HomeMy Public PortalAbout2015-09-211 REGULAR COUNCIL MEETING, SEPTEMBER 21, 2015 CALL TO ORDER The Regular Council Meeting of September 21, 2015, was convened at 6:07 P.M. by Mayor Carrie Tergin. ROLL CALL The following Council Members were present for the roll call: Present: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Absent: None A quorum was declared present. ADOPTION OF THE AGENDA Mayor Tergin asked City Counselor Drew Hilpert to explain how the Council wished to amend the agenda to allow for addition and movement of items tonight. Mr. Hilpert stated that the following amendments had been requested by the Council: (1) Add presentation of 2015 Regatta Mayor’s Cup to Jim Crabtree under Miscellaneous Agenda Items as item “b.” (2) Move Resolution RS2015-17 (“ABLE Day”) up on the agenda under Miscellaneous Agenda Items as item “c.” (3) Add Mayor’s Veto to agenda between items 3 (Adoption of the Agenda) and 4 (Miscellaneous Agenda Items) on the agenda, immediately followed by a period of public comment before the Council votes on the veto. A motion was made by Councilman Graham, seconded by Councilman Prather, to adopt the agenda, with the amendments explained by Mr. Hilpert. The motion to adopt, as amended, was approved unanimously. MAYOR’S VETO OF BILL 2015-33 2 REGULAR COUNCIL MEETING, SEPTEMBER 21, 2015 Mayor Tergin read her veto message explaining her disapproval of Bill 2015-33 (Ordinance 15433), pertaining to adoption of the 2015 -2016 budget, which is entered into the record as follows: To: Members of the City Council From: Mayor Carrie Tergin Re: FY 2016 Budget Date: September 21, 2015 The purpose of this memo is to advise the Council that I have decided to veto Ordinance Number 2015-33, by which you approved the city’s FY 2016 Budget. It is my firm belief that increasing the cost of government to our citizens should be done with a great deal of forethought and as a last resort. I am not convinced that the city’s financial need justifies increasing taxes by any amount at this time. I want to especially draw your attention to the fact that sales tax revenue has been increasing at a faster pace than it was a year ago. City government has collected roughly $10.78M from the one cent sales tax during the past twelve months. Yet, the council approved budget is projecting collections at $10.3M from the one cent sales tax during the FY2016 fiscal year. I know of no basis for believing that either the national or local economy will recede during the next year. In fact, with the growth of our retail sector (e.g., Sam’s), I believe that the city’s sales tax revenue will continue to increase. For the reasons outlined above I must respectfully exercise my authority to veto this budget. At the conclusion of the veto message, Mayor Tergin announced that the Council will now open the floor for public comment on the issue. No one came forward to speak on the issue. Mayor Tergin then put the following question to the Council: “Shall the ordinance take effect despite the disapproval of the mayor?” After a lengthy discussion, the veto was overridden by the following roll-call vote: Aye: Branch, Costales, Henry, Mihalevich, Prather, Schreiber, Scrivner, and Ward Nay: Graham and Hussey Bill 2015-33 (Ordinance 15433) stands, and will go into effect without the Mayor’s signature. MISCELLANEOUS AGENDA ITEMS 3 REGULAR COUNCIL MEETING, SEPTEMBER 21, 2015 (a) United Way Update by City Employees Britt Smith, Laura Lewis, and Kay Stuefer: Following a brief narrated visual presentation by Mr. Smith, Mayor Tergin presented the “Tiki Award” to the City team which included City Administrator Crowell and Councilman Graham, for participation on this year’s United Way City of Jefferson team. (b) Mayor Tergin presented the 2015 Regatta Mayor’s Cup to Mr. Jim Crabtree, winner of this year’s event. She congratulated Mr. Crabtree and thanked him for bringing the cup back to Jefferson City. (c) RS2015-17 A RESOLUTION DECLARING SEPTEMBER 21, 2015, AS “ABLE DAY” IN JEFFERSON CITY A motion was made by Councilman Prather, seconded by Councilman Graham, to adopt RS2015-17 as presented, and approved unanimously by the following roll -call vote: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Nay: