A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
SUPERSEDING PRIOR ACTIONS RELATIVE TO THE OBSERVANCE
OF DECEMBER 22, 2005 AND DECEMBER 29, 2005 AS HOLIDAYS IN
THE CITY CALENDAR, VALIDATING ALL PRIOR ACTIONS
CONCERNING THE SAME AND RATIFYING INFORMALLY
DECLARED COUNCIL INTENTIONS RELATIVE TO THE
OBSERVANCE OF THE ADDITIONAL DAYS OF CLOSURE OF CITY
HALL
WHEREAS, the City of Lynwood has granted its employees the days of
December 22ntl and December 29"' 2005 as paid holidays for the reasons set forth
below; and
WHEREAS, offering and providing competitive salaries and benefits, including
paid holidays; to employees increases the City's retention rate of qualified employees
as well as its ability to attract new employees; and
WHEREAS, retaining qualified and experienced employees provides a public
benefit by improving City services and enhancing the quality of life of the residents of
the City of Lynwood; and
WHEREAS, the City Council ("Council") continuously reviews the level of
employee turnover and the accompanying costs associated with turnover; and
WHEREAS, the action taken by the City is part of an effort to ensure the
continued recruitment and retention of qualified and competent City employees, to
provide a more positive framework for the continued dialogue with employee bargaining
units, and to reduce the potential for disputes and uncertainties about the good faith
efforts of the City to make changes where appropriate to job classifications and
compensation; and
~I WHEREAS, in light of the ongoing process to complete the review and
adjustment for classification and compensation, the informal manifestation of the
Council's intent to provide two additional days off during the 2005 holiday season, when
the impact on the provision of City services is minimal, must be superseded and ratified
by formal action of the Council; and
WHEREAS, it is a generally recognized rule that a governmental body may
effectively ratify what it could have theretofore have lawfully authorized, and it is the
Council's objective to so ratify the prior manifestation of Council's intent in the manner
set forth herein.
NOW, THEREFORE, THE LYNWOOD CITY COUNCIL DOES HEREBY RESOLVE
AND DETERMINE AS FOLLOWS:
Section 1. The above recitals shall be incorporated into this resolution as formal
findings of the City Council.
Section 2. City Hall and other City facilities shall be closed on December 22,
2005 and December 29, 2005.
Section 3. Those employees that are compensated for Christmas Day pursuant
~ to City practices or pursuant to the Memorandum of Understanding or other provision
shall be compensated for December 22, 2005.
Section 4. Those employees that are compensated for New Year's Day pursuant
to City practices or pursuant to the Memorandum of Understanding or other provision
shall be compensated for December 29, 2005.
Section 5. This resolution shall become effective immediately upon its
adoption.
PASSED. APPROVED AND ADOPTED this 3`d Day of January 2006.
