HomeMy Public PortalAbout2015-10-051 REGULAR COUNCIL MEETING, OCTOBER 5, 2015 CALL TO ORDER The Regular Council Meeting of October 5, 2015, was convened at 6:00 P.M. by President Pro Tempore Bob Scrivner in the absence of Mayor Carrie Tergin. ROLL CALL The following Council Members were present for the roll call: Present: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Absent: None A quorum was declared present. President Pro Tempore Scrivner recognized that a Boy Scout was in the audience and asked him to introduce himself. Th e Scout identified his troop as Troop 4 from St. Peters School, and stated he is working on his Citizenship in the Community Badge. ADOPTION OF THE AGENDA President Pro Tempore Scrivner announced that the Council had approved an amendment to the agenda in the Pre-Meeting, as follows: (1) Move both Resolutions RS2015-18 and RS2015-19 up as the last item under the category “Miscellaneous Agenda Items” A motion was made by Councilman Hussey, seconded by Councilman Costales, to adopt the agenda, as amended. The motion was approved unanimously. MISCELLANEOUS AGENDA ITEMS (a) Planning and Protective Services Director Janice McMillan introduced Ms. Lauren Henry and announced that Ms. Henry has been named r ecipient of “Young Recycling Professional” Award by the Missouri Recycling Association. Ms. McMillan and President Pro Tempore Scrivner congratulated Ms. Henry on behalf of the Council. 2 REGULAR COUNCIL MEETING, OCTOBER 5, 2015 (b) A proclamation honoring “Project Homeless Connect Day” was presented to Ms. Sarah Nichols and Ms. Kristen Hilty who were present to accept the proclamation and made comments about the project. (c) A proclamation commemorating the 150th Anniversary of the Jefferson City News Tribune was presented to Terri Leifeste, General Mgr. (d) Ms. Janet Wear Enloe made an announcement recognizing October as Breast Cancer Awareness Month and encouraged citizen participation in a regional event providing mammograms which increase the chances for early detection of breast cancer. (e) RS2015-18 Neighborhood Assistance Program (“NAP”) Certification for Community Action Center (Hussey) A motion was made by Councilman Hussey, seconded by Councilman Costales, to adopt RS2015-18 as presented. The motion was approved unanimously by the following roll-call vote: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Nay: None (f) RS2015-19 Neighborhood Assistance Program (“NAP”) Certification for Teen Transitional Living Program, Sponsored by the HALO Foundation (Graham) A motion was made by Councilman Graham for adoption of Resolution RS2015-19 as presented, seconded by Councilwoman Ward, and approved unanimously by the following roll-call vote: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Nay: None PUBLIC HEARINGS Rezoning 0.62 Acres from RA-2 to C-2 for Property Addressed as 816, 818, and 820 Southwest Boulevard. 3 REGULAR COUNCIL MEETING, OCTOBER 5, 2015 The following persons spoke on the proposed rezoning: In favor: Mr. Kevin Murphy on behalf of GRD Properties, made himself available to answer any questions. No one came forward to speak in opposition to the proposed rezoning. Planning and Protective Services Director Janice McMillan presented a staff report on the issue and offered to answer any questions. As no one else had testimony to present on the issue, President Pro Tempore Scrivner declared the public hearing concluded, and stated that the Council would now take up the associated pending bill 2015-47. 2015-47, sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 0.62 ACRES OF LAND ADDRESSED AS 816, 818 AND 820 SOUTHWEST BOULEVARD FROM RA-2 MULTI-FAMILY RESIDENTIAL TO C-2 GENERAL COMMERCIAL; DESCRIBED AS LOT 1 AND PART OF LOT 2 OF WESTWOOD SUBDIVISION PART 1, IN JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2015-47 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15439: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Scrivner, and Ward Nay: None APPOINTMENTS BY THE MAYOR There were no appointments to present to the Council at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Parks and Recreation Director Bill Lockwood provided an update on the University/Community Wellness & Recreation Center. He announced that the Parks and 4 REGULAR COUNCIL MEETING, OCTOBER 5, 2015 Recreation Department has set up an online form where citizens may pr ovide input on the issue through the City’s website. The form is found on the Parks’ front page by going to www.jeffersoncitymo.gov/parks and clicking on the link “share your idea for the center.” President Pro Tempore Scrivner asked Mr. Lockwood to make brief comments regarding recent misinformation about public access to the facility. Mr. Lockwood made brief comments, and stated that more information will be provided in the near future to correct erroneous information about the project. