RE: Transmittal of the Village of Key Biscayne's Adopted Evaluation and Appraisal
Report -based Amendments
Dear Mr. Eubanks:
Enclosed please find three copies of: Ordinance No. 2012-4 authorizing adoption of the
Village's Evaluation and Appraisal Report (EAR) -based amendments; the Village's Adopted
EAR -Based Amendments (one hard copy and two CDs), and; the Citizens' Sign -in Sheet.
Copies of this package are also being transmitted to the review agencies listed at the end of
this letter. The data and analysis for these amendments is contained in the Evaluation and
Appraisal Report which was adopted by the Village and found sufficient. The Village's
adopted Comprehensive Plan Evaluation and Appraisal Report was previously submitted to
your office and all review agencies. The Village's Comprehensive Plan is available on-line
through FLORIDA PAPERS. FLORIDA PAPERS is accessible from the DEO web site.
Copies of this transmittal package are being concurrently mailed to the review agencies
listed at the end of this letter.
Florida Statutes (F.S.) require that a governing body amend its Comprehensive Plan based
on the recommendations in the EAR after the report is found sufficient. The Village
transmitted its EAR -based amendments in March 2010. In the May 21, 2010 Objections,
Recommendations and Comments (ORC) Report, the State provided objections,
recommendations and comments regarding the Village's proposed amendments (DCA No.
10-1 ER). The Village's response and corrective actions are outlined in the introduction to
the Application Report (pages 1 — 2).

The Village is not located in: an area of critical state concern; Orange, Lake or Seminole
County, or; the Wekiva River Protection Area. The Amendments are not proposed to be
adopted under a joint planning agreement pursuant to Section 163.3171, F.S. An updated
five year Capital Improvements Element is included. The Village has not issued any de
minimus exceptions to concurrency requirements.
