HomeMy Public PortalAbout2008 Agreement Concerning Improvements for Greenwood Drive.tifRESOLUTION NO. 2008-13 A CAPITAL PROJECT AUTHORIZING RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, CONCERNING THE CONSTRUCTION OF TRAFFIC CALMING SPEEDTABLE IMPROVEMENTS FOR GREENWOOD DRIVE (THE "PROJECT"); AWARDING PROJECT CONSTRUCTION WORK TO MIGUEL LOPEZ, JR. INC., (THE "CONTRACTOR"); AUTHORIZING VILLAGE MANAGER TO ACCEPT THE PROPOSAL FOR THE PROJECT; AUTHORIZING EXPENDITURE OF FUNDS; AUTHORIZING IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village Council, upon the recommendation of the Village Manager, desires to construct traffic calming speedtable improvements for Greenwood Drive from Harbor Court to Hampton Lane (the "Project") as described in the plans (the" Plans") prepared by CORZO CASTELLA CARBALLO THOMPSON SALMAN, P.A. ("C3TS") (the "Village's Project Engineer") pursuant to the lowest responsible, responsive proposal (the " Proposal") in the amount of $14,096, as received from Miguel Lopez, Jr., Inc., (the "Contractor") pursuant to informal proposal solicitations for the Project ; and WHEREAS, the Village Council hereby waives further formal competitive bidding pursuant to Village Code Section 2-85, upon finding that the need to expeditiously implement the improvements makes formal competitive bidding impractical; and WHEREAS, the Village Council finds that the Project is necessary for the enhancement of traffic safety and is in the best interests of the Village. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted and confirmed. Section 2. Capital Project Authorizing Resolution. That pursuant to Village Charter Section 3.07(b), this Resolution shall constitute a Capital Project Authorizing Resolution. The Capital Project is the construction of the above described improvements of the Project at a total cost of not to exceed Twenty Thousand ($20,000) Dollars. Section 3. Project Authorized; Proposal Approved; A. That the Project is hereby authorized. The Project is further described in the Proposal and in the Plans . B. That the Village Council hereby authorizes the Village Manager to provide for the construction of the Project for a cost which is consistent with the Proposal and with this Resolution, to be funded from the funding source which is identified in the Village Manager's memorandum which accompanies this Resolution. To the extent that the total expenditure amount authorized in this Resolution exceeds the amount of the Proposal, the Village Manager is authorized to expend Village funds for the Project up to the total amount authorized herein, so that any necessary work items may be added to the Project , up to the total dollar amount which is authorized in Section 2 of this Resolution. C. That the Village Manager is hereby authorized to accept the Proposal for the work of the Contractor in substantially the form which is attached hereto, once approved by the Village Attorney as to form and legal sufficiency. D. That the Village Manager is authorized to expend Village funds for the accomplishment of the Project in accordance with Village budget appropriations and this Resolution. 2 E. That the Village Manager is authorized to take any action which is necessary to implement the Project, including, but not limited to, arranging for the provision of inspection of the Project work . BACKGROUND During the 2007 budget process, a petition was submitted to Council by the majority of the home owners on Greenwood Drive, requesting traffic calming devices for their street. Three estimates were delivered to the Department of Public Works. The awarded party will be responsible for all labor, material, equipment, and incidentals necessary for the construction of the contract items indicated by the plans. The funding for this project was set aside during the budgeting process in 2007, under Capital Improvements. cc: Randy White, Village Finance Director David M.
