Present: Mayor, Thomas Anderson Councilmembers, Wilfred Scherer, Thomas Crosby, William Reiser, Anne Heideman; Clerk -Treasurer, Donna Roehl; Planning and Zoning Admin- istrator, JoEllen Hurr; Public Works Director, James Dillman; Police Chief, Mich- ael Sankey; Engineers, Paul Pearson, Glen Cook; Attorney, Richard Schieffer; Building Inspector, Loren Kohnen 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following additional items; Septic system test results, Holy Name Lake area Hamel well, pump sale Public Works items 2. MINUTES OF APRIL 19, 1983 Board of Review Meeting Motion by Heideman, seconded by Anderson to accept minutes of Board of Review meeting of April 19, 1983, as presented. Motion declared carried Motion1by Scherer, seconded by Heideman to approve minutes of Regular meeting of April 19, Plotion declared carried 3. PUBLIC WORKS DEPARTMENT Tree Seedlings Jim Dillman stated that 600 seedlings had been ordered and that he would like to plant a number of them along Co. Rd. 24 for screen purposes. Medina Morningside Water Meters Jim Dillman stated that the Medina Morningside meters had been read by Francis Pumarlo and himself and that ten to twelve of them were in need of replacement at a cost of $53.00 each. Motion by Scherer, seconded by Crosby to replace eight meters, at this time, cost to be taken out of the Medina Morningside water fund. Motion declared carried Hamel Well Pump Wilfred Scherer stated that Brian Van Beusekom of Ingelside Engineering had explained that he did not know that the Minnesota Department of Health would require the amount of work that they had asked to be done after the Hamel well pump had been removed and he asked for a reduced price from the amount that he had offered to pay for the pump. Glen Cook stated that it would cost a considerable amount if the city were to hire the work done. Jim Dillman stated thatif the old pump were not removed, at this time, it would slow down the construction of the new well. Motion by REiser, seconded by Heideman to authorize Wilfred Scherer to negotiate a contract price with Ingelside Engineering for purchase of the Hamel pump. Motion declared carried 4.POLICE DEPARTMENT Secretary Michael Sankey requested an increase in pay to $5.50 per hour for the Police Department Secretary, adding that if a raise were granted now future increases would fall in line with others in January. Motion declared carried Additional Telephone Service Motion by Heideman, seconded by Crosby to table action on the addition of a third tele- phone line and another phone for the Police Department, pending receipt of installation and monthly charges from Northwestern Bell. Motion declared carried Directional Signs Michael Sankey stated that directional signs to be posted on Co. Rd. 24, for location of City Hall would cost $64.10 each and two signs would be needed. Motion by Crosby, seconded by Scherer to purchase two reflective directional signs at $64.10 each, with charges to be paid from Contingency fund. Motion declared carried 5. LIQUOR LICENSE FEES Thomas Anderson stated that the Liquor establishments along Highway 55 are being charged a fee comparable to Medina's fees and that Long Lake, Maple Plain and Minnetonka fees are higher. Motion by Reiser, seconded by Scherer to set 1983-84 Liquor license fees at the same rate as the 1982-83 fees. Motion declared carried 6. COPY MACHINE CONTRACT Donna Roehl presented a one year maintenance contract from Royal Business Machines for $400, explaining that a recent $5.00 fuse replacement had cost $65.00 for a service call. Council agreed to table the matter for the present time on the chance that a problem will not develop in the near future. 7. HOLY NAME LAKE AREA SEPTIC SYSTEM STUDY Loren Kohnen presented a map of the Holy Name Lake area indicating that inspections of all septic systems had been made; that three homes had failing systems; two were mar- ginal and the remainder had working systems. Council asked that notification be given to those with failing systems regarding corr- ections that would need to be made. 8. HOLY NAME LAKE, USE OF BOAT MOTORS, PUBLIC HEARING, 8:10 P.M. Ray Anderson reported that he had presented a petition at an earlier meeting of 100 percent of the property owners living around the lake asking that use of outboard motors be prohibitied because of the damage a large motor might do to the aeration equipment lines in the lake. Martin Bennis asked if special consideration could be given to the individual that maintains the equipment. Anne Heideman stated that she did not believe than such an exclusion could be included. Discussion of how Munn Scherer could be allowed to use his steam boat. Motion by Reiser, seconded by Scherer to close the Public Hearing. Motion declared carried Public Hearing closed at 8:20 P.M. Motion by Scherer, seconded by Heideman to authoirze the attorney to draft an ordinance which would allow non -gasoline motors and internal combustion engines on Holy Name Lake. Motion declared carried Donna Roehl asked if :signs should be posted in the access area long Co. Rd. 24. Michael Sankey stated that either the Park Reserve District or tie Department of Natural Resources might have signs. 9. .FLANNINO .AND ZONING .DEPARTMENT.. . .. 