 2015 Committee meeting minutes
Councilman Costales moved and Councilman Henry seconded to approve the June 18, 2015
minutes, motion carried. Councilwoman Ward was absent for this vote.

1. Highcliff Street Vacation (Britt Smith)
Mr. Smith explained the vacation would clarify the use of the property.
Councilman Costales moved and Councilman Henry seconded to refer the vacation to the City
Council with recommendation to approve, motion carried. Councilwoman Ward was absent for this
vote.

2. Elm Street Vacation (Lincoln University Tennis Court Area) (David Bange)

Mr. Bange explained this section of Elm Street will be permanently cut off from Lafayette
Street and the existing box culvert over the creek will be removed. This will enable the redevelopment
of the area.
Councilman Henry moved and Councilman Prather seconded to refer the vacation to the City
Council with recommendation to approve, motion carried.
3. Chestnut Street Vacation for Lincoln University (Matt Morasch)
Mr. Morasch explained staff has reviewed the request from a traffic standpoint and determined
that while it may inconvenience residents living adjacent to the area it is not uncommon for
university's to close street s in the heart of their campus especially during high pedestrian traffic time
and will support the request.
There was discussion among Committee members, staff and those present regarding full
closure, closures at certain times, service and emergency vehicle access, and safety of students. Mr.
Ambrose and Mr. Walker both spoke against the street closure.
Councilman Henry moved and Councilman Costales seconded to refer the vacation to the City
Council with recommendation to approve, motion carried with the following votes:

Nay: Prather, Scrivner
4. Airport Construction Update (Britt Smith)
Mr. Smith explained the progress of the construction stating both runways would be closed for
a couple of weeks to complete the project.
5. Sink Hole Report (Don Fontana)
Mr. Fontana explained the locations of several sink holes throughout the City.
6. Transit Route Changes to Accommodate Sam's Club (Mark Mehmert)
Mr. Mehmert explained the route changes to the Committee.
4. Other Topics

Ms. McMillan referred Committee members to the reports included in the packet.

WHEREAS, Engineering Surveys and Services, Inc., is the best qualified firm to provide professional
services related to the design of the ABB Pump Station and Forcemain Replacement
project.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. Engineering Surveys and Services, Inc., is approved as the best qualified firm to
provide professional services and its proposal is hereby accepted
Section 2. The Mayor and City Clerk are hereby authorized to execute an agreement with

Summary: This bill would authorize a contract with Engineering Surveys and Services,
Inc., to design the ABB Pump Station and Forcemain Replacement
Origin of Request: City Staff
Department Responsible: Department of Public Works
Person Responsible: MATTHEW J. MORASCH, P.E./ Eric Seaman, P.E.
Background Information: This project will design replacement of the pump station that
serves ABB, the airport, Holts Summit, and approximately 200 other customers in
unincorporated Callaway County.
The station is over 40 years old is showing the effects of having been flooded in 1993
with the dry pit and pumps requiring replacement. The forcemain is comprised of
transite pipe which was an inferior technology that was prone to leaks and is no longer
utilized today. Holts Summit has made a long-term (35-40 year) commitment to transfer
all their flow to Jefferson City for treatment.

Thanks for the information. In reviewing the document I noticed that it includes all design fees, but excludes surveying
and geotechnical services. Is that what you were thinking?
I am confident we can get to an acceptable fee as a percentage of construction. I have removed the contingency we
discussed, the additional effort to extend the line to the treatment facility and tightened other areas. We have asked
Burns and McDonnell to do the same and expect something today or tomorrow.

ABB Pump Station and Forcemain Replacement-Scope of Work
City of Jefferson, Missouri-Public Works Department
Project Description
Engineering Surveys and Services (Engineer) will provide professional engineering and project
management services to the City of Jefferson, Missouri (CITY) for the replacement of the pump station
and existing downstream forcemain that collectively serve the ABB industrial facility, the airport,
customers from unincorporated Callaway County, and customers from the City of Holts Summit as
provided in a recent amendment to an inter-municipal agreement with the CITY, effective May 2016
(hereinafter referenced as PROJECT). Funding for this project will be through the CITY's waste water
utility fund and an agreement between the CITY and Holts Summit. The planning period for design flow
is 20 years. A Facility Plan and/or Preliminary Engineering Report document in conformance with 10 CSR
20-8.110 Engineering Reports, Plans and Specifications for submittal to the Missouri Department of
Natural Resources (MDNR) is not included in this scope of services and if it is determined that it will be
necessary, this effort will be an additional service.
Scope of Work
The professional services will consist of engineering and design services including survey, geotechnical
investigations, engineering analysis and design, bidding documents, and contract documents,. The
documents will be prepared to allow for construction bidding in accordance with the CITY ordinances.
Services for bidding, construction and post-construction phases, are also included in this scope of
services. The Scope of Work and proposed deliverables are outlined below.

Subject: Vacation of Utility Easements in a Portion of Vacated Edgewood Right of Way
City staff is recommending the committee accept the request to vacate the util ity easement in front of
the parcel addressed as 2727 W. Edgewood Drive. This recommendation is contingent upon receipt of
confirmation that no utilities exist within the area .
The area in question was vacated on March 16, 2009 with the reservation of a utility easement. This
easement may have been retained as a matter of convenience rather than in response an existing
need. Investigations are now underway to ensure that no utilities are located within this area. Twenty
feet of right of way remain behind the ex ist ing curb which could be used as a utility corridor if the need
for such would arise.
The owner is also asking that the description of the area that was vacated be changes to allow the
description to better describe the area . The changes proposed do not affect the vacated area itself, but
rather the description leading to the beg inn ing point.
With the committees acceptance of this request staff will await the clearance letters from the utility
compan ies and upon receipt w ill bring this item to the attention of the Council.

