M. Members present: Mayor, Wayne Neddermeyer, Council members, Arthur Theis, Thomas Crosby William Reiser, Nancy Laurent, Assistant Clerk Sylvia Rudolph, Planning and Zoning Administrator Jeanne Mabusth, Attorney Richard Schieffer. Nancy Laurent asked that minutes of meeting of April 19, 1977 Item 23 to read committee meeting. Item No. 1 Dick Schieffer building has been removed as of April 7, 1977. Motion by Arthur Theis , seconded by Nancy Laurent to approve as corrected. Motion carried unanimously. be corrected as follows: added that the hazardous the minutes of April 19th 1. VOCATIONAL TECHNICAL SCHOOL The council asked that the letter received from John Lobben dated May 2, relating to the councils March 29, 1977 meeting to be part of the minutes. Tom Crosby presented a resolution which would not permit a Vo-Tech school in an R-A district and reasons for not rezoning. Motion by Tom Crosby and seconded by Nancy Laurent to table the resolution until the council has had a chance to consider the resolution. Motion by Tom Crosby and seconded by Bill Reiser to designate Wayne Representative of a joint study designed to address the needs of Sewer service options in the Medina Morningside and potential West campus of Vo-Tech in accordance with Dr. Richard Emerys letter of May 2, 1977. Motion carried unanimously. ": 2. ROAD MAINTENANCE MATERIAL AND SYCAMORE TRAIL BLACKTOP BIDS The following bids were received and opened at 10:00 A. M. BIDDER Bryan Rock Co. J. L. Shiely Co. Dick it would be difficult to justify not awarding to the low bidder. Motion by Arthur Theis and seconded by Nancy Laurent to award the 3/4" Limestone Pick -Up bid to Jim Sazama at 81.45 per ton. Motion carried unanimously. Motion by Tom Crosby and seconded by Arthur Theis to award the delivered bid to Bryan Rock at 13.54 per ton. Motion carried unanimously. BEECHNUT STREET VACATION Nancy Laurent stated we should give each owner 15 ft. and keep 10 ft. down the middle for public access. Mr. Toomey stated that if Beechnut was vacated he would not have access to the lake. Anne Theis stated that we need public access to the water and that everyone has that right. Charlie Pangier wants to use the access to launch a boat, he now uses Dockside. Mr. Nelson stated that it will never be a boat launch. Paddy Theis doesn't see that we should give up something we already have. Mr. Nelson said it should be on the tax roll and then he and Mr. Orth would keep it up. Motion by Tom Crosby to close the public hearing and table action until next council meeting. Seconded by Arthur Theis. Motion carried unanimously. 4. DON MAYER Jeanne Mabusth presented the Don Mayer Site Plan. Dick Schieffer stated that the council should be concerned about spot zoning and any rezoning should comply with the Comprehensive Plan. Tom Crosby drafted Resolution 77-18 giving reasons for denying the request for not approving rezoning. Motion by Nancy Laurent and seconded by Tom Crosby to turn down application to rezone from C-2 to M-1. Motion carried unanimously. 5. DON GASPAR The council reviewed the 4 conditions of the preliminary plat of April 26, 1977 Planning Commission meeting. Jeanne Mabusth will bring forth recommendations for a new fee schedule for setting plat and park fees. Motion by Art Theis and seconded by Bill Reiser to set the plat fee at 175.00 and the park fee at t125.00 Motion carried - Wayne Neddermeyer abstained. 6. DEAN BAILEY - LON DANIELSON STREET VACATION Mr. Bailey requested vacation of a street (no name). He also stated that he would like to have the Sewer assessment changed from multiple dwelling to single, and also the Sewer assessment be dropped on the 30 Ft. lot that he intends to buy from Sheldon Hoff. Dick Schieffer to check on these 2 items. Motion by Tom Crosby and seconded by Bill Reiser to schedule a Public Hearing for 8 P. M. on May 31st, 1977 to vacate street between Lot 1 Block 8 and Lot 8 Block 1 Independence Beach. Motion carried unanimously. 7. JEANNE MABUSTH The Planning Commission recommends Jeanne Mabusth to attend a Land -Use School in Anoka on June 21-22-23 at a cost of 1120.00 Motion by Wayne Neddermeyer and seconded by Tom Crosby to approve Planning Commission recommendations. Motion carried unanimously. 