209 Bruce Neumann, Conditional Use Permit and Rezoning JoEllen Hurr reviewed the application and Planning Commission recommendation regarding Mr. Neumann's rezoning and Conditional Use Permit application to operate a repair garage at 25 Hamel Rd. She stated that more fencing should be required than the Planning Comm- ission had recommended. Anne Theis, Planning Commission member, stated that the Planning Commission had also wanted more fencing but that Mr. Neumann had stated that he could not financially afford more fenc- ing at this time. Anne Heideman stated that she agreed but that the time for completion could be extended. Thomas Anderson asked if paving had been discussed and if it is not required for this business as it is for other commercial and industrial developments. Anne Theis stated that this is a single owner/operator business and this business is his sole livlihood and some consideration should be given. Thomas Anderson stated that a 30 ft. easement is needed along Brockton Lane; that parking area should be paved and the entire area should be fenced. Bruce Neuman stated that he had thought the Planning Commission had been reasonable in their recommendations and that he would prefer to have his attorney present if the Council was go- ing to require items other than those of the Planning Commission. Richard Schieffer explained that the items listed were all items normally required of devel- opers and to not ask for them might jeopordize city ordinances. Mr. Neumann stated that he had scheduled an auction and everything would be cleared from the premises. JoEllen Hurr explained that the city could never secure a 30 ft. easement along Brockton Lane in other areas as houses are built very close to the road so it would not be fair to require Mr. Neumann to deed 30 ft. Motion by Heideman, seconded by Crosby to authorize staff to prepare a resolution approving a Conditional Use Permit for Bruce Neumann to operate a repair garage at 25 Hamel Rd. with the following conditions: A 30 ft. easement from the center line of Brockton Lane be deeded to the city. Fencing be constructed by September 30th, along southerly property line, east to Brock- ton Lane right of way, thence north parallel to corner of house; thence west to the house. Driveway and parking area to be blacktopped within 2 years. Motion declared carried Richard Schieffer suggested that the rezoning be acted upon at the time the Conditional Use Permit resolution is adopted. Motion by Reiser, seconded by Heideman to table the rezong application of Bruce Neumann until action is taken on the Conditional Use Permit resolution. Motion declared carried Cherokee Rd., Vacation JoEllen Hurr reported that Attorney, Michael Nash, had prepared materials for signature regarding vacation of Cherokee Rd. cul de sac as had been required in the Meadowwoods Plat approval. Richard Schieffer stated that street vacation requires a public hearing. JoEllen Hurr stated that the vacation was one of the conditons of the plat approval and that it was Mr. Nash who had prepared the materials in an attempt to clear up the file. Motion by Heideman, seconded by Scherer to vacate the Cherokee Rd. cul de sac. Mr. Schieffer stated that if owners other than the owner of the Meadowwoods property abut the cul de sac then a Public Hearing is required. Heideman asked that her motion be rescinded. Scherer rescinded the second. Motion by Heideman, seconded by Scherer to hold a Public Hearing on June 7, 1983, at 8:00 P.M. to consider vacation of the Cherokee Rd. cul de sac. Motion declared carried George Hanson, Conditional Use Permit JoEllen Hurr reviewed memo and Planning Commission recommendations regarding Mr. Hansen's application to conduct a boat trailer sales opeation at 2782 Willow Dr. Thomas Anderson asked if the type of business being conducted is allowed in a residential area. 210 Anne Heideman reported that firewood had been stored along Willow Dr. during the winter and that the snow plows had to plow around it. Donna Roehl explained that when the old city hall property was returned to the original owner it was to be combined with other acreage owned by Mr. Hansen. Mr. Hansen stated that he now receives three property tax statements. Thomas Crosby asked how home occupation, outside storage could be handled. Richard Schieffer stated that outside storage could be prohibited. Anne Theis stated that there is an existing commercial venture across the street from Mr. Hansen that has large vehicles parked on the property. Motion by Crosby, seconded by Reiser to authorize staff ,.o prepare a resolution approving a Conditional Use Permit to George Hansen to conduct al'trailer sales business at 2782 Willow Dr. subject to the following conditions: Combination of Lot A with Lots B and C Dedication of a 30 ft. right of way from center line of Willow Dr. No outside storage of materials related to Mr. Hansen's business Outside parking allowed for one boat trailer being used for personal and occasional business use No vehicles to be parked on Willow Dr. nor north of the building No storage or parking in the Willow Dr. right of way Parking area to be designated for items used in connection with business Motion declared carried Medina Motor Inn Acting Mayor, William Reiser conducted this portion of the meeting. JoEllen Hurr reviewed memo and Planning Commission recommendations. Thomas Anderson stated that the Planning Commission wnated