SUBLEASE AGREEMENT
This SUBLEASE AGREEMENT is entered into by and between the STATE OF MISSOURI,
through the Office of Administration (hereafter "Lessor"), the MISSOURI DEPARTMENT OF
NATURAL RESOURCES (hereafter "Lessee") and the City of Jefferson (hereafter "Sublessee").
WITNESSTH: That the parties hereto, for the good and valuable consideration described herein,
covenant and agree as follows:
1. Premises: In consideration of the covenant herein, Lessee hereby subleases to Sublessee
the ground floor of the property commonly known as the Union Hotel, excluding the
mechanical equipment room and storage room attached thereto (hereinafter referred to as
the "Leased Premises"). The Leased Premises are situated within the Jefferson Landing
State Historic Site, which is located on Inlot 84 of the City of Jefferson, Missouri. The
Leased Premises are depicted on Exhibit A, attached hereto and incorporated herein by
reference.
2. Term.
a. First Term. The term of this Sublease Agreement is for is for one year,
commencing August 15th, 2015 and ending August 14th, 2016, unless sooner
terminated by mutual agreement of the parties or for any breech of the provisions
contained herein. Possession of the Leased Premises shall be given upon the
execution of this sublease and surrendered on the last date of the term herein.
b. Renewal. This Sublease Agreement shall be automatically renewed for an
additional one (1) year renewal, under the same terms and conditions as the original
lease, on August 15th of each year unless Lessee or Sublessee terminates it by
giving written notice, no later than July 15th of any given year, of its desire to not
renew.
c. Termination. This Sublease Agreement shall become null and void if passenger
train service is discontinued at Jefferson City.
3. Consideration. The consideration for this sublease shall be one dollar per year, the
receipt of which is hereby acknowledged.
4. Use. Sublessee agrees that the Leased Premises shall be used as a waiting area for Amtrak
passengers and their guests, as an information distribution center, for public restrooms, for
vending machines, and for no other purpose whatsoever. Sublessee will provide any office
furniture, telephones (public and private) and any other equipment required for its staff
and/or volunteers to carry out their duties. Sublessee shall provide all training and
supervision for its staff and/or volunteers working in the Leased Premises, and shall
provide Lessee a staffing plan that includes a description of the duties and responsibilities
of staff and/or volunteers, the name and telephone number of the supervisor/volunteer
coordinator, and a regular work schedule for staff and/or volunteers.
5. Leasehold Improvements. Sublessee shall make no improvements or additions to the
interior or exterior of the Leased Premises unless Sublessee first submits plans and
specifications for such improvements and additions to Lessee and obtains Lessee's written
approval of same.
6. Utilities. Lessee reserves the right to temporarily disconnect utilities during nonnal
business hours to conduct necessary repairs and maintenance to the building and its
systems.
7. Appearance and Maintenance. Sublessee shall be responsible for all maintenance and
upkeep of the restrooms which shall include a minimum of one cleaning per day.
Sublessee shall provide paper products for the restrooms. Sublessee will conduct all
maintenance, repairs, and general upkeep of the Leased Premises to provide a safe and
clean environment. Sublessee will be responsible for any structural repairs or repairs to
the heating, ventilating, and air conditioning (HV AC) system for the leased premises.
8. Hazardous Waste Compliance: Sublessee agrees not to allow, keep, use, store, or place e
Leased Premises, or permit to be kept, used, stored, or placed thereon any hazardous
wastes of any kind having ignitable, corrosive, reactive and/or toxic characteristics, or any
wastes listed by the Missouri Department of Natural Resources or the Environmental
Protection Agency as hazardous at the time of such storage, use or placement upon the
Leased Premises. Any violation of this covenant shall, automatically and without any
further action on the part of Lessee, be deemed a default and breach of this lease by
Sublessee, and shall entitle Lessee to immediate possession of the Leased Premises.
Furthermore, all future costs incurred by Lessee or its successors and assigns for removal
and cleanup of environmental damage(s) to said premises shall be fully reimbursed by
Sublessee.
9. Liability Insurance: Sublessee assumes the risk of, and shall protect, defend and hold
harmless Lessee and Lessor from and against all liability and claims for or on account of
any injury to or death of any and all persons or damage to property arising from or related
to Sublessee's use and possession of the premises. Sublessee shall protect and hold
harmless Lessee and Lessor, its agents and employees from all such claims, demands, suits
or actions, including investigation costs, court costs and attorneys' fees resulting or in any
manner arising from Sublessee's use and possession of said Leased Premises to the full
extent permissible under the law. Sublessee further agrees to immediately investigate any
such claims, demands or suits and shall defend, settle and/or otherwise dispose of the same
at their sole cost and expense to the extent pennissible by law. In the event Sublessee
settles any such claims, demands, it shall obtain a release that includes Lessee and Lessor.
This provision shall not however be deemed to be a waiver of Sublessee's sovereign
immunity. During the term of this sublease, Sublessee shall maintain in force public
liability insurance in the sum of not less than Three Hundred Thousand Dollars per person
and Two Million Dollars ($2,000,000) per occurrence. Upon request, Sublessee shall
provide Lessee with a certified copy of the policy.
10. Right of Entry. Lessee shall, at all reasonable times, have right of entry, and free access
to, the Leased Premises and every part hereof, for the purpose of maintaining the HV AC
system, inspecting the same to determine its condition, and to determine whether or not
Sublessee is using and occupying the premises for the purpose and in the manner herein
allowed and for any other reason whatsoever
11. Security. Sublessee shall unlock the Leased Premises by 9:00a.m. each morning and shall
lock the Leased Premises each day after the last passenger train has departed. Sublessee
shall take the lead in working with the Capitol Police Department if the doors to the Leased
Premises are found to be unlocked after hours. Sublessee will provide Capitol Police with
the names and telephone numbers of at least two members of Sublessee's staff as contacts
in the event the doors are found to be unlocked after hours.
12. Default: If Sublessee defaults on any of the covenants contained herein that are to be
kept and performed by Sublessee, or if Sublessee violates any of the provisions or
conditions hereof, then all legal and equitable remedies, including injunctive relief,
specific performance and damages shall be available to Lessee. Additionally, Lessee may
declare this Sublease Agreement at an end and enter into and upon and possess said Leased
Premises as of its former estate, together with the improvements thereon. No action or
proceeding under this paragraph by Lessee shall in any manner release or discharge the
covenants, agreements and undertakings of Sublessee or any of the obligations, risks or
duties assumed herein by Sublessee. Failure by Lessee to enforce one or more of the
remedies herein provided upon an event of default shall not be construed to constitute a
waiver of such default. Sublessee agrees to reimburse Lessee for reasonable costs of any
claims, suits, judgments, costs, attorneys' fees, court costs and all other related expenses
incurred by Lessee arising from or growing out of Sublessee's defaulting on any of the
terms of this lease.
13. Waiver. Waiver. No waiver by either Lessee or Sublessee the terms, conditions or
covenants of this Sublease Agreement shall be deemed as a waiver at any time thereafter of
the same or of any other term, condition, or covenant herein contained, nor of the strict and
prompt performance thereof. Lessee may waive any default of Sublessee at any time
without affecting or impairing any subsequent default. any time of any of deemed as a
condition or covenant. Lessee may waive right arising from a Sublease Agreement and all
of the provisions upon the parties hereto, their successors and assigns herein required to be
given to either Lessee or Sublessee shall be served upon or delivered to such party, or their
authorized if mailed by certified mail, postpaid, to the address of such party.
14. Termination: Upon the expiration or tennination of this Sublease Agreement, including
termination by reason of default, Sublessee shall abide by the tenns and conditions set forth
in this Sublease Agreement regarding removal of improvements and shall surrender
possession and vacate the premises immediately upon such expiration or termination.
15. Assignment: Sublessee shall not sublet, assign or otherwise transfer any rights, interest or
responsibilities under this sublease, without the prior written consent of Lessee, and any and
every such attempted subletting, assignment or transfer without such prior written consent
shall be void and of no effect. This Sublease Agreement is personal to the Sublease and shall
not inure to the benefit of any receiver, trustee or other officer or of any assignee. In the event
of any approved assignment or subletting, Sublessee shall at all times remain fully responsible
and liable for the compliance .of all of its other obligations under the terms, provisions and
covenants of this Sublease Agreement.
16. Miscellaneous.
a. Notice. Any notice herein required to be given to either Lessee or Sublessee shall be
deemed properly given if served upon or delivered to such party, or their authorized
agent, or if posted on or if mailed by certified mail, postpaid, to the address of such
party as follows:

b. Complete agreement. No oral promises, oral agreements or oral warranties shall be
deemed a part of this Sublease Agreement, nor shall any alteration, amendment,
supplement, or waiver of any of the provisions of this Sublease Agreement be binding
upon either Lessee or Sublessee unless the same be supplemented, altered, changed or
amended by an instrument in writing, signed by Lessee and Sublessee.
c. Signature required. This Sublease Agreement does not become binding until
executed by Lessee's Director.

Agreement with Missouri Baptist for Land Sale and Infrastructure
Improvements.
City staff is recommending the committee endorse the agreement for the sale of property and the street
scape project that is being proposed w ith the Missouri Baptist Convention Execu tive Board.
The Missouri Baptist Convent ion is investing in the rehabilitation of the building they own at 400 East
High Street and has approached City Staff concerning their desire to purchase a portion of the City
owned parking lot adjacent to the rear of the ir building. The goal of this purchase is to provide for
adequate parking for the tenants they intend to attract, to allow fo r an improved sense of place, and for
security reasons . To further enhance the s ite they are loo king to partner with the City to rebu ild the
sidewalks and make other streetscape improvements along the ir frontage of Adams Street and High
Street. They also look to reconfigure the existing parking lot to provide fo r more efficient use of the
space and to achieve t heir security and wayfinding goals .
Th e parcel that is the subject of this agreement is currently an aspha lt park ing lot that is controlled by
the parking division. The spaces are available for lease but apart from a small number of the spaces
being used for trailer mounted advertising the lot is underutilized. The parking div ision is aware of the
ofte n discussed need of a second parking structure; however, this lot does not contribute to the
achievement of that vision because of its shape and location.
The Agreement and a preliminary drawing of the parcel in question and the infrastructure improvements
have been attached.

