HomeMy Public PortalAbout024-1983 - Amending Chapter 154 - Zoning - 2001 US 27 Southr r GENERAL ORDINANCE NO. 24-1983 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COM- MONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE RE- ZONING OF PROPERTY LOCATED AT 2001 U.S. 27 SOUTH FROM C-2 CQ4 ERCIAL DISTRICT TO C-2 SU CC!KIERICAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A NURS- ING [ ICE. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 designates and describes as C-2 Commercial District the property located at 2001 U.S. 27 South; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from C-2 Commercial District to C-2 SU Commercial Special Use District and to authorize the Special Use of said property as a nursing home; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 24th day of May, 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was eleven (11) to zero (0) in favor of recommending the passage of Ordinance No. 24-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-2 SU Commercial Special Use District, and that said pro- perty be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. Being apart of the Northeast Quarter of Section 17, Township 13 North, Range 1 West in Wayne Township, Wayne County, Indiana, and being more particularly des- cribed as follows: Beginning at a point in the east line of the Northeast Quarter of said Section 17, said point being 640.95 feet south of the northeast corner or said Northeast Quarter, (assuming said east line runs north and south), and running thence, from said beginning point, continuing south, along said east line, 293.00 feet to a point; thence south 89 degrees, 32 minutes and 30 seconds west, 423.91 feet to the point in the curve of the eastern right-of-way line of United States Highway Number 27; thence along the eastern right-of-way and along said curve to the left, whose chord bears north 18 degrees, 40 minutes and 45 seconds east, a distance of 310.13 feet to a point in line with the extension of the south line of an existing building; thence north 89 degrees, 32 minutes and 30 seconds east, along the ex- tension of said south line, along the south line of said existing building and along the extension of said south line, 324.58 feet to the place of beginning, containing an area of 2.507 acres. SECTION 2. That as provided in Articles 21.01 and 48 of Chapter 154 of the Municipal Code, the following described use of the above described real estate is allowed as a Special Use as a nursing home. SECTION 3. As a condition of the aforesaid Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owners of said real estate. a. The site plan accompanying the petition shall be marked Exhibit A and made a part of the Ordinance. b. All off-street parking facilities, including those existing and those proposed, shall be paved and developed in accordance with the standards of Article 41 of the Zoning Ordinance. c. A site drainage plan for the Special Use shall be prepared and submitted to the City Engineer for approval. d. All service areas, including trash dumpster locations, shall be adequately screened to minimize their impact on adjoining property. CITY PLAN COMMISSION RICHMOND, INDIANA June 2, 1983 Mr. Kenneth Mills, President Members of Common Council and Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 24-1983 Plan Commission Case PC-83-6 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, May 24, 1983, on the petition of Al and Paula Knobler, Owners; Robert Burton, Agent; requesting the rezoning of property located at 2001 U.S. 27 South from C-2 Commercial District to C-2 SU Commercial Special Use District, and also requesting authorization for the Special Use of said property as a nursing home to allow the expansion of an existing nursing home facility. Seven (7) notices of public hearing were sent to adjoining property owners with none returned. During the public hearing two (2) area residents expressed their concerns over an unscreened dumpster area and provisions for storm drain- age. The Plan Commission determined that the petition meets the requirements and standards of the Zoning Ordinance and voted eleven (11) to zero (0) to recommend that Ordinance No. 24-1983 be adopted with the four (4) conditions as stipulated in Section three (3) of the Ordinance. After an investigation of the area, which is closely adjacent to U.S. 27 and with the intersection of 227 close by, I feel that if there is proper parking available and an entrance and exit so that there is no parking along Straightline Pike, then the added construction would pose no problem at this time.
