Members Present: Council Members John Ferris, James Johnson, Ann Thies, Philip Zietlow and Mayor Anne Theis. Members Absent: None. Also Present: Police Chief Rick Rabenort, Public Works Director Jim Dillman, City Engineer Shawn Gustafson, City Attorney Ron Batty and Clerk - Treasurer Jeff Karlson. 1. ADOPTION OF AGENDA Moved by Zietlow, seconded by Thies, to adopt the agenda with the following additions: a. Update of Medina Morningside Drainage Problem b. Appreciation for City Volunteers Motion passed unanimously. 2. CONSENT AGENDA Moved by Thies, seconded by Mayor Theis, to adopt the consent agenda, as follows: a. Approval of Lawful Gambling License for Minnesota Deer Hunters Association/West Suburban Chapter Motion passed unanimously. 3. MINUTES Moved by Thies, seconded by Ferris, to approve the minutes of the regular meeting of April 19, 1994, as presented. Motion carried unanimously. 4. 1993 FINANCIAL AUDIT City Auditor Dave Hinnenkamp of Kern, DeWenter, Viere presented the audit of the financial statements of the City for the year ended December 31, 1993. Hinnenkamp said two bond issues could be called in 1994, which included the 1985 General Obligation Bonds with interest at 6.25 to 8.40 percent and the 1987 Taxable G.O. Bonds with interest at 8.50 to 9.30 percent. Hinnenkamp said the Water Fund had enough retained earnings to cover operating expenses and depreciation, but the Sewer Fund had a net income loss of $25,647. Hinnenkamp recommended that the Council review the City's sewer rates and increase rates enough to cover depreciation for future infrastructure replacement. Hinnenkamp said that overall the financial condition of the City was very good. 68 Moved by Ferris, seconded by Thies, to accept the audited financial statement of the City for the year ended December 31, 1993. Motion passed unanimously. 5. ELLIE CROSBY - REQUEST FOR CONDITIONAL USE PERMIT Ellie Crosby, 1612 Willow Drive, requested a conditional use permit for a private dog kennel at her residence. The Planning Commission recommended that the conditional use permit be approved with ten conditions. The maximum number of dogs that would be permitted on the property was eight. Moved by Thies, seconded by Ferris, to direct city staff to prepare a resolution granting a conditional use permit to Ellie Crosby for a private dog kennel. Motion passed unanimously. 6. PETER LAKE DRAINAGE The Council discussed the high water level of Peter Lake which was brought to their attention by Jim Dillman and George Layeux, 4605 Wichita. Layeux felt that the high water problem was due to the rock dam upstream of the Pioneer Trail culvert. Tom Hovey of the DNR had visited the site and concluded that the water level at the rock dam was lower than the previous year and was not restricting the flow of the water. The railroad culvert was completely submerged, but it was difficult for Hovey to determine if it was plugged to any extent. Hovey said the City could start to eliminate the problem by dredging a channel between the lake and railroad channel. He also informed Dillman that a DNR permit would be required if the City wished to remove the rock dam. Dillman said he looked for a beaver dam between the lake and the railroad culvert and did not observe anything that would have restricted the flow. Jim Johnson said the City should find a solution to the problem with assistance from the DNR. Mayor Anne Theis said the Council could be opening up a Pandora's box by correcting the water problem because the City could have 25 more people ask for the same assistance. Shawn Gustafson said one solution to cover the expense of correcting drainage problems throughout the City would be to add a stormwater utility charge to the utility bills. Ann Thies asked if the Pioneer -Sarah Creek Watershed District monitored the flow of water in the area. Mayor Theis said if a water problem is confined within one city, the watershed district would not try to solve that individual city's problem. Johnson suggested that Community Development Block Grant funds be used for this type of project. 69 Dillman said it was difficult to determine what the exact problem was without shooting elevations. Dillman recommended that the city engineers survey the ditch and shoot elevations. Dillman said the City could then come up with a plan to obtain a DNR permit for the correction work. Moved by Johnson, seconded by Ferris, to authorize the city engineers to survey the ditch and shoot elevations at an estimated cost of $1,500 and bring back a report identifying the problems and what action is needed to resolve them. Motion passed unanimously. 7. REQUEST FOR FISHING DOCK John Wilson, 4595 Walnut Street, and Tony Barden, 3140 Cedar Avenue, requested permission to build a fishing dock at the end of Beechnut Street. Jim Johnson said this matter should go to the Park Commission first before the Council reviewed it. Moved by Johnson, seconded by Ferris, to forward the request to the Park Commission for their review and recommendation. Motion passed unanimously. 8. HIGHWAY 12 ALTERNATIVES Ann Thies said discussion surrounding the Highway 12 alternatives had reached a point where Medina needed to decide what alternative was best for the community. Thies said she was concerned that Medina's comments up to this point were not being conveyed accurately. Thies said the City had to take a more active approach as to what was going on. She recommended that one other council person and two planning commission members be available for the next Highway 12 policy meeting and for the additional caucuses which would be held at various locations. Jim Johnson said he would volunteer to attend the next meeting. Moved by Johnson, seconded by Thies, to refer the matter of the Highway 12 alternatives to the planning commission for their review and a determination as to whether the Highway 6 alternative is consistent with Medina's comprehensive plan; and to request that two members of the planning commission be present at the next Highway 12 policy meeting. Motion passed unanimously. 