HomeMy Public PortalAbout038-1983 - Amending Article 31 of Chapter 154 - ZoningGENERAL ORDINANCE NO. 38-1983 AN ORDINANCE AMENDING ARTICLE 31 OF CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. WHEREAS, it is the intent and purpose hereof to amend Article 31 of the Zoning Ordinance to add Article 31.011 Wood Stripping; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 26th day of July, 1983, at which time remonstrances were heard from all parties in- terested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was nine (9) to zero (0) in favor of recommending passage of Ordinance No.38-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That Article 31 of Chapter 154 of the Municipal Code shall be amended by adding Article 31.011 to read as follows: 31.011 Wood Stripping: The process of utilizing a chemical solvent which has been demonstrated to be non -hazardous by reason of odor, dust, fumes, refuse matter, or air or water carried waste, to remove paint, lacquer, varnish, shellac or other wood finish- ing material from antiques, household furnishings or other wood pieces. Wood stripping may include those services normally con- sidered accessory to a stripping business such as minor repairs, gluing, sanding and hand finishing. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. July 27, 1983 Mr. Kenneth Mills, President Members of Common Council and Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 38-1983 Plan Commission Case No. PC-83-12 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, July 26, 1983, on its own petition requesting to amend Article 31 of the Zoning Ordinance. The Planning Department has been approached by a party proposing to establish a wood stripping business. However, the Zoning Ordinance presently does not classify the use wood stripping in any zoning district regulation. During the public hearing, the Plan Commission determined that wood stripping should properly be placed within the C-2 zoning district by adding a new Article 31.011.
