MEDINA CITY COUNCIL MEETING MINUTES OF MAY 4, 1999
The City Council of Medina, Minnesota met in regular session on May 4, 1999 at 7:30 p.m. in
the City Hall Chambers. Mayor John Ferris presided.
Members present: Ferris, Zietlow, Hamilton, Johnson, and Smith.
Members absent: None.
Also present: Police Chief Ed Belland, Attorney Ron Batty, Public Works Director Jim Dillman,
and City Clerk -Treasurer Paul Robinson.
1. Additions to the Agenda
A. Liquor License for Hamel Athletic Club.
B. Update on Mooney Lake Project.
Moved by John Hamilton, seconded by Phil Zietlow, to approve the agenda as amended.
Motion passed unanimously.
2. Approval of the Minutes from April 14, 1999 Board of Review
Moved by Phil Zietlow, seconded by John Hamilton, to approve the minutes of April 14,1999.
Jim Johnson abstained. Motion passed.
3. Approval of the Minutes from April 20, 1999
Moved by Carolyn Smith, seconded by Phil Zietlow, to approve the minutes as presented. Jim
Johnson abstained. Motion passed.
4. Consent Agenda
A. Resolution 99-30 Granting A Conditional Use Permit To Doug Dickerson.
Moved by Jim Johnson, seconded by Phil Zietlow, to approve the consent agenda. Motion
passed unanimously.
5. Comments from Residents in Attendance on Items Not on the Agenda
Bill Ciora of 915 Sunset Court said he sent the city council and planning commission a petition
from six of the homeowners on the south end of Foxberry Farms who abut the property currently
zoned rural residential yet guided for commercial/industrial. He said all the residents that
abutted the property were concerned about what would potentially happen when that property is
developed. He said they would like the area to remain rural residential or in some residential
zoning. However, if it is to be zoned commercial, they would like to have some significant input
in the process as to what is going to be developed and how.
There was some discussion about this item.
Carolyn Smith said that the planning commission had initially proposed a townhouse type
residential buffer between the commercial area and the residential area, however, at the public
meeting addressing that issue, there was significant opposition to that zoning. However, she
believed that a different type of buffer should be considered in that area.
There was some discussion about deciding what type of buffer could be available. There was
talk about increased setbacks between the urban commercial and urban industrial and
residential districts.

John Ferris thanked Mr. Ciora for his petition and said that when this property is up for rezoning
the citizens in that area will be notified.
6. Park Commission Comments
Jim Dillman said he was not able to hire a summer employee and went out for bids for
contracted service to take care of the lawn mowing in the city for parks and public areas. He
said that he received two bids; one from Neil Wolfe for $400.00 and the other from Steve
Hammerschmidt for $420.00. This bid was for mowing all the parks except for Hamel Legion
Park.
7. Planning Commission Comments
Paul Robinson said the planning commission set the Comprehensive Plan public hearing for
Tuesday night, June 22. He said that there will be an open house from 5 to 8 p.m. to speak with
staff and commission members, and at 8 p.m. the public hearing would begin.
8. Reserve Policy
Ed Selland said that he got together policies from other reserve programs in the area and
created a policy for the city.
Phil Zietlow had a question about the hiring practice.
Ed Belland said that he thought reserves needed to be considered employees to be covered
under workers compensation. However, he said staff would look into this issue further.
He said they had budgeted $3,000 for the program which would outfit between five to seven
reserves. He said that at the chief's convention a number of the chiefs had mentioned problems
with transporting people to jail. He said that reserves could provide some of this service. He
said that they could work jointly with Orono, West Hennepin and other communities in the area
to have one reserve designated each evening for transporting people to jail.
Phil Zietlow said that the policy looked good.
There was some discussion about the required age.
Ed Belland said that initially they were going to require that the age be 21, however, they
dropped it to 19 in order to bring in enough people into the program.
9. Approval of the Liquor License for the Hamel Athletic Association
Moved by Carolyn Smith, seconded by Jim Johnson, to approve the liquor license for Hamel
Athletic Association. Motion passed unanimously.
10. 1999 Road Projects
Jim Dillman said there will not be enough money in the budget to do both the Willow Drive and
Chippewa Road projects. He said if the council would like both of these projects done this year
they would need to allocate an additional $100,000. He wanted to know what the city council
would like to do.
Paul Robinson said that last year the city council reserved 150,000 from the previous year's
budget surplus. He said the council could use that money to finance these road projects.

