AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE
NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF
PROPERTY LOCATED AT 105 AND 109 NORTH 5th STREET, 69, 73, 75, 77, 79,
95 and 97 FORT WAYNE AVENUE; 106, 126, 130 AND 214 NORTH 6th STREET;
AND 508, 518 and 520 NORTH "A" STREET FROM R-3 ONE -TO -EIGHT FAMILY
RESIDENCE DISTRICT AND C-3 CENTRAL BUSINESS DISTRICT TO C-4 GENERAL
BUSINESS DISTRICT.
WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968
designates and describes as R-3 One -to -Eight Family Residence
District and C-3 Central Business District the above described
property; and,
WHEREAS, it is the intent and purpose hereof to change the zoning
classification of said property from R-3 One -to -Eight Family
Residence and C-3 Central Business District to C-4 General
Business District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the 28th day of June, 1983, at which time
remonstrances were heard from all parties interested in or
affected by this Ordinance; and
WHEREAS, the vote of the Richmond City Plan Commission was eight (8)
to zero (0) in favor of recommending the passage of Ordinance
No. 33-1983.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana, as follows:
SECTION 1. That the zoning classification of the property described
below be, and the same is hereby changed to C-4 General
Business District and that said property be regulated in
accordance with the zoning Ordinance of the City of Richmond,
Indiana, and all amendments thereto.
The following described real estate situated in the City of
Richmond, Indiana, to wit:
Lots 21,22, 23, 36, 37, 38, 39, 40 and 41 in the Jeremiah
Cox Addition, and Official Map 568 and the vacated alley ad-
joining and immediately south of Official Map 568
SECTION 2. This Ordinance shall be in full force and effect from and
after its passage and approval as by law required.
PASSED AND ADOPTED by the Common Council-lof the City of Richmond,

Dear Mr. Mills, Members of Corrmon Council and Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on
Tuesday, June 28, 1983, on the petition of George E. Mariani et
al (petitioners being the owners of at least fifty percent (50%)
of the area included in the petition); Frank Otto, Agent, re-
questing to rezone property located at 105 and 109 North 5th
Street; 69, 73, 75, 77, 79, 95 and 97 Ft. Wayne Avenue; 106, 126,
130 and 214 North 6th Street; and 508, 518 and 520 North "A"
Street from R-3 One -to -Eight Family Residence District and C-3
Central Business District to C-4 General Business District.
Fourteen (14) notices of public hearing were sent to surrounding
property owners with one (1) returned in opposition to the re-
quest.
The Plan Commission voted eight (8) to zero (0) to recorrmend the
adoption of Ordinance No. 33-1983 and determined the following:
1. The petition has been initiated by property owners
in the area who own at least 50% of the property
sought to be rezoned which complies with the State
law.
2. The Master Plan designation for the property in
question is Industrial.
3. The rezoning to C-4 would allow for a mix of retail,
service, and wholesale commercial uses which would
enhance the probability of the area becorrming a
viable commercial area. The wholesale and ware-
housing uses allowed in C-4 would be particularly
appropriate in this area in support of Richmond's
Central Business District.
4. The predominate land use in the area is commercial
including two (2) existing C-4 uses.
5. The property adjoins C-4 zoning to the west.
