HomeMy Public PortalAbout036-1983 - Grant - Emergency Jobs Program - RP&LORDINANCE NO. 36 - AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF COMMUNITY DEVELOPMENT PROGRAM FUNDS PURSUANT TO THE "EMERGENCY JOBS PROGRAM" AND DESIGNATING RICHMOND POWER & LIGHT AS THE AGENCY OF THE CITY OF RICHMOND, INDIANA FOR THE ADMINISTRATION OF SAID GRANT AND MATTERS RELATED THERETO. WHEREAS, the City of Richmond, Indiana is the owner and operator of a municipal electric utility system engaged in rendering utility service to the City and the inhabitants thereof for public, domestic and industrial uses under the style of Richmond Power & Light (RP&L); and WHEREAS, the County Commissioners of Wayne County and the City jointly applied for a federal grant through the State of Indiana, Department of Commerce, Community Development Program, which said grant, in the amount of Five Hundred Thousand Dollars ($500,000.00), has been approved under the provisions of the "Emergency Jobs Program"; and WHEREAS, the general purposes of said grant are to transmit from the Richmond State Hospital via a transmission system owned and under the control of RP&L to E.G. Hill Company, Inc., steam/hot water produced by the excess boiler capacity existing at the Richmond State Hospital; and WHEREAS, certain other costs beyond grant funds will be required to be expended by RP&L for the purposes of said project, certain grant conditions must be complied with and grant funds must be applied for from time to time in accordance with said grant conditions; contracts have to be negotiated between the various parties, consultants and contractors; and WHEREAS, the grant provisions must be complied with and certain regulatory agencies may require their approval and will of necessity have to be negotiated with; and NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA AS FOLLOWS: Section 1. That Richmond Power & Light by and through its General Manager is hereby designated as the Agent of the City of Richmond, Indiana for purposes of carrying out all the terms and provisions of this ordinance including the terms of the said grant under the Emergency Jobs Program, carrying out the conditions thereof, executing all documents required in connection therewith, negotiating and contracting with all of the necessary parties including but not limited to the State of Indiana, Richmond State Hospital, E.G. Hill Company, Inc., consultants, and contractors as may be required. Section 2. That with respect to the grant funds in the amount of 500,000.00, Jock J. Pitts shall have authority to approve the obligation of grant funds and must approve the expenditure of said funds to insure the conformity to the grant provisions and shall make application to governmental authorities for said funds from time to time as may be required. -z- Section 3. That said General Manager is hereby author- ized to execute on behalf of the City of Richmond, Indiana and Richmond Power & Light all contracts and agreements that may be required to carry out the purposes and provisions of this ordinance. Section 4. That the General Manager of RP&L and his staff are hereby authorized to take any and all actions necessary to carry out the terms and provisions of this ord- inance and the said grant including but not limited to executing documents, negotiating contracts, and such other actions as may from time to time be required and that funds on hand of RP&L reasonably estimated to amount to One Hundred Seventy Five Thousand Dollars ($175,000.00) are hereby authorized. Section 5. This ordinance shall be in full force and effect from and after its passage and execution.