Phil Zietlow said that there would probably be a lot more discussion on this issue if the city.did
not have the money to pay for it. However, since we do, he was okay with using the designated
fund balance.
The consensus of the council was to use the designated council fund balance from the 1997
budget surplus.
12. Clean Up Day
Jim Dillman said that there was a tremendous amount of volunteers and that the tree program
went very well.
Phil Zietlow said that it seems to keep getting bigger.
Carolyn Smith said that a lot more waste could have been pulled out of the dumpsters and
recycled in other ways, given to Goodwill, for example.
Jim Dillman said that next year Carolyn Smith could organize a Goodwill collection and recycling
and reuse collection as a part of clean up day.
13. Cabin Social
Jim Dillman said the cabin social is set for June 17. He said that the city clerk thought it would
be good to have a motion authorizing the fireworks display.
Moved by Carolyn Smith, seconded by Jim Johnson, to authorize the fireworks display for the
cabin social event on June 17, 1999. Motion passed unanimously.
Jim Dillman said that a majority of the money for this cabin has come from private donations.
He wanted to know if the city would like to participate in funding a portion of this event. He said
a $1,000 from the city would be good to help pay for the cost of the event which will be around
$6,000.
Moved by Carolyn Smith, seconded by John Ferris to authorize up to $1,000 for the event. This
money is not meant to finance the fireworks display. Motion passed unanimously.
14. Update on Mooney Lake
Phil Zietlow said that the Minnehaha Creek Watershed District had Bonestroo, Rosene,
Anderlik, and Associates conduct a study on the impact of the rising water level and how to
correct that problem. There were a number of solutions initially proposed. They have been
concentrating on the one solution which would include pumping a certain amount of water out of
the lake each year. This would cost around $200,000 and also include $ 2,000 a year in
operating costs.
Phil Zietlow said that their initial proposal would allocate around 28% of the cost to Medina,
even though Medina has only five homes on the lake.
There was some additional discussion.
Phil Zietlow said that he is comfortable with a cost allocation method that would either distribute
the cost based on the amount of hardcover that contributed runoff to the lake or on the number
of homes that benefit from the project.
The consensus of the council was to either use the amount of hardcover or the number of
homes located in the lakes drainage area.

15. Transfer from the Water Fund to the Water Capital Improvement Fund
Moved by Phil Zietlow, seconded by John Hamilton, to approve transfer of $183,232.00 from
fund 601 to fund 402. Motion passed unanimously.
16. Chamber Event
Paul Robinson said that each year the city has participated in this golf outing. He said that Phil
Zietlow requested that it be placed on the agenda for discussion.
John Ferris said that he has participated each year. He believes it is a good event for the city to
take part in.
Phil Zietlow said that it was important to raise this issue at the council meeting and that the
council vote to participate in this event as a city function.
Moved by Phil Zietlow, seconded by John Ferris, to approve taking part in the chamber golf
outing event. Motion passed unanimously.
17. Request for Time Extension for Administrative Intern
Paul Robinson said this week is Judd Harper's last week as an intern for Medina. He said he
would like to keep Judd for an additional 80 hours to work specifically on the Tax Increment
Financing report documentation.
John Ferris explained the problem with completing the TIF reports.
Moved by Jim Johnson, seconded by Carolyn Smith, to approve the request for an additional 80
hours for the administrative intern. Motion passed unanimously.
18. Approval of the Bills
Moved by Jim Johnson, seconded by John Hamilton, to approve the bills, order check numbers
19629-19661 for $102,540.01, and payroll check numbers 16083-16103 for $15,300.66.
Motion passed unanimously.
Phil Zietlow said that 50% of the total amount of the bills was going to Metropolitan Council.
19. Executive Session
Moved by Carolyn Smith, seconded by John Ferris, to close the regular meeting to go into
executive session to discuss potential litigation matters. Motion passed unanimously.
Moved by Jim Johnson, seconded by Phil Zietlow, to reconvene the regular meeting and close
the executive session. Motion passed unanimously.
20. Adjournment
Moved by Jim Johnson, seconded by Phil Zietlow, to adjourn the eeting at 8:30 p.m. Motion
passed unanimously.
