Present: Mayor, Thomas Anderson; Councilmembers, William Reiser, Wilfred Scherer, Sarah Lutz, Thomas Crosby (7:32 P.M.); Clerk Treasurer, Donna Roehl (7:31 P.M.) Planning and Zoning Administrator, JoEllen Harr (7:31 P.M.) Police Chief, Charles Hoover; Engineer, Dave Hansing; Attorney, Richard Schieffer; Building Inspector, Loren Kohnen 1. MINUTES OF APRIL 21, 1981 Motion by Reiser, seconded by Lutz to approve minutes of April 21, 1981, as presented. Motion declared carried it r� n_ C l 2. POLICE DEPARTMENT Repair of 1978 Pontiac Chief Hoover reported that the following repairs were needed on the 1978 Pontiac: Replacement of oil pump, main bearings and rod bearings, at a cost of $500 — $600 by Loretto Towing and Repair. Motion by Reiser, seconded by Lutz to authorize Loretto Towing to make the necessary repairs at a cost of $500 — $600. Motion declared carried Power Boat Races Barney Glaefke, representing the Minnesota Power Boat Race Association, presented noise comparisons of the Association power boats with noise generated by other boats. He stated that during the races they run no closer than 300 ft. to shore. Bob Hebzinski a resident of the Independence Beach area stated that boats are apparently practicing weeks before the race making a great deal of noise. Thomas Anderson stated that the organization should be policing itself as well as other racing boats that are not members of the club. David Pfeffer, another resident of the area expressed a similar concern. Thomas Crosby stated that to his knowledge the City Council had not received complaints in prior years. Motion by Crosby, seconded by Lutz to approve the Minnesota Power Boat Race Association's holding races on September 12, 1981, at Lake Independence, according to plans submitted; that all participants are tobe notified of the complaints regarding noise; that the City Council members and Police Officers shall observe the races on September 12th and pending the outcome of this year's race the city may not give its approval in subsequent years. Motion declared carried Mayor Anderson asked that residents voice any complaints they may have immediately after this years race. Police Officer Chief Hoover introduced Mark Raskop as an applicant for part time police Council discussed the need to limit the hours worked to 14 hors per week membership in the police bargaining unit. Discussion of training needed, that employee could carry a gun and write discussion of starting pay, probation period and uniform allowance. Motion by Reiser, seconded by Scherer to hire•Mark Raskop as a part time police officer on a one year probation period, that he is to work no more than 14 hours per week, that he shall be paid a full uniform allowance, and that starting pay shall be $7.00 per hour. Motion declared carried 3. PUBLIC WORKS DEPARTMENT Hamel Sidewalks The following bids had been received and sidewalk improvements in Hamel: Advanced Construction $26,661.50 J.W. Hanson Construction 20,914.75 Redstone Construction 24,263.50 work. or less to avoid tickets. Also tabulated on April 30, 1981 at 2:00 P.M. for Victor Carlson F.A. Kelly Francis Schmidt $ 15,912.65 22,333.00 31,028.50 Dave Hansing recommended that Victor Carlson be awarded the bid as he is known to do good work and that he would want to begin immediately. Motion by Reiser, seconded by Lutz to adopt Resolution 81-13, approving plans and specif- ications, advertizing for bids and accepting bids for improvements of sidewalks in the Hamel area. Motion declared carried Medina Morningside, Sewer Improvement Public Hearing, 8:00 P.M. Richard Schieffer explained that the Public Hearing had been called due to the fact that more than a year had elapsed since the last public hearing in February of 1980, that bids had not been let on the project and that State Statute requires another public hearing before proceeding further. Dave Hansing reported that the plans had been completed and forwarded to PCA for approval which is expected sometime in May. The project could then be bid in June. He stated that the grants that have been approved will pay a portion of the sewer. and street work but will_not pay f.or curb and gutter•nor storm sewer. He also reported that estimates remain the same as in 1980, that is, $7500 per lot, not including the water system; Financial Consultant, Phil Chenoweth, of Ehler's and Asociates, presented estimates for an amoritization schedule for retirement of bonds based on a 10 year and 15 year program. Costs per year for 10 years at 10.5% interest on $7500 would be $1246.93 and a 15 year issue would cost $1071.93 per year at approximately 11.5% interest on the same amount. He also presented some figures for payment of the water system which will not be included in the bond program. Al Gongaware, 2705 Bobolink: Will we be supporting drainage to the north, and if so, why? Richard Schieffer stated that a storm sewer -project will draw some water from a peripheral area and that it is usually difficult to see any benefit from a storm sewer system. Dave Hansing