HomeMy Public PortalAbout2006-024 (02-21-06)RESOLUTION NO. ~nnF roa RESOLUTION TO AUTHORIZE THE MAYOR TO EXECUTE A MODIFIED CONTRACTUAL AGREEMENT WITH THE LEGAL FIRM OF BELTRAN AND MEDINA, FOR THE CITY ATTORNEY SERVICES, AT A MONTHLY AMOUNT OF NOT-TO-EXCEED $35,000 EXCLUDING OUT-OF-POCKET EXPENSES WHEREAS, the City Council of the City of Lynwood desires to receive r legal counsel services that are professional, high-quality but also cost-effective; and WHEREAS, the City Council directed the City Manager to review the scope of work performed by the legal firm of Beltran and Medina in their capacity as the City Attorney, the billing rates of the firm, and the ongoing costs incurred by the City to receive these services, and to recommend actions to contain the costs while receiving the high quality legal services needed by the City; and WHEREAS, the City Manager reviewed the monthly billing statements of Beltran and Medina related to their provision of legal support services to the City, compared the billing rates to those in other comparable cities, and segregated the litigation work from other legal services; and WHEREAS, the City Manager negotiated the monthly spending threshold with the legal firm of Beltran and Medina, and presented the spending cap recommendation to the City Council on February 7, 2006; and WHEREAS, the City Council authorized the City Manager to develop a modified contractual arrangement with Beltran and Medina to provide the City Attorney services at the monthly cost of not to exceed $35,000 excluding out-of- pocket expenses; and NOW, THEREFORE, the City Council hereby finds, determines, and resolves as follows: Section 1. That the modified contractual agreement with Beltran and Medina, attached herein and made a part of this resolution through this reference, be approved. Section 2. That the contractual engagement be on a month-to-month basis, with the following monthly spending caps: $35,000 for non-litigation services, and $5,000 for out-of-pocket expenses, as detailed in the attached contractual agreement. Section 3. That the Mayor is authorized to execute a modified contractual agreement with Beltran and Medina, per the attached contract. Section 4.