None Following introduction of the ABLE tutors and volunteers by Mr. Mike Downey, which included ABLE Tutor Councilman Bob Scrivner, Mayor Tergin thanked them for their service to the community. Amending Chapter 35 Pertaining to Multi-Family Uses in the RA-1 District, Residential Driveway Widths and Fencing Standards. Following a staff presentation by Planning and Protective Services Director Janice McMillan, Mayor Tergin opened the floor for public comment on the issue. No one came forward to speak either in favor of, or opposition to , the proposed rezoning. Mayor Tergin declared the public hearing concluded and stated the Council would take up the associated pending bill. 2015-43, sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 35, THE ZONING CODE, PERTAINING TO MULTI-FAMILY USES IN THE RA-1 4 REGULAR COUNCIL MEETING, SEPTEMBER 21, 2015 ZONING DISTRICT, RESIDENTIAL DRIVEWAY WIDTHS AND STANDARDS FOR FENCES. Bill 2015-43 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15434: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Nay: None APPOINTMENTS BY THE MAYOR Mayor Tergin recommended the following appointments: a. Bill Lockwood A motion was made by Councilman Scrivner for approval of the appointments as presented, seconded by Councilman Hussey, and approved unanimously. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Parks and Recreation Director Bill Lockwood provided an update on the University/Community Wellness & Recreation Center. He stated that the Parks Commission and Lincoln University had both voted to approve a Memorandum of Understanding since the last Council meeting. 5 REGULAR COUNCIL MEETING, SEPTEMBER 21, 2015 ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF The Council made the following announcements: Councilman Mihalevich announced that the September 24 Public Service Committee meeting had been canceled. Councilman Scrivner announced that the Public Works & Planning Committee would meet on Thursday, September 24 at 7:30 a.m. Councilman Branch announced that crew members of the USS Jefferson City Submarine would be in the City beginning September 24 and would participate in the Old Munichburg Oktoberfest on Saturday, September 26, as well as a BBQ event at Memorial Park on Sunday evening, September 27. Tickets for the BBQ can be purchased for $14 at several businesses as well as City Hall. Mayor Tergin made the following announcements about recently held and upcoming events: Chamber of Commerce event held at East School to give a tour of school renovations Jefferson City Fire Department Annual BBQ “Safety Net” Concert Vietnam Memorial Moving Wall Katy Trail 25th Anniversary Celebration Oktoberfest at Old Munichburg Eastside Business Association BBQ at McClung Park Staff made the following announcements: Public Works Director Matt Morasch announced the Transit Division will hold a “Ride the Bus Free Day” on Columbus Day (October 12) since that is a state and county holiday on which the buses would be in operation. He encouraged citizens to ride the bus on that day as a way to “try out” the public transit system. Transit will also unveil their new logo and uniforms on that date. 6 REGULAR COUNCIL MEETING, SEPTEMBER 21, 2015 LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE Lincoln University student / City Council liaison Jonathan Jackson was not present, but Mayor Tergin stated he would make announcements at the October 5 Council meeting about Lincoln University’s schedule of Homecoming events. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS Ms. Sherry Doctorian of Armstrong Teasdale , LLC, made a presentation regarding Bill 2015-44 (Contract for Legislative Consultant) to thank the City for th e opportunity to bid on this service and looked forward to possibly bidding again in the future. CONSENT AGENDA The following items were brought before the Council for approval by Consent: a. Minutes of City Council Meetings: September 8, 2015 b. Renewal (Year Two) of Bid in the Amount of Approximately $21,250.00 with Schuhmacher Fire Equipment for Protective Clothing for the Fire Department d. Mayor Tergin suggested that Mr. Crawford contact Police Chief Schroeder to discuss his ideas with him.
