REGULAR COUNCIL MEETING, SEPTEMBER 8, 2015
CALL TO ORDER
The Regular Council Meeting of September 8, 2015, was convened at 6:00 P.M. by
Mayor Carrie Tergin.
ROLL CALL
The following Council Members were present for the roll call:
Present: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather,
Schreiber, Scrivner, and Ward
Absent: None
A quorum was declared present.
ADOPTION OF THE AGENDA
A motion was made by Councilman Scrivner, seconded by Councilman Prather, to
adopt the agenda, as amended by allowing Ms. Kate Hotel of Mediacom to make her
presentation earlier in the meeting under ‘Presentations on Specific Bills or
Resolutions.’ The motion to adopt, as amended, was approved unanimously.
MISCELLANEOUS AGENDA ITEMS
Constitution Week Proclamation – Mayor Tergin presented the proclamation to Ms.
Vivian Kaysen of the Jefferson City Chapter of Daughters of the American Revolution.
Ms. Kaysen thanked the City for recognizing Constitution Week each year.
PUBLIC HEARINGS
There were no public hearings scheduled for this meeting.
APPOINTMENTS BY THE MAYOR

Mayor Tergin recommended the following appointments to City Boards and
Commissions for Council approval:
A motion was made by Councilman Prather for approval of the appointments as
presented, seconded by Councilman Branch, and approved unanimously.
PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS
Parks and Recreation Director provided an update on the University/Community
Wellness & Recreation Center. He stated that both the Parks Commission and Lincoln
University expected to approve a Memorandum of Understanding this week.
ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF
Mayor Tergin made the following announcements:
A “Mayor’s Seatbelt Challenge” campaign to encourage citizens to use their seatbelts
will be set and announced when details are finalized.
Mayor Tergin announced that crew members from the USS Jefferson City Submarine
will visit the City September 22 – 28, and looked forward to participating in some of the
events scheduled during that time with the crew.
LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE
Lincoln University student / City Council liaison Jonathan Jackson made the following
report:
Thank you to everyone who attended the August 27 Blue Tiger Fest in Downtown
Jefferson City.
On Saturday, September 5, the Lincoln University Marching Musical Storm and
the Football team traveled to Langston, OK, to compete against each other. The
Marching Musical Storm faced off with the Langston University Marching Band in
the Battle of the Bands, and on Saturday the football teams played. Both
organizations triumphed, and with a score of 34-32 the Blue Tigers earned their
first win of the season.

Saturday, September 12, 2015, at 12:00 p.m. at Dwight T. Reed Stadium, the
Blue Tigers will play St. Francis at our BLEED BLUE game. Please come help
root on the Blue Tigers.
Open Convocation will be Thursday September 10, 2015, at 11 a.m. in Mitchell
Auditorium with President Dr. Kevin D. Rome Sr. as the Keynote Speaker.
Since serving as City Council Liaison for the University, I have been asked to
come speak about Lincoln University to a few local organizations.
With the help of the Downtown Association that worked really hard for us to
receive Blue Tiger Tuesdays at select businesses in Jefferson City, MO, I will be
hosting a number of events at those locations for students to gather and meet
people in the community.
If there are any committees or initiatives that would like me to speak, please let
me know and I will be more than happy to assist and or attend such events.
PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS
Councilman Hussey announced Neighborhood Watch Night parties are coming up and
encouraged citizens to get involved in those.
Ms. Kate Hotle of Mediacom made a presentation to announce that Mediacom now
offers “Gigabit” Broadband service in certain parts of the City as a new premium
service. She distributed information about the service and answered questions asked by
the Council.
Mr. Justin Bennett of Concrete Solutions, LLC, made a presentation regarding Bill
2014-45 (Contract for Marshall – Roland Street project). He stated his objections to the
selection of the bidder awarded the contract.
Mr. Don Hentges made an announcement regarding the “Moving Wall” which will be in
Jefferson City later in September. It will open at noon at Thursday, September 24 and
remain until September 28. Anyone who wishes to participate in the reading of the
names may contact Ms. Eve Ward at the Jefferson City Veterans Council.
Mr. F. Joe Delong made a presentation regarding Bill 2015-33 (Adoption of 2016
Budget). He stated his objections to the increase in the Gross Receipts Utility Tax as
proposed by the Budget Committee.
CONSENT AGENDA
The following items were brought before the Council for approval by Consent:

c. Authorizing $218,000.00 Year 3 Renewal with All Season Landscaping and
Construction, Inc., for Yard Waste Drop Off and Composting Services
d. Authorizing $12,000.00 (approx.) Year 5 Renewal with St. Mary’s Occupational
Medicine for Medical Services – Workers’ Compensation
e. Authorizing $6,000.00 (revenue) Year 4 Renewal with Houck Transit Advertising

A motion was made by Councilman Graham for approval of the Consent Agenda,
seconded by Councilman Costales, and approved unanimously.

Councilman Henry requested that the rules be suspended and Bill 2015-45 placed on
final passage. There were no objections to the request for suspension of the rules.

Discussion was held and staff answered questions regarding the bid selected for the
project.

Councilman Branch requested that Bill 2015-42 be place on the Informal Calendar at
this time.
INFORMAL CALENDAR
2015-33, sponsored by Councilman Prather, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING A BUDGET
AND PERSONNEL CLASSIFICATION PLAN FOR THE CITY FOR THE PERIOD OF
NOVEMBER 1, 2015, TO OCTOBER 31, 2016, AND APPROPRIATING MONEY IN
THE CITY TREASURY TO PAY THE COST OF OPERATING THE CITY
GOVERNMENT DURING THAT PERIOD IN ACCORDANCE WITH THE BUDGET.
Councilman Prather requested that Bill 2015-33 be removed from the Informal Calendar
at this time. Bill 2015-33 was read by title and placed on final passage.
Councilman Prather made a motion to accept the budget as amended by the Budget
Committee and submitted to the Council. The motion was seconded by Councilman
Mihalevich. The motion was approved unanimously by the following roll-call vote:

Following a lengthy discussion, Bill 2015-33 was passed, as amended, by the following

A motion was made by Councilman Costales for adoption of Resolution RS2015-15 as
presented, seconded by Councilman Graham, and approved unanimously by the

PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS
Mr. Glover Brown made a presentation on behalf of the “Friends of Lafayette” to thank
the Council and staff for identifying the problems which will be addressed by passage of
Bill 2015-45 (Roland – Marshall Street improvement project).
COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY
There were no comments made at this time.
NEW BUSINESS
Councilman Costales asked if the City would be able to use legal action to recover the
cost of fighting the two recent arson fires. City Counselor Hilpert stated he would look
into that possibility and let the Council know.

A motion was made by Councilman Hussey to approve the August 17, 2015, Closed
Session Minutes, seconded by Councilman Prather, and approved by the following roll-
