IONA CITY HALL
APRIL 18,2023—7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Evan Mann, City Attorney
Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West.
ABSENT: None.
VISITORS: Kurt Roland, Deanna Simmons and Daren Long.
Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by
Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of March 21,
2023 were reviewed. Council reviewed the finance reports for the period ending March 31, 2023
(50% of the fiscal year elapsed). The City had $2,906,327.21 in the bank and routine bills had
been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
consent agenda as presented. Council Member Thompson seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Public Hearing, Application for Preliminary Plat, Eagle Rock Engineering; Countryside
Ranches, a Subdivision located on Parcel #RPC0000366603; located on the north side of
49th North, between 45th East and 55th East — Kurt Roland of Eagle Rock Engineering, 1331
Fremont Avenue, Idaho Falls, approached the podium and stated he is representing the developer
of the Countryside Ranches Subdivision. He continued and stated the property is approximately
16 acres and they are proposing to have 33 lots that are approximately 1/3 acre. Mr. Roland
stated the subdivision will be serviced by Iona Bonneville Sewer District and will be on the City
of Iona water system. He continued and stated they intend to use infiltrators for storm water. He
also stated there will be 2 lots on the edge of 49th North for landscaping as you enter the
subdivision. Council President Geray asked who will be responsible for maintaining that
landscaping. Mr. Roland confirmed the Homeowners Association (HOA) will be responsible.
Council President Geray expressed hesitation for depending on the HOA for this type of
maintenance.
Council Member Mann asked if there is going to be any type of park or green space in this
subdivision. Mr. Roland stated there is no park on the plat. However, they have been told there is
potential for a park on the lot to the east that is currently owned by Bonneville County. Mr.
Roland continued and stated they are going to shift some of the lots for the final plat to include a
walking path to that future park. Mayor Gubler stated the lot used to be a landfill and is owned
by Bonneville County. He continued and stated the City approached Bonneville County about
developing it into a park because it cannot be used for any building or developments. Mayor
Gubler stated the county told him they would research the legality of transferring ownership of
that property to the City of Iona, but he has not heard anything back. Council Member Mann

stated that park is not a guarantee and it has been discussed amongst the City Council as well as
the Planning & Zoning Commission to require developers to include green space in their
subdivisions. Mr. Roland stated the developer does not want to put a green space in the
subdivision that they will be responsible for maintaining until all the lots sell. Council Member
Mann stated families are losing a sense of community without a park or green space to gather as
neighbors.
Attorney Rawlings asked for clarification on the boundaries and intentions of the lot that
currently has a house on it, along with another lot, next to the proposed development. Mr. Roland
stated that is the original owner of this parcel that kept their house and split it off from the rest of
the land and they sold it to Rockwell Homes. Attorney Rawlings stated if the owners of that
property want to have 2 lots, they need to be included on the plat. Clerk West stated the entire
parcel was annexed into the City of Iona 2 years ago as a single lot. She continued and clarified
to Mr. Roland that the original owners cannot have two lots that are left unplatted if this
development is approved. Clerk West stated those owners may have already had that split
recorded with Bonneville County. Attorney Rawlings stated they would have needed to get
approval from the City if they split it into 3 lots.
Council Member Thompson stated the road entering the subdivision from 49th North is a dead-
end on the north side of the subdivision. He expressed concern for the future development of
surrounding parcels. Council Member Thompson then pointed out the lot to the west of this
development would be landlocked unless they added another road on the west side of this
subdivision. Council Member Wadsworth agreed. Council and Mr. Roland discussed potential
roadways that could connect future developments on surrounding parcels.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to
address the Council on this Preliminary Plat. No response. Mayor Gubler closed the Public
Hearing portion of this agenda item for Council deliberation.
Council Members Wadsworth and Thompson both stated the only problem they have with the
plat is land locking the lot to the west. Council President Geray then stated he believes the
Council needs to pass an ordinance that requires green space in new developments. He continued
and stated it has been discussed, but it needs to be codified. Council and Mr. Roland discussed
options for various locations of temporary and permanent parks in this and future developments
of adjacent parcels.
Council Member Thompson asked the Council if 70' wide roads are sufficient for this
subdivision if there will be future developments to the north. Mayor Gubler stated this plat meets
the updated standards the City passed last year and are sufficient for future growth. He continued
by stating future developments will be responsible for additional access points.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the
Preliminary Plat of Countryside Ranches with the suggestion of adding a road opening to the
west for future growth and a green space be left open until another green space can be
determined in a future development. Council Member Thompson seconded the motion. A roll
call vote was taken:

