Commissioner Taylor moved, and Commissioner Smith seconded the motion to
approve the Agenda. Motion carried: 6-0.

a. PC Resolution 2015-07-01 Recommending Denial of the Application for a Use by
Special Review for the Byers Wastewater Treatment Facility

Commissioner Smith moved, and Commissioner Sumrall seconded the motion to
approve PC Resolution 2015-07-01 Recommending Denial of the Application for a Use
by Special Review for the Byers Wastewater Treatment Facility. Motion carried: 6-0.
b. Major Subdivision Final Plan & Preliminary Plat The Meadows at Grand Park
Planning Area 3WC.1 Grand Park PDD
Commissioner Smith moved, and Commissioner Young seconded the motion to open
the public hearing on Major Subdivision Final Plan & Preliminary Plat the Meadows at
Grand Park Planning Area 3WC.1 Grand Park PDD. Motion carried: 6-0.
Proof of publication, notification of adjacent property owners and the mineral rights were
entered into record.

Clark Lipscomb, representing Grand Park, briefed the Board regarding the Meadows at
Grand Park.
Planning Area 3WC, approximately 12 acres, is located between US 40, Old Victory
Road and the Cozens Meadow.
The entitlements in the PDD for PA 3WC allow for 60 attached residential units with an
average density of 5.2 units per acre and 70,000 SF of commercial. The approved
development standards allow for mixed use and require 10% open space and a 45'
maximum building height. Required setbacks in PA 3WC are 0' in the front yard, 0' in
the side yard and 10' in the rear yard, and 20' improvement and 20' building setback
from US40.
The applicant is proposing 30 single-family lots to be platted and constructed in three (3)
phases accessed by a public road with a sidewalk on one side of the road. There is a
secondary access shown on the documents listed as "private street." This private street
is proposed to provide a loop and secondary access to the parcel, connecting Old
Victory Road across for Elk Ranch Road (Elk Creek at Grand Park subdivision).
Trustee Sumrall requested a letter of approval for the access road from the East Grand
Fire District.
Pending any additional comments from the public hearing and if the Planning
Commission decides to recommend approval of the Preliminary Plat and Final Plan for
The Meadows at Grand Park, staff would recommend the following conditions at a
minimum:
1. Revise documents to respond to staff comments, including Town Attorney and Town
Engineer.
2. All Town Attorney comments pursuant to the Annexation Agreement shall be
forwarded to the Town Board for review and consideration.
Commissioner Sumrall moved, and Commissioner Taylor seconded the motion to close
the public hearing on Major Subdivision Final Plan & Preliminary Plat the Meadows at
Grand Park Planning Area 3WC.1 Grand Park PDD. Motion carried: 6-0.
Commissioner Smith moved, and Commissioner Taylor seconded the motion approve
Resolution 2015-07-2-02 A Resolution Recommending Approval Of The Meadows -
Final Planned Development Plan (FPDP) And Preliminary Plat Planning Area 3wc.1
Grand Park Planned Development District, Located In Section 20, Township 1 South,
Range 75, West of the 6th Pm County Of Grand, State Of Colorado. Motion carried: 6-
0.
c. Development Permit/Final Plan North Retail at Grand Park Planning Areas
4W.1A & 4W.1B Grand Park PDD Meyer Lot 1, Block 1 Meyer Lot 2, Block 1

the public hearing on a Development Permit/Final Plan North Retail at Grand Park
Planning Areas 4W.1A & 4W.1B Grand Park PDD Meyer Lot 1, Block 1 Meyer Lot 2,
Block 1. Motion carried: 6-0.

Proof of publication, notification of adjacent property owners and the mineral rights were
entered into record.
The applicant has included a "parking requirement variance request" in the submittal
material. Staff inadvertently did not public notice for this. This is a variance to the
zoning code and would require a variance hearing in front of the Board of Adjustment.
The Planning Commission now also acts as the Board of Adjustment, however, a
separate public hearing and notification is required. In addition, the process as outlined
in the Municipal Code has not been followed and as submitted, there is no basis for the
request. Staff has suggested options to the applicant to use some of the incentives
mentioned above to see if there might be a viable solution without asking for a variance.
Clark Lipscomb, representing Grand Park addressed the Commission regarding the
proposed plan.
Trustee Sumrall expressed his concern of not having a traffic control plan, referencing a
connection to Old Victory Road.
The PDD land use and development notes indicate the following:
4W is approximately 11.2 acres situated along Old Victory Road, south of the Fraser
Valley Center, adjacent to the 5-acre in holding parcel and adjoining the Elk Creek
meadow. Planned for commercial site planning considerations include its relationship to
Old Victory Road.
The entitlements in the PDD for PA 4W allow for 100 attached residential units with an
average density of 9.3 units per acre and 105,800 SF of commercial. The approved
development standards allow for mixed use and require 10% open space and a 45'
maximum building height. Required setbacks in PA 4W are 10' in the front yard, 6' in the
side yard and 10' in the rear yard, and 20' improvement and 20' building setback from
Old Victory Road.
Staff has reviewed the submittal and found the submittal to be lacking for the following
reasons:
1. The site data breakdown chart on sheet 3 of 14 doesn't match the site plan.
2. The parcels are not labeled correctly.
3. The title suggests that 4W.1A is part of this proposal and yet that is included in the Elk
Creek Final Plan.
4. The future development 5W.1 parcel, labeled as such on sheet 3 of 14, has now been
included in the Elk Creek 5W Final Plan (as attainable housing lots).
5. The utility layouts are unclear are not consistent with the Elk Creek plans.
6. The drainage plan does not meet the requirements specified in the Municipal Code.
John's Drive can't handle any additional drainage flows.
7. In 2005, the applicant processed the Meyer Subdivision and entered into a
Subdivision Improvement Agreement (SIA and plat in packet) for certain improvements
associated with these lots. Such improvements are not incorporated into this
development proposal.
8. There was much talk about the road connection between CR 72 and Old Victory Road
in conjunction with the Elk Creek subdivision. Perhaps this can be accomplished here;
however additional ROW is needed.

9. The exterior material package as submitted is inadequate.
10. Delete Pad 2A and 2B or provide additional information on the same.
For the above referenced reasons, staff asked the applicant to not proceed with the
public hearing; however the applicant insisted on being on the July 22, 2015 agenda.
Due to the need of the Board of Adjustments to hear the parking requirement variance
request it is recommended this hearing be continued until after the BOA meets regarding
this variance request.
Staff recommends that the applicant address the outstanding issues as outlined above
and in the Attorney and Engineer review memos and resubmit the application. Staff will
continue to work with the applicant.
Commissioner Smith moved, and Commissioner Young seconded the motion to the
motion to close the public hearing on a Development Permit/Final Plan North Retail at
Grand Park Planning Areas 4W.1A & 4W.1B Grand Park PDD Meyer Lot 1, Block 1
Meyer Lot 2, Block 1. Motion carried: 6-0.
Commissioner Smith moved, and Commissioner Taylor seconded the motion to amend
the motion to continue the public hearing on a Development Permit/Final Plan North
Retail at Grand Park Planning Areas 4W.1A & 4W.1B Grand Park PDD Meyer Lot 1,
Block 1 Meyer Lot 2, Block 1. Motion carried: 6-0.
