Wow, its sure been a great summer! [hope the weather stays warm for a couple more months
and that the politics stay cool: the former probably has more chance than the latter. . .
workshop
Maryvale will be here Wednesday for ajoint workshop with the Planning Commission. They're
looking for a final "nod" on their new PDD Plan. Once the big picture is clear, work on the final
details wiII madly commence. We'll meet in the gym at 6:00. No supper will be served.
open forum
Bob Caravano will address you on a proposed in-line hockey facility that a non-profit group is
attempting to build at the Sports Complex. See the enclosed letter -- its marked "draft" as it's
pending review by Conner Shepherd and Cyndy Flores.
Catherine Ross will also drop-by to give the Chamber update.
There are no action items scheduled for this meeting.
discussion items
We'll complete (or begin) our discussion on how we want to proceed with the Cemetery
Association on P A 28. Enclosed is a letter from Ross Libenson related to the same. It is my
suggestion that the Cemetery Association pay for the survey and plat preparation that identifies
the view corridor and existing Cemetery access, and that we deed restrict development in these.
areas -- either by identifying them as "no-growth" areas or restricted height zones. Regarding
housing that we may build on the parcel, it is too early to commit to any restrictions or plans.
Finally, Liz asked that the Headwaters Trails association be placed as an agenda item.
During staff choice I'd like to clarify an issue related to our purchase & delivery options for our
Clinton water and r d like to provide an update on the water project, among other things. . .

MARYV ALE MASTER PLAN
Necessary Components For Major Density Reductions
1. Cui de sac distances, flag lot distances, and divided roads considered as dual access in
Planning Areas 9W, lOW, 11W, and l2W.
Note: This was previously considered and approved by the Fraser Town Board at a
past Board meeting.
2. Maryvale LLC to dedicate land for right-of-way and cooperate fully on the future
Leland Creek railroad underpass.
3. Fraser will help facilitate Maryvale LLC's efforts in securing legal access to Kings
Crossing Road from Planning Areas 11 Wand l2W.

4. Planning Areas IE through 8 0 be approved, at a minimum, for well & septic service.
All regulations and requirements governing well & septic service will be adhered to. This
approval is necessary to make the density reductions specifically in these Planning Areas.
5. The Town of Fraser to rebate 1.4% of the total sales tax levy (or 35% of all sales tax
received by Fraser from a business located on the Maryvale property). This rebate will be
used only for infrastructure cost reimbursement, including interest. Maryvale LLC will
work with the Town of Fraser in analyzing commercial revenue projections to determine
the effect of said rebate on Town services within Maryvale. The rebate will be discontinued
upon the payoff of all infrastructure costs, including interest.
5. Maryvale LLC will deed adequate water to Fraser to serve the Maryvale development,
including the proposed golf course. Fraser, in return, will supply the Maryvale
development with water, including the proposed golf course. Calculations for water usage
shall be based on the SFE definitions included in the current water augmentation plan and
annexation agreement. Fraser will also allow Maryvale to suggest increases in tap fees over
the then current rates for Maryvale developments, and these increased portions may be
used for any portion of infrastructure cost reimbursement, including interest.
6. Chip and seal will be allowed on any road within Maryvale except the main access ways.
Main access ways are Fraser Parkway, Village Center Drive between Planning Areas lW
and 4W, and east of Highway 40 to the beginning of Planning Area 9E. Also, any other
roads serving a commercial area must meet Fraser asphalt roadway standards.

The reg41ar meeting of July 16, 1997 was called to order at 7:30 p.m. Board present were
Mayor J~hnston, Havens, Wirsing, Klancke, Sanders, Swatzell and McIntyre. Staff
present Were Reid, Skelton and Winter.

Maryvale'will be at the Aug, 6th meeting to continue discussions on a new POD filing.
Johnston commented he wants the Town to workhard on getting policies for affordable
housing and employee housing.