Subject: Road Relinquishment Agreement, Jefferson Street
City staff is recommending the committee accept the agreement offered by MoDOT to relinquish their
ownership of a portion of Jefferson Street near its intersection with Stadium Boulevard.
In the mid 1960's MoDOT undertook the construction of Highway 54 through Jeffe rson City and as a
part of that project realigned a portion Jefferson Street lying north of Stadium Boulevard and created
Jefferson Street to the south of Stadium. Since that time Jefferson Street has been used as a city street
but has remained in the ownership of MoDOT.
Currently the City is engaged in a project which will lead to the construction of a roundabout at the
in tersection of Stadium Boulevard and Jefferson Street. City staff have been in discussion with MoDOT
concerning the ownership of this roundabout which, if nothing were to change, would be constructed
partially on the City owned Stadium Bouleva rd right of way, while the remainde r would be split between
MoDOT right of way and properties that the City will acquire for the project. The solution to this problem
is what you have before you, namely, that the City would take ownership of the MoDOT owned
Jefferson Street right of way from the Highway 54 off ramp northward to Swifts Highway. With this the
City would have full control of the roundabout which simplifies the process of construction and is a
reasonable long term solution.
The agreement and a sketch of the r ight of way in question are attached.

MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION
ROAD RELINQUISHMENT AGREEMENT
THIS AGREEMENT is entered into by the Missouri Highways and Transportation
Commission {"Commission") and the City of Jefferson {"Agency").
WITNESSETH:
NOW, THEREFORE, in consideration of the mutual covenants, promises and
representations in this Agreement, the parties agree as follows:
{1) PURPOSE: The purpose of this Agreement is to relinquish a portion of
the state highway system to the agency.
(2) WORK BY COMMISSION: Prior to any relinquishment or conveyance of
the herein state highway to the Agency, the Commission shall perform the following:

{3) LOCATION: The general location of the highway to be conveyed is as
follows:
Jefferson Street from approximate Station 6+18.59 to Station 17+98.30 and
Station 0+55.94 to Station 4+11.23 as shown on attached Exhibit A
{4) RELINQUISHMENT: Upon completion of the work as specified in
paragraph (2), the Commission shall convey to the Agency the portion of the State
Highway which is the subject of this Agreement by a quitclaim deed releasing any and
all interest the Commission has in the above-described property. The exact legal
description of the highway shalll:!ppear in the quitclaim deed. The Commission makes
no representation to the state of title of the above-described property and it is incumbent
upon the Agency to seek its own professional opinion as to the resulting state of title.
The Agency agrees to accept the deed from the Commission. The deed shall be filed
with the office of the recorder of deeds in the county where the highway is located.
{5) UTILITY CLAUSES IN THE DEED: The following clauses will· be included
in the quitclaim deed from the Commission to the Agency:
The Agency, by acceptance of this conveyance, covenants and agrees for
itself, its successors and assigns, to allow known or unknown utility

facilities currently located on the property, whether of record or not, to
remain on the property, and to grant the current and subsequent owners
of those facilities the right to maintain, construct and reconstruct the
facilities and their appurtenances over, under, and across the land herein
conveyed, along with the right of ingress and egress across the land
herein conveyed to and from those utilities.
(6} MAINTENANCE BY COMMISSION: Prior to conveyance of the highway,
the Commission shall maintain the highway as part of the state highway system. Upon
conveyance of the highway to the Agency, Commission's responsibility to maintain the
highway shall cease and the highway will no longer be considered a part of the state
highway system.
(7} MAINTENANCE BY AGENCY: Upon conveyance by the Commission as
shown by the date on the quitclaim deed, Agency shall maintain the highway as part of
Agency's system.
(8} FUTURE REPAIR: After conveyance of the highway to the Agency, the
Commission may agree to perform future repair to the highway. Any future repair by the
Commission shall only be by a separate written agreement between the Commission
and the Agency. The cost of any future repairs by the Commission shall be identified by
the separate agreement and shall be the responsibility of the Agency.
(9) COMMISSION REPRESENTATIVE: The Commission's district engineer
is designated as the Commission's representative for the purpose of administering the
provisions of this Agreement. The Commission's representative may designate by
written notice other persons having the authority to act on behalf of the Commission in
furtherance of the performance of this Agreement.
(10) LAW OF MISSOURI TO GOVERN: This Agreement shall be construed
according to the laws of the State of Missouri. The Agency shall comply with all state
and federal laws and regulations relating to the performance of this Agreement.

BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1.

Chapter 34 (Transportation) Article V (Vehicles for Hire) is amended as
ARTICLE V. VEHICLES FOR HIRE
DIVISION I. GENERALLY
For the purposes of this article, the following words and phrases shall have the meanings respectively
ascribed to them by this section:
Car Service. A business offered to the public to transport passengers and/or passengers and their
property for a fixed charge, fee, or a rate based primarily upon the amount of time the vehicle is retained.
Chauffeur Agency. A business which supplies a driver to operate a motor vehicle which is owned or
rented by the customer and not owned or rented by the business.
Courtesy car. Any vehicle used by an establishment to transport patrons of an establishment from said
establishment to another location and/or back to the same establishment and nowhere else, or any vehicle used by an
establishment arranging sightseeing or other similar tours for the purpose of transporting patrons of such
establishment without charge.
Director of Finance or Director. The Director of the Division of Finance of the City of Jefferson, or his
designee.
Limousine. A motor vehicle of more than five-passenger capacity, excluding the driver, that is licensed by
the Missouri Department of Transportation, especially a luxurious automobile, normally driven by a chauffeur but
shall not include motor buses.
Limousine service. A business offered to the public to transport passengers and/or passengers and their
property by limousine.
Motor Bus. A motor vehicle having a seating capacity for ten (I 0) or more persons, but shall not include
motor buses owned or leased by the city, state, school district or federal government.
Motor Bus Service. A business offered to the public to transport passengers and/or passengers and their
property by motor bus.