reported that in a survey of the area residents all felt that. there was a storm water problem in the entire area. Larry Rhiel; 2542 Morningside Rd.: Will I have to pay for a third pipe system if I do not have a problem nor a drain tile around my house? Dave Hansing explained that such requests should be made at an assessment hearing. Doug Sorenson, 2645:Morningside Rd.: How wide will Morningside Rd. be and will sod and driveway entrances be restored? Dave Hansing reported that streets will be restored to. 26wide and all yards and driveways will be restored as part of the project. Mark Fautch, 2475 Morningside Rd.: What recourse is there for a property owner.who does not feel that his property value has increased by the amount of the assessment? Richard Schaeffer explained the assessment appeal process. Russ Krueger, 2762 Morningside Rd. stated that anyone who had not signed the petition for Minnegasco service could do so with. him. Linda Halliwill, 1385 Maplewood Dr.: As we are planning to sell our house when will we know the amount thabmust be put inescrow to pay for the assessments? Richard Schaeffer stated that City Clerk's usually decide when an assessment is pending. Donna Roehl stated that assessments are pending at the time a.bid is awarded to a contractor. Phil Chenoweth stated that there is usually a 30 day interest free period in which assess- ments can be paid. Charles Anderson, 1365 Maplewood Dr.: May assessments be assumed by a purchaser of.a home? Thomas Crosby stated that FHA. requires assessments be paid and other lending institut- ions will negotiate. A show of hands indicated that the majority of those attending the hearing preferred a 10 year payment schedule. Pat Headley, 2685 Bobolink Rd.: What is the time line for construction? Dave Hansing explained that after plans are approved by PCA, which should occur shortly, bids could be taken in June, contracts signed in July, with construction to begin in July or August. Streets would not be blacktopped until the Spring of 1982. Donna Roehl stated that because Federal and State funds are to be used bid proposals, bids received and contracts must be reviewed before project can commence. Cal Headley, 2685 Bobolink Rd.: Why has it taken so long to secure plan approval? Thomas Crosby stated that the city did not -wish° to begin plans until the grant had been approved because any work completed before grant approval is not fundable. Motion by Lutz, seconded by Scherer to close the public hearing. Motion declared carried Public Hearing closed at 8:55 P.M. Motion by Reiser, seconded by Scherer to adopt Resolution 81-14, ordering improvements and preparation of plans and specifications for Medina Morningside improvements. Motion declared carried Medina Morningside Water Improvements Mayor Anderson explained briefly the purchase of the existing water system and the means by which a User fee would be charged to pay for the system. He also explained the Long Lake proposal for connecting the Medina Morningside water system to that of Long Lake. 4. PLANNING AND ZONING DEPARTMENT Minnesota Exteriors JoEllen Hurr explained Martin Bennis' plans to increase the size of his building at 295 Hwy. 55. A letter has been received from the Soo Line Railroad indicating no objection to granting a 19 ft. rear yard setback variance so that present line of building could be continued. Motion by Crosby, seconded by Scherer to grant a 19 ft. rear yard set back variance to Martin Bennis to construct a 150 ft. unheated warehouse addition to his existing building at 295 Hwy. 55 and staff,is directed to prepare a development contract to cover landscap- ing, parking lot blacktopping, if needed, and city administration fees. Motion declared carried Gary Lindgren, Independence Estates Richard Schieffer explained that Mr. Lindgren had been advised to petition the city to make the street, sewer and water improvements to his -property, which he has done, by means of his letter. - JoEllen Hurr stated that in the past the city, in most cases, has not done such work. Also Ron Duran did not favor the city becoming involved in such projects. Thomas Anderson stated that this is a situation whereby some tax forfeit property is being included and will be put back on the tax roll and the street improvements will improve existing streets in the area. Gary Lindgren estimated the cost to be $75,000 plus the cost of the street improvement. Thomas Anderson asked that Thomas Crosby prepare some variables for consideration and that Mr. Lindgren present firm estimates as to cost of the project. Motion by Crosby, seconded by Lutz to table the matter until May 19th. Motion declared Carried Gary Fey, North American Gran Prix Track Mayor Anderson turned over conduct of the meeting to Acting Mayor William Reiser and left the Council Chambers. Richard Schieffer reviewed the resolution denying approval of a Conditional Use Permit to operate a Gran Prix Race Track at 310 Hwy. 55. Tom Bissel, representing Mr. Fey, asked that Council reconsider denial or table the