ORDINANCE NO. 50-2011 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES PERTAINING TO THE RETAIL DISTRIBUTION OF ALCOHOLIC AND MALT BEVERAGES, WINES AND DISTILLED SPIRITS ON SUNDAYS FOR THE
CITY OF TYBEE ISLAND, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution
of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of the citizens of Tybee Island, Georgia, and WHEREAS, the duly elected
governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and WHEREAS, the governing authority desires to adopt this ordinance under its police, zoning,
and home rule powers, and WHEREAS, the City of Tybee Island desires to amend the Code so as to adopt a new section pertaining to the retail distribution of malt beverages, wines and
distilled spirits on Sundays between the hours and 12:30 p.m. and 11:30 p.m. and to establish an effective date; and WHEREAS an election is scheduled to be conducted on November 8, 2011
and the ballot contains a referendum question pertaining to authorizing the sale of malt beverages, wines and distilled spirits at certain times on Sundays; and WHEREAS, the Mayor and
Council of the City of Tybee Island desire to adopt an amendment to the Code of Ordinances, Chapter 6, so as to establish a new Article IV relating to retail sales of packaged beverages
on Sundays; and WHEREAS, in the event the referendum establishes that the majority of voters approve the sale of such beverages by retailers between the hours of 12:30 p.m. and 11:30
p.m. on Sundays, NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee Island that a new Article IV in Chapter 6 of the Code of Ordinances is hereby adopted
and shall provide as follows:
Article IV. Sunday Retail Sales of Packaged Beverages. Properly licensed retailers of malt beverages, wine and distilled spirits are authorized to engage in and conduct sales of malt
beverages, wine and distilled spirits on Sundays between the hours of 12:30 p.m. and 11:30 p.m. This Ordinance shall become effective on ________ day of __________________, 2011. ADOPTED