Taxicab. A vehicle for hire used by a taxicab business.
Taxicab business. A business offered to the public to transport passengers and/or passengers and their
property for a charge or fee based primarily upon the distance or mileage utilized while transporting the
passenger.
Taxicab driver. The operator of a taxicab.
Transportation network company means a company operating in the City of Jefferson that uses a
digital network or software application to connect a passenger to transportation network services provided
by a transportation network operator.
Transportation network operator means an individual who operates a motor vehicle that is owned or
leased by the individuaL and not licensed as a public vehicle for hire taxicab or limousine under this Chapter,
and used to provide transportation network services • .
Transportation network services means transportation of a passenger between points chosen by the
passenger and that is prearranged by a transportation network company for compensation.
Vehicle for hire. A motor vehicle with a capacity of not more than five passengers, or a motor vehicle
with more than a capacity of five passengers which is not othetwise licensed as limousine with the Missouri
Department ofTransportation, exclusive of the driver, used in the transportation of persons or property for hire between
points within this city, or between points within this city and points outside of this city, but not including limousines,
courtesy cars or motor buses. Vehicles for hire include a car service, taxicab business, transportation network
service, and all other services meeting the criteria set forth in this definition.
Vehicle for hire business. 'llte service or business of transporting persons and/or persons and their property
for consideration, including a taxicab business, car service, transportation network company ridesharing sep,·ise,
and other similar services but excluding limousines, courtesy cars, and motor buses.

Sec. 34-61. Permit required.
A. Business. It shall be unlawful for any person. corporation or partnership to operate a vehicle for hire business,
limousine service, motor bus service or chauffeur agency without first obtaining a permit.
B. Operator. It shall be unlawful for any person to operate a vehicle for hire, limousine, or motor bus,
without first obtaining a permit.

Sec. 34-62. Permit fee.
A. There shall be an annual penn it fee for operation of a vehicle for hire business, limousine service, motor bus
service, and Chauffeur agency.
B. The annual permit fee for the first vehicle and for each additional vehicle shall be as set forth in Appendix
Y.
C. The annual fee shall be waived during the first pennit period.

See. 34-63. Permit period.
A. The first permit issued for operation of a vehicle for hire business, limousine service, motor bus service, and
chauffeur agency shall be issued from the date of issue until December 31, of the year in which the permit is
issued.
B. All such permits issued thereafter shall be issued for one year beginning January 1st and ending December
31st.

Sec. 34-64. Transfer prohibited.
A permit issued pursuant to this Article shall not be transferred or assigned.
Sec. 34-65. Display.
It shall be unlawful for any vehicle for hire or limousine other than one operated pursuant to a valid permit
to display any markings suggesting or indicating it is a vehicle for hire. Whenever a vehicle operated as a vehicle for
hire is removed from service, the permit holder shall remove all markings suggesting it is a vehicle for hire. (Ord.

Sec. 34-66. Revocation.
A. Upon notice and hearing, the Director of Finance may suspend or revoke a certificate or permit issued
pursuant to this Article era eeR¥eRieRee BREI Reeessit;y, for any of the following reasons:
1. Failure to conduct the permitted business for a period of thirty (30} days or longer.
2. Violation of this Code or any ordinances of the city or statutes of the state.
3. Employment of unlicensed drivers or drivers without a state or city issued permit.
4. Operation of vehicles without insurance on file as is prescribed by this article.
5. For Vehicles for Hire, failure to charge the rates prescribed by this chapter.
6. Aiding, abetting or assisting the promotion or advancement of any illegal activity, affair or
business.
7. For Vehicles for Hire, failure to maintain the hours of operation set forth in the permit.

B. The Director shall issue written findings of fact setting forth the reasons for the action taken.

Sec. 34-67. Insurance requirements.
A. Every holder of a permit issued pursuant to this article shall at all times during the course of such
operations have on file and approved by the Director of Finance a certificate of public liability and property
damage insurance covering each motor vehicle being operated in such vehicle for hire business by the
holder ef the eeFtifieate ef eeRnRieRee &Rd Reeessily, in the minimum amounts of a combined single limit
of Three hundred Thousand and no/100 Dollars property damage for any one accident.
B. The following endorsement shall be attached to each certificate of insurance required by this section:
"The policy to which this endorsement is attached shall not expire, nor shall the cancellation,
revocation or suspension thereof take effect, until after ten (I 0) days' notice in writing by the
company or insurer shall have first been given to the Director of Finance of the City of
Jefferson, Missouri, in care of the City Hall Building, Jefferson City, Missouri, said period of
ten (I 0) days' notice to commence to run from the date that notice is actually received at the
office of the Director.