9. COUNTY ROAD 116 SEWER MAIN PROJECT City Engineer Shawn Gustafson estimated that the cost of putting in piling for the sewer line along the Feltl property would be $93,000. Gustafson said construction for the remainder of the project was running under the projected cost by about $53,000 meaning that the total project cost would have an expected overrun of $40,000 with the additional piling. Gustafson proposed a June 2, 1994 bid opening date and the award of the bid on June 7. Phil Zietlow asked if the project could be completed this winter if Lundgren Brothers was in no hurry to begin development in 1994. 70 Gustafson said it was feasible that the work could be completed in the winter but he added that there was no reason to think that the Lundgren Bros. development would not proceed in 1994. Ron Batty said the City would have to go back to Lundgren and request an additional $40,000 for the cost of the piling. Moved by Johnson, seconded by Zietlow, to adopt Resolution No. 94- 26, "Resolution Approving Plans and Specifications and Ordering Advertisement for Bids for Co. Rd. 116 Trunk Sanitary Sewer Piling Improvement." Ayes: Ferris, Johnson, Thies, Zietlow and Mayor Theis. Nays: None. Resolution No. 94-26 adopted on a 5-aye and 0-nay vote. 10. MEDINA MORNINGSIDE STORMWATER DRAINAGE Phil Zietlow said the key question regarding the Medina Morningside stormwater drainage ditch was the potential safety hazard caused by the erosion of the ditch. Zietlow said it was not a safety hazard at the present time, but if the ditch continued to erode it would become a problem. He said City Engineer Shawn Gustafson and Public Works Director Jim Dillman had suggested laying pipe to take care of the problem. Zietlow said the City could lay 100 feet of pipe each year over a 5-year period. He added that the expenditure could be justified because of the taxes paid by the 82 homeowners in Medina Morningside. Fred Keller said the Council should keep in mind that the City created the problem by directing water to the ditch. Ron Batty said whenever a public improvement project is involved, it is a public issue. He said it could be a general fund expenditure or it could be an assessment project. Batty added that many residents believed it was not their problem and would object to an assessment. John Ferris said the issue of taking care of stormwater was a broad responsibility that all cities had to deal with. The cost of fixing the drainage easement at Medina Morningside was estimated at $100,000. Johnson said the City needed a policy which addressed these issues. Ferris said the City would have more water problems in the future as development continued to occur in Medina. Mayor Theis said the Council should move ahead and authorize Shawn Gustafson and Jim Dillman to put together an improvement plan. Johnson asked if the City should have a policy in place before proceeding with a solution to the problem. Ron Batty said he did not see a need for a comprehensive policy. Batty said the Council could address each problem on an ad hoc 71 basis. Batty said Peter Lake was a different problem from the Medina Morningside drainage. Batty added that the Council could consider a Chapter 444 project, whereby the City would set up stormwater districts and pay for improvements through taxes rather than special assessments. Mayor Theis directed City Engineer Shawn Gustafson and Public Works Director Jim Dillman to develop an improvement plan for the Medina Morningside drainage ditch. 11. OPEN MEETING LAW DEFENSE COST COVERAGE The Council considered the purchase of Open Meeting Law defense cost reimbursement coverage offered by the League of Minnesota Cities Insurance Trust. The cost of the coverage was $500. The policy included coverage for elected and appointed city officials. Ron Batty said open meeting laws had become much more complicated and there was significant risk to public officials just trying to do their job. Batty said the coverage was well worth the cost. Moved by Thies, seconded by Ferris, to approve the purchase of the Open Meeting Law Defense Cost reimbursement coverage at a cost of $500. Motion passed unanimously. 12. APPRECIATION FOR CITY VOLUNTEERS The Council expressed appreciation to Dave Stejskal of Boudreau Construction, Ron Etzel of R & R Express, and Tony Barden of Sealed Tight Deck Services for volunteering their time and talents to the City when they replaced the roof on the Independence Beach well house; and to Randy Mayer of Mayer Mobil for donating two fuel pumps to the Public Works Department. Mayor Theis commended these Medina residents for assisting the City. 13. PAYMENT OF BILLS Moved by Thies, seconded by Ferris, to approve payment of Order Check Numbers 13182-13231 for $245,486.74 and Payroll Check Numbers 13868-13884 for $12,017.88. Motion passed unanimously. 14. EXECUTIVE SESSION Ron Batty announced at 10:10 p.m. that the Council would be going into executive session to consider the grievance appeal of Officer Chuck Wallace. Batty recommended that the meeting be closed based on the court decision, Unke v. Independent School District 147. Moved by Mayor Theis, seconded by Thies, to close the executive session at 10:55 p.m. Motion passed unanimously. Moved by Mayor Theis, seconded by Ferris, to uphold the determination that Officer Chuck Wallace resigned from his employment with the Medina Police Department due to his unauthorized absence from duty on March 4, 5, 6 and 7, 1994. [This determination was made pursuant to the terms of the Labor Agreement 72 between the City of Medina and LELS.] Motion passed unanimously. 15.
