In accordance with the Warrant the meeting was held in the Brewster
School Auditorium Monday, March 4 , 1968.
The meeting was called to order at 7 :00 P. m. b7 the Moderator, Grant
W. Koch with June Gallant, Paul Sylver,and Dorothy Grenier serving as ballot
clerks and checkers. Prayer was offered by Rev. Edward Ellmore,
The Warrant was read by the Town Clerk, Donald P. Coxsodine, with the
exception of the Articles which were read as they were being considered,
ARTICLE 1. To act on the annual report of the Selectmen and other
Town Officers .
Voted unanimously that the. annual report of the Selectmen and other
Town Officers be accepted as printed.
ARTICLE 2. To see if the Town will vote to authorize the Town Treasurer9
with the approval of the Selectmen., to borrow money from time to time in
anticipation of the revenue of the financial year beginning January 1, 1968
and to issue a note or notes, therefore, payable within one year, and to
renew any note or notes as may be given for a period of less than one ,year in
accordance with Section 17 of Chapter 44, General Laws as amended.
Voted unanimously that the Town authorize the Town Treasurer with the
approval of the Selectmen, to borrow money from time to tame in anticipation
of the revenue of the financial year beginning January 1, 1968 and to issue
a note or notes, therefore, payable within one year and to renew any note or
notes as may be given for a period of less than one year in accordance with
Section 17 of Chapter 44, General. Laws as amended.
ARTICLE 3. To see if the To-an will vote to transfer a sum of money
from surplus overlays to -the Reserve Fund,
Voted unanimously that Five Thousand Dollars ( $5,000.00 ) be transferred
from surplus overlays to the Reserve Fund,
ARTICLE 4. To hear the report of any special committee,
Lawrence Crocker reported on the Regional School and Herbert
Montgomery reported on the Dump.
ARTICLE 5. To see if the Town will vote to fix the salary and compen-
sation of all elective officers of the Town as provided by Section 108,
Chapter 41, General. Laws as amended to be affective January 1, 1968 as follows :

ARTICLE 6, To see if the Town will vote to amend the Personnel By- Law as
by adding to Section 12-Sub Section. B4 as follows: x$450.00 per year (includes
transportation) for Sewage inspector - Regular Part Time.
Voted unanimously that the gown amend the Personnel By-Law by adding to
Section 12-Sub Section Btu as follows : $450 -00 per year (includes transportation,
for Sewage Inspector - Regular Part Time.
ARTICLE 7. To see if the Town will vote to amend the Personnel
By-Law as f ollows :
Section 5.1.1-Delete the words 'FULL TIME POLICE" , so that Section
5.1.1 will read as follows : EXCLUSIONS - No overtime pay shall be
allowed elected Town Officials whose salaries are established by the
town meeting, department heads, those in an administrative or supervisor
capacity, clerical employees , regular fire personnel, communications
personnel, and others as may be elected by agreement at time of employ-
ment. An exception tot his rule nay be elected officials whose salarie,
are established by the town meeting at an hourly rate and who are author
ized to be paid by vote of the town, but in such circumstances overtime
work shall be paid for only at the regular hourly rate established by
the town meeting.
Section 5.1.3 - Add after the word work in the last line the
words ''EXCEPT POLICE WHO SHALL BE 2AID FOR OVERTIME AND COURT TIME."
Therefore Section 5.1.3 will read as follows :-TIME OFF IN LIEU OF
OVERTIME PAY -- The Town., through its Selectmen, or through its depart-
ment heads, with the approval of the Board of Selectmen, reserves the
right to substitute time off with pay in lieu of payment of overtime
and court tine as provided for in section 5.1.2.
voted unanimously that the Town amend the Personnel By-Law as
follows :

PAY- The Town, through its Selectmen, or through its department heads
with the approval of the board of Selectmen, reserves the right to
substitute tine off with pay in lieu of payment of overtime for such
hours worked, except police who shah be paid for overtime and court —
tine as provided for in Section 5.1.2.
It was voted to take up Article 47 at this time.
ARTICLE L7. To see if the Town will vote to raise and appropriate
and add to the street lighting budget the sum of Seventy Two Dollars
072.00) to install and maintain four street lights on Crosby Lane on
poles No. 1/6, 72, 10, 13S.
Voted unanimously that the Town raise and appropriate and add to

ARTICLE 8. To see if the Town will vote to raise and appropriate
such sums of money as may be deemed necessary to defray Town charges