Sec. 34-68. Record keeping.
Every holder of a permit issued pursuant to this article shall keep records of each dispatch, its origin, and its
destination for each vehicle for hire. Records shall be kept for one year.

Sec. 34-69. Zero Tolerance Policy.
Everv vehicle for hire business. limousine service, motor bus service or chauffeur agency shall
establish a zero tolerance oolicy for alcohol or drug use by its drivers or operators while the drivers or
operators are performing services for the business.
DIVISION 2. VEHICLES FOR HIRE
Sec. 34-70. Application generally.
A. Any person desiring to secure a permit to engage in, operate or conduct a vehicle for hire business within
the city shall tile with the Director of Finance a written application therefor, in duplicate, verified under
oath, giving the following information:
I. The full name, residential and business addresses of the applicant for the past five (5)
years; if a partnership, the name and residential and business addresses of all the partners for the
past five (5) years; if a corporation, the name and residential address of all of the officers and
directors for the past five (5) years.
2. Whether or not the applicant, or any persons listed in subsection (I) above, has been
convicted of the violation of any federal or state felony law, or any federal or state misdemeanor
involving the use or threat of force or violence or the sale of drugs or sexual abuse; or, within the
previous two (2) years, has been convicted of violating any provision of this Code or has ever had
a business license or other license or permit issued by the city revoked or suspended. Applicant
shall supply a criminal record check by the Missouri State Highway Patrol or similar agency to
verify the information provided in this section.
3. Whether or not the applicant or any person listed in subsection (1) above has unpaid
claims or unsatisfied judgments against him for damages resulting from the negligent operation of
a vehicle.
4. The past experience, if any, that the applicant has had in rendering a vehicle for hire
service, including the dates such service was rendered and the city wherein the service was
rendered.
5. Whether or not any license or permit to operate a vehicle for hire issued to applicant has
ever been revoked or suspended, and if so, the circumstances of the revocation or suspension.

applicant's vehicle for hire including the manner in which such vehicles will be dispatched.

9. The hours during which the business will be operated.
I 0. Such further information as the Director may reasonably require.
B. Upon the first application for a permit only, an application fee in the amount of Two Hundred and no/100
Dollars ($200.00) plus an additional five dollars ($5.00) for each vehicle in excess of one. The portion of
any application fee not expended by the City shall be refunded to the applicant.
C. Denial of the application pursuant to this section shall be considered an appealable decision pursuant
to this Chapter.

Sec. 34~ 71. Vehicle for Hire Business Operator, Investigation; granting of application.
A. No pennit to operate a Vehicle for Hire business shall be issued unless the applicant has first ehtained a

C. Every vehicle for hire business shall establish policies and procedures for reporting a complaint
about any vehicle for hire driver or the driver's vehicle. Any such policies and procedures shall
require that the vehicle for hire business conduct an investigation upon the receipt of an allegation
that a driver has violated the zero tolerance policy required by Section 34-69 and when the complaint
involves the allegation that the driver exhibited inappropriate or offensive language or conduct
during the service.

A. Vehicle for hire businesses may charge a fare for the services provided to passengers, provided that,
if a fare is to be collected from a passenger. the vehicle for hire business must notify the passengers of

hire business shall also provide passengers with the applicable rates being charged and the option to

Sec. 34-76. Appeals.
Any person aggrieved by the decision of the Director In regard to the denial, suspension or
revocation of a license or permit as provided for in this chapter shall have the right to appeal to the city
administrator. Such appeal shall be taken by filing with the city administrator. within ten CIO) days after
notice of the decision by the finance department has been mailed to such person's last known address. a
written statement setting forth the grounds for the appeal. The city administrator shall review the written
statement of the party, the letter of denial. suspension or revocation. and any other relevant information and
determine whether the decision of the Director to deny. suspend or revoke the license or permit was
appropriate. The order of the city administrator on such appeal shall be final.

DIVISION 3. VEHICLES AND DRIVERS
Sec. 34-90. Meters.
Each vehicle used in the operation of a vehicle for hire business which shall have any portion of a rate
conditioned on mileage shall be equipped with a fare meter or other similar device or apolication, designed and
constructed to clearly and accurately register the exact mileage traveled by the taxicab on each transportation
movement and equipped to clearly and accurately register the exact fare to be paid for use of such taxicab by one
passenger at all times while such cab is in motion and upon arrival at the point of destination. The fare meter shall
be turned on at the time such taxicab departs from the point of origin with a passenger and shall be kept on until the
point of destination is reached. at which time the taxicab driver shall stop the meter.