an additional 20 ft., front footage, but this lots fronts on a cul de sac. Ms. Hurr stated that there would only be 80 ft. of frontage if Hunter Dr. were to be extended at a later date, and 110 ft. is needed to comply with the subdivision ordinance. Thomas Crosby asked what the correlation was between action the city is being asked to take and sewer availability. Ms. Hurr explained thatMetro Waste Control has not said that the city cannot allow add- itional connections to the system. William Reiser asked if we had specifically asked them. Ms. Hurr stated that it had been made clear to them that there are those within the sewer district that may wish to develop their property. Thomas Crosby suggested a way, in which, the front footage could be extended beyond the Hunter Dr. cul de sac. William Reiser asked if plans still included a Beauty Shop and Travel Agency to be located in the building. Robert RAskob stated that they were still considering the Travel Agency. Thomas Anderson stated that they had shown more than adequate parking. JoEllen Hurr suggested that they determine a square footage for accessory use even if they should decide not to use it. She also explained that a landscaping plan was needed that would have grass rather than rock and that she would be receiving a report from the Elm Creek Conservation Commission. Motion by Crosby,seconded by Heideman to grant preliminary plat approval to the TRA Corp- oration for 3 lots with actual acreage to be determined when plat is redrawn to show ex- tended Hunter Dr. cul de sac frontage. Motion declared carried. Not participating -Thomas Anderson Motion by Crosby, seconded by Heideman to authorize staff to draft a resolution approving a Conditional Use Permit for construction of the Medina Motor Inn subject to the following conditions: Green area/hard cover ratio to be met °sk tte 528 Sq. Ft. of building to be used for accessory, commercial use Engineers requirements regarding water lines and fire hydrants shall be met Elm Creek Watershed requirements to be met Minnesota Department of Transportation to review designated entrance Landscape plans to be approved by city staff Development contract to be entered into Any approval to be subject to availability of sewer Motion declared carried. Not participating -Thomas Anderson Brett and Kathy Cook JOEllen Hurr reported that the Cooks have requested a tim extension to allow the mobile home on their property at 2900 Co. Rd. 19, until August 31, 1983, at which time their home should be completed. She stated that a number of calls had been received regarding the trailer on the property and that some sort of agreement should be signed by the Cooks' regarding the removal by August 31st. Motion by Crosby, seconded by Heideman to grant a time extension until August 31, 1983 to allow a trailer to remain on property at 2900 Co. Rd. 19, subject to the owner entering into an enforceable agreement regarding removal, by that date. Motion declared carried Paul Pearson. reviewed McCombs-Knutsons request for an amendment in the amount of $9067 additional,due to changes and additional He stated that the costs would be taken from the original bond Thomas Crosby stated that the projects engineering fee is high to wait three months until the project is completed. Anne Heideman asked what contract amendment # 1 included. Paul stated that it granted a time extension for completion of the project to August, 1983. Motion by Crosby, seconded by Heideman to authorize signature of Contract amendment # 2 increasing the engineers fee from $91,702 to $100,769. Motion declared carried 21 10. SYLVESTER SCHUMACHER, MEDINA MORNINGSIDE SEWER INSTALLATION Council discussed letter from Mr. Schumacher's attorney regarding responsibility if problems develop in connection with his sewer line installation. Council reviewed prior meeting discussions that had been held regarding the matter. Motion by Crosby, seconded by Scherer to authorize the City Clerk to inform Mr. Schumacher's Attorney that the Council understands that there is adequate elevation from the Schumacher house to the sewer line in the street, if the sewer line is properly installed and that the matter should be resolved with Mr. Schumacher's contractor, Jerry Johnson. Motion declared carried 12. ERNEST ELLIS JoEllen Hurr reviewed letter that had been sent to Mr. Ellis regarding clean-up of property at 4985 Hwy. 101. She stated that the animals would be removed by June 1st and that she would follow up on her letter of April 22, 1983 to Mr. Ellis. Regarding the old autos on the Neumann property to the north, she stated that the owner of that property should tell Mr. Ellis to have them removed. 13. BILLS Motion by Reiser, seconded by Crosby to pay the bills; Order Checks # 2021 - 2085 in the amount of $31,276.99 and Payroll Checks # 7145-7167 in the amount of $11,039.48. Motion declared carried 13. ADMINISTRATION SALARIES Council discussed salaries for 1983 and job descriptions, individually, with Donna Roehl and JoEllen Hurr. Motion by Heideman, seconded by Scherer to set salary of Clerk -Treasurer and Planning and Zoning Administrator at $11.50 per hour for 1983, retroactive to January 1, 1983. Motion declared carried Motion by Reiser, seconded by Heideman to adjourn. Motion declared carried Meeting adjoned at 11:30 P.M. Clerk -Treasurer