matter. Mr. Fey stated that he was prepared to withdraw his plans for a game room, cut back hours to 10:00 P.M. weekdays and 11:30 weekends and to cut back the number of cars on the track. Thomas Crosby stated that both the Council and Planning Commission had spent a great deal of time on the matter and that the time to request the matter to be tabled should have been at the April 21st meeting. Acting Mayor Reiser asked if Council wished to reconsider Mr. Fey's proposal with the changes hehas proposed. Mr. Fey stated that although a Council can decide what businessess come into a city he has a right to show the Medina Council what he -says is true. Richard Schieffer stated that under a Conditional Use Permit a Council cannot make up rules as it goes along, all must. be set forth at. the beginning. Thomas Crosby stated that the central issue is the race track. Motion by Crosby, seconded by Lutz to adopt Resolution 81-15, denying a Conditonal Use Permit to operate a Gran Prix Race Track at 310 Hwy. 55. • Motion declared carried Robert Derus, Variance JoEllen Hurr presented information regarding Robert Derus' request for. a 30 ft. front yard setback variance to construct a house on Lots 1, 2, 16, Block 24, Independence Beach. She stated that the request is consistant..with others in the area because of the small lot size. Motion by Crosby, seconded by Lutz to grant a 30 ft. front yard setback variance to Robert Derus to construct a house on Lots 1,2 and 16, Block 24, Independence Beach. Motion declared carried Charles Pangier Council reviewed Mr. Pangier's letter and heard from Building Inspector, Loren Kohnen, that Mr. Pangier had dug a basement without obtaining a building permit and that the project had been "red -tagged." Sarah Lutz stated that the council had made its decision at the April 21st meeting and she did not believe the Council should discuss the matter further, as circumstances remained the same. • Council advised Loren Kohnen to proceed according to previous Council direction and under regulations of the State Building Code. John Spaeth -Hennepin County Park Reserve District . Motion by Crosby, seconded by Reiser to adopt Resolution 81-16, approving exchange of property between John Spaeth and the Park Reserve District, provided that the legal description that has been provided fits what is known to be the areas to be exchanged. Motion declared carried 5. 1981 LIQUOR LICENSE FEES . Council discussed increasing the 1981-82 license fees by 10% as had been decided when the 1981 budget had been prepared. . Joe and Bob Raskob asked that the City check other cities fees for the 1982-83 licenses. Motion by Reiser, seconded by Scherer to adopt Resolution 81-17, increasing on Sale Liquor license fees for 1981-82 by 10%. Also to look at what neighboring communities are charging before setting the 1982-83 fees. Motion declared carried 6. WnODLAKE SANITARY LANDFILL Joellen Hurr reviewed events regarding- expansion plans for Woodlake Sanitary Landfill. Richard Schieffer stated that Woodlake would like criteria contained in ordinance to be similar to that of other controlling bodies. Ed Monteleon of Hennepin County stated that Woodlake's license is •to be renewed on June 30th and the expansion area is not included in that application. Be added that the County does not act on the expansion until Medina acts. 7. BILLS Motion by Crosby, seconded by Reiser to pay the bills; Order Checks # 9471-9520 in the amount of $63,827.543 Payroll Checks # 6199-6222 in. the amount of $ 9,102.45; Revenue Sharing Check .# 1030 in the amount of $8056.93. Motion declared carried 8. WICHITA TR. Dave Hansing reported that Mr. Layeux will secure a proposal from a contractor for the repair of problem area on Wichita Tr. Richard Schieffer stated that Mr. Layeux wishes to hire a contractor and release the city from becoming involved. Motion by Scherer, seconded by Lutz to approve spending $1500.00 of the $2000.00 escrow amount for previously agreed upon improvements to correct problems on Wichita Tr. Motion declared carried Loren Kohnen stated that he has informed Mr. Layeux that he must repair his septic system and that he would be following up on that order. 9. SWIMMING POOL FENCES Loren Kohnen asked if Council wanted him to enforce the fencing requirement contained in the Swimming Pool Ordinance. The specific provision involved is fencing of existing pools. Consensus of the Council was to proceed as has been done, that is, enforcing the ordinance to include pools that existed before adoption of the ordinance. 10. WEST-HENNEPIN POLICE COMMISSION Council agreed to attending a joint meeting with the West Hennepin Police Commission at a convenient time during the week of May 24th, to discuss a possible merger of the Medina Police Department with West Hennepin. 11. ROBERT RASKOB Mr. Raskob requested information regarding receiving a separate tax statement on property on Holy Name Dr. JoEllen Harr was asked to follow up on the request and contact Mr. Raskob, Motion by Reiser, seconded by Lutz to adjourn.
