A RESOLUTION FOR APPROVAL TO RELEASE FUNDS TO DEER VIEW ESTATES FOR WATER
AND SANITARY SEWER IMPROVEMENTS
WHEREAS, the City of Tiffin Iowa, An Iowa Municipality (The "City"), paid to IPL Development, LLC and A
lot for Mot, LLC (Deer View Estates), a subdivision within the -corporate limits of Tiffin, Iowa, funds for water
and sanitary sewer improvements on March 23, 2007 in accordance to the Subdivider's Agreement signed by
both parties on September 13, 2006.
WHEREAS, as approved and passed by City'of Tiffin City Council, Resolution 2007-10, dated March 14,
2007, payment for the amounts of $390,000 for sanitary improvements and $45,000 for water improvements
would be paid by City to Deer View Estates minus a 5% retainage resulting in $21,750 still owed to Deer View
Estates.
WHEREAS, on July 11, 2007, Tiffin City Council passed and approved Resolution 2007-34 Approving Final
Plat for Deer View Estates Part One and Resolution 2007-35 Approving and Accepting All Infrastructure
Improvements In Deer View Estates Part One Except Sidewalks.
WHEREAS, Deer View Estates now has presented a request for payment of the $21,750 funds still being
retained by the City, I
THEREFORE BE IT RESOLVED, the City Council has reviewed the request for payment and find no reason
to deny the request for the $21,750 payment by the City to Deer View Estates and such payment will be made
from the Water and Sewer Funds.
On the 14th day of September, 2011 at a regular Tiffin City Council meeting Council person Travis Weipert
introduced Resolution 2011-39 A RESOLUTION FOR APPROVAL TO RELEASE FUNDS TO DEER
VIEW ESTATES FOR WATER,AND SANITARY SEWER IMPROVEMENTS for approval and
seconded by Council person Mike Gericke.
Ayes: Chris Ball, Mike Gericke, MaRK Petersen, Travis' Weipert
Nay: None
Absent: Jim Bartels
THEREUPON with Four votes for City Council approval, Mayor Phillips declared that the Resolution 2011-39
31 A RESOLUTION FOR APPROVAL TO RELEASE FUNDS TO DEER VIEW ESTATES FOR WATER
AND SANITARY SEWER IMPROVEMENTS be adopted and signified his approval of the same by affixing
his signature thereto.