8:00 p.m. Continued hearing for the conside.'ation of adoption of the 1997 URC and
related documents.
Mayor Johnston called the continued hearing to order. The Board was advised that
Grand County has adopted the UBC and relatcd documcnts including amendments, the
Town may now proceed with the consideration tor adoption.
The Courtty has satisfied the concerns that the public had concerning the house log
grading requirements.
No public comment.
McIntyre moved to close the public hearing, 2nd Havens, carried.
McIntyre moved to adopt Ordinance #235 regarding the ] 997 UBC and related Codes,
motion 2nd by Swatzell.
STAFF CHOICE
Skelton asked for input from the Board on any changes to the Subdivision regulation
regarding Pathways/trails and Road requirements.
Staff is still working on affordable Housing language that will be added to the subdivision
regs. Needs in Maryvale will be address at the new POD submittals.
Sanders gave an update on the growth planning committee meeting. It remains to be seen
if any recommendation can be included in the subdivision regulations.
The Board viewed a video that was shown at the CML conference that included Fraser.
No further business, meeting adjourned at 9:30 p.m.

TIlank YPlt for taking the time to meet with the Cemetery Board Members to con-
sider the issues of the en.trance, view corridor, and natural screening with respect to
Platming An~a i28. Based upon our meeting, we understand that the Town is cunently
in agreement with respect to the entrance and view corridors. Regarding the entrance,
the Town will convey a,n interest to the cemetery, either expressly or impliedly, which
results in the access from County Road 72 to the cemetery beingfof the exdusive use of
the cemetery.
With respect to the view corridor, tilE" Town Board was in agreement with the
area which we had flagged off in advance of the meeting. We understand the view cor-
ridor will be conveyed- to the Cemetery Association by an easement prohibiting build-
ing on the upper a.rea within the corridor and restricting building height within the
view corridor on. the lower level of Plarming Area 28. Of course, we are available if you
need assistance with drafting the instruments of conveyance.
Finally, :with respect to the na.tural screening issues and the change of the current
use, if any, of the upper area of Plamting Al'ca 28, there appears to be a need for further
reflection or di~cussion among the town trustees, themselves. Obviously, we want to be

available for C0111ment on those. While we understand your concerns with fespect to
employee housing, it doE'S remain our first choke that the entire upper area of Planning
Area 28 be left undeveloped. Therefore, while I realize there are different current vi-
sions as to what development if any, should occur on the upper area, please confer
with me in writing as to the nu.n1ber of units and density that you, as Town Manager,
are contemplating or suggesting to the Trustees. You mentioned this at the meeting,
but I did not write it down.
I look forward to being advised of the resolutions which may come from the
Town as a result of our meeting. We do want to proceed with surveying before the
change of seasons. I am concerned that it may take some lead time to schedule that.

Dear Mr. Reid:
The Division has reviewed the desktop evaluation and the plans
and specifications for the pump station modifications. The
proposal is to add lime and aeration to control the corrosion of
lead in t~e distribution system and reduce the radon
concentration, respectively. The Division concurs with the
recommendations proposed and the report is approved. In
addition, I the plans are approved with the condition that the
clearwellioverflow pipe design be modified to prevent the
entrance ~f any insects or rodents storm sewer.
After theiequipment has been installed please provide the
following: ( 1) a letter, to the Division, certifying the
installation and operability of the equipment, and (2) comply
with the following monitoring to verify the effectiveness of the
lime trea1j:ment.
1. Lead and copper samples must be collected in the
dist~ibution system at the original 20 sites in two, six
month monitoring periods.
2. Alka~inity and pH samples must be collected at the entry
point: to the distribution system biweekly until the action
level for lead is met.

period.
The first six-month monitoring period will begin after the
Division has received a letter certify the improvements were
built in accordance with the approved plans and the equipment is
operational.
After the two consecutive periods of monitoring, if the samples
are in compliance with the action levels, a request may be made
to the Division for a reduction in the number of samples to be
collected.
In additipn, until the action level for lead is met, public
education! must be performed in accordance with 40 CFR, 141.83 and
141.88. The Town must submit a letter to the Division certifying
the public education requirements have been accomplished in
accordanc~ with the regulations. The letter must be received by
the Divislon no later than December 31, each year, until the
water system is in compliance with the lead action level.
Approval pf this project is based only on engineering design to
provide s~f~ potable water, as required by the Colorado Primary
Drinking Water Regulations and in no way will influence the local
building tlepartment or the local health department decisions on
this project.
