A RESOLUTION A TO SET PUBLIC HEARING
FOR THE POSSIBLE FUTURE CONVEYANCE OF CITY OWNED LAND ADJACENT TO THE
WOODFIELD RIDGE STORM WATER RENTENTION POND
WHEREAS, the City of Tiffin Iowa, An Iowa Municipality (The "City"), received, as a condition of the Final
Plat acceptance of the Woodfield Ridge Part One, Outlot "B" from Woodfield Ridge Estates Development by
City per revised Developers Agreement dated June 20, 2007. Outlot "B" is a DNR required storm water
retention pond.
WHEREAS, the homeowners adjacent to the retention pond, have now requested the city to convey areas
surrounding the pond to individual homeowners for an agreed upon fair market value for the auditor's parcels.
WHEREAS, the City Council has requested the City Engineer and the City Attorney to proceed with
preparing legal descriptions and auditor's parcels and facilitating all legal documentation necessary for any
public owned land conveyances in accordance to Iowa Code Chapter 354.
WHEREAS, the City Council, after`holding a properly noticed public hearing on the issue; the City Council
may desire to make a decision to convey the properties as detailed on. Attachment "A".
AND WHEREAS, Notification to the Public will be published and posted as required in accordance to Iowa
Code. And affected landowners will be notified of Hearing.
THEREFORE, the City Council will hold a Public Hearing for comments for or against the possible
conveyance of city owned land to private landowners on the 12th day, of October, 2011 at 6:30pm at the
Springmier-Library located on the north end of the CCA Middle School.
WHEREUPON, on the 14th day of September, 2011 at a regular City Council meeting of the City Council, Tiffin,
Iowa, Council person Chris Balli introduced Resolution 2011-38 for approval A RESOLUTION TO SET
PUBLIC HEARING FOR THE POSSIBLE FUTURE CONVEYANCE OF CITY OWNED LAND ADJACENT
TO THE WOODFIELD RIDGE STORM WATER RENTENTION POND and seconded by Council person
Travis Weipert.
Ayes: Chris Ball, Mike Gericke, Mark Petersen, Travis Weipert
Nay: None
Absent: Jim Bartels
With Four votes for City Council approval, Mayor Phillips declared that the Resolution 2011-38 A
RESOLUTION TO SET PUBLIC HEARING FOR THE POSSIBLE FUTURE CONVEYANCE OF CITY
OWNED LAND ADJACENT TO THE WOODFIELD RIDGE STORM WATER RENTENTION POND be
adopted and signified his approval of the same by affixing his signature thereto.
Passed and approved this 14th day of September 2011.
