HomeMy Public PortalAbout032-1983 - Amending Article 33.031 of Chapter 154 - ZoningGENERAL ORDINANCE NO. 32-1983 AN ORDINANCE AMENDING ARTICLE 33.031 OF CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDLANA, ADOPTED JUNE 3, 1968. WHEREAS, it is the intent and purpose hereof to amend Article 33.031 of the Zoning Ordinance to provide that in a C-4 Zoning District the outdoor display or storage of merchandise, vehicles, materials and equipment when located within 1000 feet of a C-3 Zoning District shall be per- mitted only through the authorization of the Board of Zoning Appeals; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 28th day of June , 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of theRichmond City Plan Connnission was eight (8) to zero (0) in favor of recommending passage of Ordinance No. 32-1983. NOW 7JEREFORE BE IT ORDANIED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That Article 33.031 of Chapter 154 of the Municipal Code shall be amended to read as follows: 33.031 Closed Buildings: All businesses, services or processing shall be conducted wholly within a completely enclosed building except for the display of merchandise, sale of motor vehicle fuel, lubricants and other fluids at ser- vice stations, loading and unloading operations, parking and the outdoor display or storage of vehicles, materials and equipment. Except that the outdoor display or mer- chandise and the outdoor display or storage of vehicles, materials and equipment when located within one thousand (1000) feet of a C-3 Zoning District shall be permitted only through the authorization of the Board of Zoning Appeals. SEC -LION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. June 30, 1983 Mr. Kenneth Mills, President Members of Common Council and Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 32-1983 Plan Commission Case No. PC-83-9 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 28, 1983, on its own petition requesting to amend Article 33.031 of the Zoning Ordinance. The requested amendment is a result of there being three (3) re- zoning requests in the last eighteen (18) months to the C-4 Zoning District all being within 1000 feet of the downtown C-3 Central Business District. In each request the Plan Commission has recom- mended to Common Council that the C-4 rezoning be approved. In general, C-4 uses are compatible with C-3 uses and the wholesaling and warehousing allowed in C-4 is particularly appropriate in sup- port of the Central Business District. However, there is an aspect of the C-4 District that could have a negative impact on the Central Business District, and that is the outside storage and display of materials and equipment that would be allowed with certain C-4 uses. Therefore, in order to mitigate the adverse effects of outside storage, the Plan Commission is proposing the following amendment to Article 33.031 which would read: 33.031 Closed Buildings: All businesses, services or processing shall be conducted wholly within a completely enclosed building except for the display of merchandise, sale of motor vehicle fuel, lubricants and other fluids at service stations, loading and unloading operations, parking and the outdoor display or storage of vehicles, materials and equipment. Except that the outdoor display of merchandise and the out- door display or storage of vehicles, materials and equipment when located within one thousand (1000) feet of a C-3 Zoning District shall be permitted only through the authorization of the Board of Zoning Appeals.