8. HOLY NAME DRIVE Nancy Laurent stated that it has been brought to her attention that the people along Holy Name Drive do not want ditches. If such being the case she doesn't want the city engineer spending any more time in this area, and patch instead of redoing it. Kathy Hansmann will contact people on Holy Name Drive to see if they will accept ditches. Lyle Swanson will make up a letter as to why ditches are needed and the clerk will send to people living on Holy Name Drive. 9. HENNEPIN CO. ROAD AID Tabled until the May 17, 1977 Council Meeting. 10. DUST CONTROL George Cleveland stated that the PCA has no objection to use a mixture of 80% drain oil and 20% asphalt, and that no permit is required. Mr. Cleveland will have the PCA write a letter to Nancy Laurent to establish a policy as to how to apply to the city roads. 129 11. ROBERT SCOTT Motion by Nancy Laurent and seconded by Arthur Theis to grant Mr. Scott permission to transfer Special -Use Kennel Permit from 2835 Hamel Road to a new location across the street to 2832 Hamel Road subject to the 5 items as listed in the April 26, 1977 Planning Commission Meeting. Motion carried - Tom Crosby abstained. 12. HIGH CREST - MEDINA MANOR Lyle Swanson recommended regrading the edge of the street and oil coat over gravel. Motion by Nancy Laurent and seconded by Arthur Theis to have the city engineer take care of problem. Motion carried unanimously. 13. PUBLIC WORKS DEPARTMENT Discussion on Resolution 77-19 establishing a Department of Public Works and outlining the functions thereof. Motion by Nancy Laurent to approve Resolution 77-19 and seconded by Tom Crosby with the following addition. BE IT FURTHER RESOLVED that the councils responsibility for the Department of Public Works shall be divided between and among a commissioner of Roads and a Commissioner of Sewer and Water who shall each be responsible for matters within the Department of Public Works reasonably related to Roads and Sewer and Water, as appropriate. Original as ammended. Motion carried - Wayne Neddermeyer abstained. Motion by Nancy Laurent'and seconded by Tom Crosby that Ronald Duran be the Director of Public Works at the same salary and other benefits. Motion carried unanimously. 14. METRO SYSTEMS STATEMENT Mr. Crosby breifly described the Metropolitan Systems Statement. Motion by Tom Crosby and seconded by Arthur Theis to refer this to the Planning Commission and Zoning Administrator for factual accuracy. Motion carried unanimously. 15. HAMEL WELL REPORT Lyle Swanson discussed the problems with the Hamel Well and that the pumping level has dropped. Lyle recommended a program to commence to drill test wells, case and screen them and put a larger one in the future when needed. Motion by Wayne Neddermeyer and seconded by Bill Reiser to authorize Lyle Swanson and Bill Reiser to talk to property ownders along Co. Rd. 116 North of Hwy. #55 about purchasing property for the test wells. Motion carried unanimously. 16. PARK MAINTENANCE - BOAT RAMP - LAWN MOWER Arthur Theis stated the need to purchase a lawn mower to be used for trimming. Motion by Tom Crosby and seconded by Bill Reiser to authorize Arthur Theis to get quotes and purchase a lawn mower, also to look into the boat ramp and picnic tables at Lake Independence and also barrels to be used for garbage. Motion carried unanimously. 17. NORTHWESTERN BELL TELEPHONE CABLE REQUEST Motion by Nancy Laurent and seconded by Tom Crosby to adopt resolution 77-20 to bury a cable at Pioneer Trail and Apache Drive. Motion carried unanimously. 130 18. BILLS Motion by Nancy Laurent and seconded by Arthur Theis to pay the bills, Order checks #6676-6731 in the amount of $16,185.29 and Payroll checks #4476-4503 in the amount of $5,911.76. Motion carried unanimously. Motion by Nancy Laurent and seconded by Bill Reiser to adjourn. Motion carried unanimously. Meeting adjourned at 12:45 A. M. Mayor May 3, 1977 The Council of the City of Medina met as a Board of Review on Tuesday, May 10, 1977 at 7:30 P.M. Members present; Wayne Neddermeyer, Mayor; Councilmembers, Nancy Laurent, William 'Reiser. Arthur Theis. Thomas Crosby; Clerk, Donna Roehl; Assessor Willis Kohnen and Mr. Martin of the Hennepin County Assessors Office. No Medina property owners appeared to discuss their tax situation or requested any information regrrding assessments. Members remained in chambers for one hour; until 8:30 P.M.