ARTICLE 10. To see if the Town_ will vote to raise and
appropriate or transfer from unappropriated available funds
in the treasury, a suer: of money for Chapter 90, Highways.
Voted unanimously that the Town raise and appropriate
the sum of $1 ,500.00 and transfer from free cash the sum of
$13,500.00 to meet the cost of the state and the countyis
share of Chapter 90, Highway construction.
ARTICLE 11. To see if the Town will vote to transfer
the sum of Three Thousand Three Hundred Twenty Four Dollars
and Twenty . Five C eat s ($3,324.25).25) from the fund provided by
Section 5 of Chapter 679 of the Acts. of 1967 to be used for
resurfacing work on Freemans Way,
Voted that the Town transfer the sum of Three Thousand
Three .Hundred Twenty Four Dollars and Twenty Five Cents
(3324-25) from the fund provided by Chapter 616 of the Acts
of 1967 to be used for resurfacing work on Freemjans gray.
ARTICLE 12. To see if the Town will vote to appropriate
from the Road Machinery General Fund, the sura of Thirty Five
:hundred Dollars ($3,500.00) to be used far the purchase,
maintenance and operation of Road Machinery.
Voted unanimously that the Town appropriate from Road _
Machinery General Fund, the sum of Thirty Five Hundred Dollars
{$3500.00) to be used for the purchase, maintenance and oper-
ation- of Road Machinery.
ARTICLE 13. To see if the Town will vote to raise and
appropriate the sum of Fourteen Hundred Seventy Five Dollars
(^ 1 75.00 ) for resurfacing the balance of the School Parking
Lot ,
Voted unanimously that the `Down raise and appropriate the �

ARTICLE 14. To see if the Town will vote to raise and appropriate
the sum of Thirty Four "hundred Dollars ( 3400.00) to clear, grade,
harden, pave and berm the landing at Walker' s Pond.
Voted that the Town raise and appropriate the sum of Thirty Pour
Hundred.Dollars ($3400.00) to clear, grade, harden, pave arid berm the

ARTICLE 15. To see if the Town will vote to raise and appropriate
Nineteen Hundred Dollars ($1900.00) to clear, grade and harden a
landing at Pine Pond.
This article was disapproved by a hand vote of 52- Yes - 98 -- No.
ARTICLE 16. To see if the Town will vote to raise and appropriate

ARTICLE 17. To see if the Town will raise and sppropriate to the
Planning Board the su-m of Nineteen Thousand Four Hundred Dollars
($19,400.00 ) for the Planning Board to be used to retain the firm of
Tfetcalf & Eddy, Date. for the preparation of a Master Plan.
Voted that the Town raise and appropriate to the Manning Board
the swim of Nineteen Thousand Four Hundred Dollars ($19,400.00) for the
Planning Board to be used to retain the firm of Metcalf & Eddy, Inc .
for the• preparation of a Master Plan.
It was voted to take up the Special Town Meeting at 9:00 P. 1i.
The meeting was called to order at 9:00 P. 1M. by the Moderator,
Grant W. Koch. The warrant was read by the Town Clerk, Donald P.
Consodine, excepting the articles .ti=hich were read as they were being
considered.
ARTICLE 1. To see if the Town will vote to petition the General
Court to authorize the Town to construct a foot bridge over Paine t s
Creek.
Voted unanimously that the Town petition the General Court to
authorize the `Down to construct a foot 'bridge over Paine t s Creek.
ARTICLE 2. To see if the Town will vote to permit the enlargement
of the body comprising the Dennis Water District as established by the
Massachusetts Legislature in Chapter 277 of the Acts of 195 to include
the tax paying inhabitants of Brewster residing within the following
boundary lines, to wit-

Co=encing at the intersection of the boundary lines between the
Town of Brewster and the Town of Dennis , at a monument near Old County
Way, and running northwesterly by the boundary line between the Town of
Brewster and the Town of Dennis located in Quivet Creek to the Old County

ARTICLE A. To act on any other business that nay
legally come before said meeting.
There being no farther business, the meeting adjourned
at 9:25 P. M.
ARTICLE 18. To see if the Town will vote to enter into
a contract with the Barnstable County Conservation District
for the preparation of a soils map to be used as a basic —
part of the Town Master Plan and raise and appropriate the
sur, of Four Thousand One Hundred Fifty One Dollars (7151.00)
Voted that the Town enter into a contract with the
Barnstable County Conservation_ District for the preparation
of a soils rap to be used as a basic part of the Town Master
Plan and raise and aprropriate the sums of Four Thousand One
Hundred Fifty One Dollars ( $4151.00) .
ARTICLE 19. To see if the Town will vote to amend the
zoning, by-law as follows : Section V - USE REGULATIONS -
Paragraph B - In a Limited Business Distract, add a new sub-
section 7 to read as follows : "A U.S. Post Officers.
Voted that the Town amend the zoning by-law as .follows :

ARTICLE 20m To see if the 'Town will vote to construct
a new Herring Run fish ladder and retaining wall behind the
Old Mill and raise and appropriate the sum of Four Thousand
Two Hundred Dollars C$4,200.00) .
Voted unanimously that the Town construct a net Herring
Run fish ladder aid retaining wall behind the Old Mill and
raise and appropriate the sun- of Four Thousand Two Hundred
Dollars ($4,200.00) .
ARTICLE 21. To see if the Town will vote to amend the
building code by-law as follows : Section 9 REQUTREMEYTS FOR
ALL BUILDINGS - Paragraph 7, add the following sentence:
Precast metal ehimmeys and fireplaces of a type approved bay

ARTICLE�E 22. To see if the Town will vote to instruct
the Assessors to act under Chapter LO, Section 4 of the
General laws and to enter into a contract for a professional
equalization of unimproved acreage south of Route 6A and
raise and appropriate the sum of Five 'Thousand Dollars

ARTICLE 23. To see if the Town will vote to authorize
the Selectmen to lay out Old North Road and riase and approp-
riate the sum of Seven. Hundred Fifty Dollars (8750.00) for
engineering purposes.
Voted unanimously that the Town authorize the Select-
men to lay out, Old North Road and raise and appropriate the
sum of Seven Hundred Fifty Dollars ($750.00 ) for engineering
purposes.
ARTICLE 14 . To see if the 'Town will vote to purchase a
new half ton pickup truck for the highway Department use and
rase and appropriate the sum of Seventeen Hundred Eighty
Five Dollars 01,785.00; and authorize the Selectmen to trade
in the present truck toward the purchase.