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF President Pro Tempore Scrivner announced the following upcoming Council Committee Meetings: Council Committee on Administration – Wednesday, November 4, at 8:00 A.M. Finance Committee – Thursday, November 12, at 7:30 A.M. Public Safety Committee – Thursday, October 29, at 7:30 A.M. Public Works & Planning Committee – Thursday, October 22, at 7:30 A.M. LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE Lincoln University student / City Council liaison Jonathan Jackson stated that Lincoln University Homecoming Week will be October 11 -17, and asked that the Council consider participating in the parade by representing each of their wards. He stated he would send information in the next few days about all the Homecoming events to City Clerk Powell to share with the Mayor and Council. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS The following presentations were made regarding Bill 2015-59 (Vacation of Chestnut Street): Mr. Steve Walker stated his reasons for opposing the vacation. Ms. Cathy Bordner stated that she supports the eventual vacation, but does not believe it should occur at this time due to construction of the Lafayette Interchange project. Mr. Gary Stroup stated he also agrees with the comments of Mr. Walker in opposition to the vacation. 5 REGULAR COUNCIL MEETING, OCTOBER 5, 2015 Mr. Jeff Martin stated his concern that traffic problems already in existence would become worse with the vacation. Dr. Kevin Rome, Lincoln University, spoke in favor of the vacation and stated his reasons why Lincoln University believes it is needed. At the conclusion of the presentations, President Pro Tempore Scrivner announced that an “open house” style public meeting would be held on Thursday, October 8, in the Boone-Bancroft Room from 4:00 to 6:00 P.M. where citizens may come at their convenience to view the visuals which will be provided by Lincoln University and ask questions about the issue. CONSENT AGENDA The following items were brought before the Council for app roval by Consent: a. Minutes of City Council Meetings: September 21, 2015 b. Acceptance of $18,267.00 Department of Justice, Office of Justice Programs “JAG” Grant c. Trade of Remnant Parcels of Land Between Waters Realty Company and Parks & Recreation Commission d. Accepting $62,620.00 Change Order No. 2 with Horner and Shifrin, Inc., for Hayselton Pump Station and Forcemain Design A motion was made by Councilman Mihalevich for approval of the Consent Agenda as presented, seconded by Councilman Prather, and approved unanimously. BILLS INTRODUCED 2015-56, sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 35, THE ZONING CODE, ESTABLISHING MOTOR VEHICLE SALES, LEASING AND RENTAL AS A PERMITTED USE OF THE M-2 GENERAL INDUSTRIAL ZONING DISTRICT 2015-57, sponsored by Councilman Prather, entitled: 6 REGULAR COUNCIL MEETING, OCTOBER 5, 2015 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE 2015-2016 BUDGET OF THE CITY OF JEFFERSON, MISSOURI, BY CHANGING THE PERSONNEL SCHEDULE WITHIN THE DEPARTMENT OF HUMAN RESOURCES. Councilman Prather requested that the rules be suspended and Bill 2015-57 placed on final passage. There were no objections to the request for suspension of the rules. RESOLUTIONS Resolutions RS2015-18 and RS2015-19 were taken up under “Miscellaneous Agenda Items.” PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS Ms. Angela Whitman made a presentation regarding her views on issues found in the area of Elizabeth Street. She announced that a neighborhood meeting will be held at 10:00 A.M. on Saturday, October 10 at the Boys and Girls Club (a/k/a Dorothy Pack Center). President Pro Tempore Scrivner thanked Ms. Whitman for her comments and encouraged her to keep in contact with the Police Department regarding some of the issues she mentioned. Dr. Kevin Rome from Lincoln University stated he had additional comments regarding the Chestnut Street vacation issue. He stated that Lincoln University would be willing to wait until the Lafayette Interchange is finished to vacate Chestnut completely, but that it should be gated as soon as possible. He will work with staff to come up with acceptable language to that effect in the agreement currently before the Council with Bill 2015-59.