Sec. 34-91. Vehicle permits, inspection.
A. Every vehicle used in a vehicle for hire business must have a permit issued by the Director prior to its use
as a vehicle for hire.
B. Vehicle permits shall only be granted after an inspection as set out in this section. In addition to all other
vehicle inspections required by law, each vehicle governed by this article shall be subject to an annual
inspection. All inspections shall be conducted by a mechanic authorized by the State of Missouri to perform
motor vehicle inspections (or such other person approved by the Director) and shall consist of the
following:
I. Exterior. Headlights, taillights, brake lights, directional signal lights, license plate lights,
windshield, vent glasses, windshield wipers, all other vehicle glass, glass window raisers, doors
and door locks, trunk lid, trunk hood, and interior door handles, exhaust system, splash shields,
hubcaps, bumpers, fenders, body and tires shall be inspected to ascertain that each is functioning
properly. There shall be no tears or rust holes in the vehicle body and no loose pieces such as
fenders, bumpers or trim hanging from the vehicle body. There shall be no unrepaired body
damage which would create a safety problem or interfere with the operation of the vehicle.
2. Interior. The rear view mirror, steering wheel, foot brakes, parking brakes, seat belts and air
conditioning and heating systems shall be inspected to ascertain that each is functioning properly.
The upholstery, floor mats, head lining, door panels and the trunk compartment shall be inspected
to determine whether they are clean, free of tears, and that the trunk bas sufficient space for
passengers' luggage.
3. If the vehicle is equipped with a meter, the meter shall have a current Department of Agriculture
seal and sticker indicating that it has been properly calibrated.
4. The report of inspection shall be on a form promulgated by the Director.
S. The vehicle shall not be utilized in a Vehicle for Hire business until it successfully passes
inspection; provided, that the Director, in his or her discretion, for a period not to exceed fifteen
(15) days, may allow the continued use of a vehicle which substantially complies with the
inspection requirements.
6. Nothing herein shall prohibit the random inspection of a vehicle used in a Vehicle for Hire
business by the Director or police department where possible violations of this article or other
violations of law regarding the condition of vehicle for hire are evidenced by visual inspection.

Sec. 34-92. Identification.
A: Each vehicle for hire shall be identifiable as a vehicle for hire by appropriate signs on the door on each side
of such vehicle or the vehicle shall be identified to the passenger prior to arrival.

Sec. 34-93. Vehicle, condition and appearance; identification.
A. Vehicle to be kept in safe and operable condition. All vehicles used in a vehicle for hire business shall be
kept in a thoroughly and mechanically safe operating condition complying with all of the safety
requirements ofthis Code and other ordinances of the city and state law.
B. Vehicle and driver appearance. Every permit holder shall maintain his vehicles in a clean serviceable
condition and in adequate repair. All permitted vehicles, except minivans, shall have two (2) doors
affording direct entrance and exit to and from the passenger compartment. The interior of each vehicle shall
be cleaned and vacuumed at the hegirmiRg ef eaeh drh•er's shift and shall be maintained in a clean
condition, free of foreign matter and offensive odors. There shall be no litter in the vehicle or trunk and the
seats shall be kept clean and without holes or large wear spots. The exterior of each vehicle shall be washed
at least once each week.

used in a Vehicle for Hire business shall bear on the outside on each side the name of the company; and the

identifying lhat partieular vehiele. Each vehicle for hire operated by the same permit holder must have
identical information displayed to the public. The Director of Finance may give a temporary waiver of this
requirement upon good cause shown not to exceed 180 days.
D. Driver dress and uniforms. While on duty, all drivers governed by this article must be neat and clean in