ARTICLE 25. To see if the Town will vote to raise and approp-

advantages of the Town in accordance with the provisions of Chapter
42, Acts of 1954-
Voted unanimously that the Town raise and appropriate the sum

ARTICLE 26. To see if the Town will vote to raise and approp-
riate the sum of Two Hundred Six and 80/100 ($206.80) under the
provisions of Chapter 388, Acts of 1954 amended by Chapter L33 of
1955, control of Greenhead Fly, and authorize the Town Treasurer to
pay said appropriation into the State Treasury.
Voted unanimous 1v that the Town raise and appropriate the sum of
Two Hundred Six and 80/100 ($206.80) under the provisions of Chapter
388, Acts of 1954 amended by Chapter 4133 of 195''), control of Green-
head Fly, and authorize the Town Treasurer to pay said appropriation
into the State Treasury,
ARTICLE. 27. To see if the mown Will assume liability in the
manner provided by Section 29 of Chapter 91 of the General Laws , as
amended by Chapter 516 and 524, Acts of 1950 for all damages that may
be incurred by work to be performed by the Department of Public Works
of Ylssachusetts for the improvement, development, maintenance and
protection of tidal and non.-tidal rivers and streams, harbors, tide-
waters . fpreshores and shores along a public beach outside Boston
Harbor, including the Merrimack and Connecticut Rivers in accordance
with Section 11 of Chapter 91 of the General Laws, and authorize the
Selectmen to execute and deliver a bond, of indenni.ty therefore to the
Commonwealth..
Voted that the Town assume liability in the manner provided by
Section 29 of Chapter 91 of the General Laws , as amended by Chapters
516 and 524, Acts of 1950 for all damages that may be incurred by work
to be performed by the Department of Public Works of Mass, for the
improvement, development, maintenance and protection of tidal and non-
tidal rivers and streams, harbors, tidewaters, foreshores and shores
along a public beach outside Boston Harbor, including the Merrimack and
Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the
General Laws, and authorize the Selectmen to execute and deliver a bond
of indemnity therefore to the Commonwealth.
ARTICLE 28. To see if the7own will vote to authorize and instruct
the Town Treasurer to pay the Dog'Tax returns from the assessments of
1967 to the Brewster Wadies ' Library Association in accordance with
Chapter 140, Section 72.

ARTICLE 29. To see if the Town will vote to transfer from avail-
able funds in the Treasury, the swirl of Five Hundred Dollars 0500-00)

ARTICLE 35. To see if the Town will vote to raise and approp-
riate the sum of One Hundred. Dollars ($100.00) to be expended for
engineering services in a preliminary survey of leo. Bottom Pond for
a proposed conservation area.

ARTICLE 38 . To see if the Town will vote to adopt the follow-
ing by-law: The use of soap or detergent of any type is prohibited
in the waters along the shore lines of all Town. Landings on fresh
water bonds. Any violation of this by-law shall be, subject to a fine
of not less than. Twenty Dollars (820.00) . (B7 request)

Engineers, Eastham, Mass . dated February 12, 1968 on file with the Town
Clerk and to authorize and instruct the Selectmen to take by deed of
gift, the lands within said layout and to act fully thereon.

which was read by Mrs. Alice Fitsch.
Whereas :
The .,contemplated development of oil wells with atterdent
oil rigs and equipment in the waters off our coast could irre-
parably damage the image of Cape Cod, and
WhAreas:
Oil from leaking or bursting gel's or equipment could con-
taminate our bathing and fishing waters, our beaches and our
marches, and
Whereas
These priceless resources must be ?rotected if we are to
maintain our way of life, and
Whereas :
House Bill r#11'Q has been filed in. Congress by CongressmaEm
Hastings Keith and others and. Senate Bill S 205 has. been filed
in the Senate by Senators Edward Kennedy and Edward Brooke
which would prevent the development of of f-shore oil wells until
a study of the feasibility of providing permanent protection for
the area could be made
Therefore, be it resolved:
That the• voters assembled at this Town. Meeting in Brewster
on March 4 , 1968, do hereby record themselves as supporting the
aforementioned House and Senate bills and do hereby instruct the
Town Clerk to send copies of this resolution to Congressman
Hastings Keith and the co-signers of HR 1.1584, to Senators
Edward Kennedy and. Edward Brooke, to Secretary of the Int eri or
Udall, to Governor Volpe and our representatives and Senator to
the Great and Genera2 Court,