Sec. 34-94. Driver's permit required.
No person shall drive a vehicle used in a Vehicle for Hire business within the city limits, unless such
person has in his possession a currently effective and valid vehicle for hire driver's permit which has been issued as
provided in this division.
Sec. 34-95. Age of vehicle.
No person shall utilize a vehicle which is more than I 0 years old as a vehicle for hire. The Director may
waive that requirement upon application for good cause shown if the vehicle is a classic or historic vehicle.
Sec. 34-96. Vehicle for hire business permit holder's responsibility.
No person, other than the holder of a vehicle for hire driver's pennit, shall be allowed by any person
engaged in the operation of a vehicle for hire within the city to operate or drive a vehicle for hire within the limits of
the city.
Sec. 34-97. Application and issuance procedure.
A. Any person desiring to obtain a permit to operate a vehicle for hire within the city shall file an application
with the Director of Finance on a form to be provided, by the Director of Finance, to obtain a permit to
drive a vehicle for hire and concurrently pay an application fee set by the City Administrator to the director.
The application form shall require the applicant to furnish the full name, Social Security Number, Driver's
License Number, residence, places of residence for the preceding five-year period, sex, age, color, height,
color of eyes and hair, place of birth, marital status, length of residence in the city, citizenship and
nationality, places of previous employment, and whether such applicant has been previously licensed as a
chauffeur and, if so, whether such license has ever been revoked and, if so for what reason. Such applicant
shall both sign and swear to the truth of the contents of the application. Applicant shall submit a criminal
history report from the Missouri State Highway Patrol and certified copy of his driving record from the
Missouri Department of Revenue.
B. No application shall be accepted unless it is accompanied by a certificate or other public record showing
that the applicant has been tested and passed drug and alcohol screening at least equal to the screening
requirements set by the United States Department of Transportation for motor carrier drivers with respect to
the number and types of drugs or controlled substances tested, which certificate must have been issued no
more than five days prior to the date of application.
C. The director may require the applicant to demonstrate his skill and ability to operate safely a motor vehicle
and to pass a physical examination showing that such applicant has average eyesight and hearing. Upon
completion of the investigation, physical examination and driving test, ifthe Director of Finance concludes
that the applicant is suitable and qualified to drive a vehicle for hire, the director shall issue the applicant a
lHi driver's permit.
D. Denial of a driver's permit pursuant to this section shall be considered an appealable decision
pursuant to this chapter.
Sec. 34-98. Qualifications.
A. Every applicant for a driver's certificate shall:
l. Be at least eighteen ( 18) years of age at the time of application.
2. Be able to read the English language sufficient to read street signs and operate a vehicle.
3. Be clean and neat in dress and person, and not addicted to the use of intoxicating liquor or drugs.
4. Have a general reputation for integrity, responsibility, good moral character as a law abiding
citizen.
5. Possess a valid Missouri Commercial Driver's License.
6. Have at least one year's experience as a driver of motor vehicles, and at least sixty (60) days'
experience operating motor vehicles over the streets of the city.
7. Not have been convicted of, plead guilty to, or plead no contest to, regardless of whether sentence
was imposed:
a. Any felony, within the last five (5) years, a material element of which involves fraud,
dishonesty, the use of or threat of violence, the possession, or sale, of illegal drugs or
stealing. (Ord. 14314, §1, 1-22-2008)
b. Any misdemeanor, infraction, or ordinance violation, within the last two (2) years, a
material element of which involves fraud, dishonesty, the use of or threat of violence, the
possession, sale, or selling of illegal drugs, or stealing.
c. Any offense involving the operation of a motor vehicle while under the influence of
alcohol or drugs within the last twelve (12) months, or more than one such offense during
the last five (5) years.
d. More than two convictions within the last two years for any moving offense.
e. Any offense which would, if convicted in Missouri, cause the applicant to be required to
register as a sexual offender.
B. The Finance Department shall notify the applicant fails to provide any of the above information
Sec. 34-99. Renewal.
A. Every applicant for a driver's certificate shall:
A. On or before the first day of July of each year each holder of a vehicle for hire driver's permit shall apply to
the Director of Finance for an annual renewal of such permit and pay a renewal fee prescribed by the City
Administrator. The Director of Finance shall then issue a vehicle for hire driver's permit authorizing the
holder thereof to operate a vehicle for hire within the city until June 30 of the subsequent year if the
applicant, at the time he seeks renewal of the permit is sought, holds a currently effective vehicle for hire
driver's permit previously approved, which permit has not been revoked or suspended.
B. No application for renewal shall be accepted unless it is accompanied by:
I. A certificate or other public record showing that the applicant has been tested and passed drug and
alcohol screening at least equal to the screening requirements set by the United States Department
of Transportation for motor carrier drivers with respect to the number and types of drugs or
controlled substances tested, which certificate must have been issued no more than five days prior
to the date of application.
2. A criminal history report from the Missouri State Highway Patrol and certified copy of his driving
record from the Missouri Department of Revenue.
Sec. 34-100. Display.
The holder of a vehicle for hire driver's permit shall have such permit prominently displayed in the vehicle
for hire operated by him at all times such vehicle for hire is in operation.
Sec. 34-101. Revocation or suspension.
A. The Director of Finance may revoke the permit of any vehicle for hire driver if the holder thereof is
convicted of a violation of provisions ofthis Code or any city ordinance regulating the operation of motor
vehicles while in motion, drunkenness or any matter involving moral turpitude, or if. after a public hearing
as provided in subsection (b), any vehicle for hire driver is found to be mentally, physically or morally unfit
or unsafe to operate a vehicle for hire within the city.
B. Upon conviction of the holder of a vehicle for hire driver's permit for any reason stated in subsection (a), or
if a complaint shall be filed with the Director of Finance against the holder of a vehicle for hire driver's
permit alleging that the holder of the permit is mentally, physically or morally unsafe or unfit to operate
vehicle for hire within the city, the Director of Finance shall set a day for the hearing on the revocation of
the permit of such vehicle for hire driver and cause the holder of the permit to be served a written notice
stating the time and the place of such bearing and the offense charged against the holder of such permit,
and ordering the holder of the permit to appear at such hearing to show cause why the permit to operate a
vehicle for hire within the city should not be revoked. If, at the hearing, if should be proven that the holder
of such vehicle for hire driver's pennit has been convicted of any offense mentioned in subsection A, or if it
shall be proven by competent evidence that the holder of the pennit is mentally, physically or morally unfit
or unsafe to operate a vehicle for hire within the city, taking into consideration generally the health, safety
and welfare of the residents of the city, the Director of Finance may either revoke and cancel the pennit or
suspend the pennit for a period of time not to exceed ninety (90) days. Failure of the holder of the pennit
to appear at the hearing shall be deemed an admission of the validity and truthfulness of any charge
contained in the notice of hearing. The Director of Finance may suspend a penn it, pending a hearing on
revocation, if the holder is charged with violation of any provision of this Code or any ordinance specified
in subsection A.
C. In the event that a license or pennit is suspended, the Director may set such conditions as he or she deems
appropriate for reinstatement.
D. Revocation or suspension of a vehicle permit pursuant to this section shall be considered an
appealable decision pursuant to this chapter.
Sec. 34-102. Accident notification.
In the event any vehicle for hire driver, while operating a vehicle for hire, is involved in a traffic accident
involving injury to any person, regardless of fault, said driver shall within 72 hours of such accident (excluding the
period between 5:00p.m. on Friday and 8:00 a.m. on Monday) a certificate or other public record showing that the
applicant has been tested and passed drug and alcohol screening at least equal to the screening requirements set by
the United States Department of Transportation for motor carrier drivers with respect to the number and types of
drugs or controlled substances tested, which certificate must have been issued no more than 24 hours after the time
of the accident. Failure to submit such documentation within the time period required shall automatically cause the
driver's permit to be suspended.