Public Hearing, Amendment to Iona City Code § 11-11-6: Accessory Buildings; adding a
set back from the residence by at least 12 feet (Ord. 286-04-23) — Mayor Gubler stated this
Code Amendment is to add a requirement to have a 12' setback for accessory buildings from
existing structures. Attorney Rawlings stated this amendment was requested by the City Building
Inspector and was discussed at last month's Work Meeting. He continued and stated further
language was changed to clarify measurement points, etc. Council President Geray stated the
amendment specifies the foundation as a measuring point, but mentioned some concrete slabs
with an overhang are not considered part of the foundation. He continued and stated that would
mean the roof of the overhang could be closer than 12' to an accessory building and asked if that
needs to be addressed in this amendment. Mayor Gubler stated there is not a fire code that
stipulates this requirement. Council President Geray stated as he understands it this amendment
is being considered to stop the spread of fires from accessory buildings to main structures. Clerk
West stated when the City Building Inspector requested this amendment, he specified the
foundation as the measuring point. Attorney Rawlings concurred.
Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience would like
to address the Council on this agenda item. No response. Mayor Gubler then closed the Public
Hearing portion of this agenda item.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve
Ordinance No. 286-04-23, an Ordinance of the City of Iona, Idaho; amending Section 11-11-6 of
the Iona City Code; adding a requirement for accessory buildings to be set back from the
residence by at least twelve feet; providing methodology; preserving prior Ordinances in each
instance; providing for severability; and establishing an effective date. Council President Geray
also made a motion to dispense with the rule of reading the proposed Ordinance in full and on
three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was
taken:

Review and Approve City Surplus List — Clerk West stated the City staff has gone through
many items the City owns and cannot get rid of until the City goes through the auction process.
She continued and stated once the auction is closed, the items can be sold at the City Yard Sale
on June 3`d at the City Park. All items that are not sold through the auction or Yard Sale will then
be donated. Council President Geray stated it needs to be clearly understood that elected officials
cannot bid on the items. Director Prouse stated elected officials and employees can only try to
purchase items after the auction period closes. Clerk West stated she needs approval from the
City Council to include all the attached items on the public auction. She will then get the auction
set up and the public notices published.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the City
Surplus List as presented. Council Member Wadsworth seconded the motion. All in favor.

General Discussion of Animal Neglect and Public Nuisance — Attorney Rawlings stated this
was suggested as a future topic of discussion at last month's City Council Meeting. He continued
and clarified enforcement of these issues is handled internally between the Mayor and the
contracted police service, which is currently Bonneville County Sheriff's Office (BCSO).
Attorney Rawlings stated the City Council is not responsible for specific enforcement of such
issues. Their role is to discuss policy and set up guidelines on how these situations should be
administered and enforced. He continued and stated the City Council can listen to testimony
about issues and use that information in a general sense on how to administer future situations,
but they cannot decide specific action or enforcement on individual instances.
Council President Geray asked about the history of the situation that was brought up at last
month's meeting pertaining to animal neglect. He also asked if this is a common situation in the
City or if this is an isolated incident. Deputy Randall stated he first received a phone call about
animal neglect for the home on Hansen Avenue last October. He continued and said the Animal
Control deputies visited the house and were dissatisfied with the condition of the fence. He stated
the homeowner fixed the fence to meet Animal Control's requirements. Deputy Randall stated
after the issues that arose last month, Animal Control conducted two additional visits to the
home. He continued and stated the first visit was while the homeowner was away and the second
was with the homeowner. It was determined after both visits that the horses and grounds were
acceptable by their standards. Deputy Randall then stated he does not feel this is a wide spread
issue around Iona. Council President Geray then asked the proper route for an individual to take
if they are unsatisfied with the county's decision on such cases. Attorney Rawlings stated they
could take their complaints to BCSO directly or could report them to the Mayor. Council
President Geray asked if the City has received any documented evidence that contradicts
BCSO's experience. Mayor Gubler stated there has been nothing received by the City.
Attorney Rawlings asked Deputy Randall if he has any suggestions on amendments that may be
needed in the City Code regarding animal neglect or public nuisance. Deputy Randall stated he
feels the City Code is sufficient regarding animal neglect. However, as for the public nuisance he
would like to see specific requirements such as a previous call, etc. Attorney Rawlings stated
with a public nuisance the City does want to maintain some flexibility. He continued and stated
the City can also adopt an"aggravated nuisance" section in the City Code, which is an option.
An audience member expressed her frustration from the audience regarding the situation with her
neighbor and the process for enforcement. Council Member Thompson advised her to continue
making calls and documenting specific dates and times of specific instances. Mayor Gubler
stated the City will continue having Animal Control check on the horses and will report if the
situation gets worse.
General Fiber Project Discussion — Director Prouse stated Fybercom is currently working on
Barnes Way. He then stated Direct Communications will have 8 crews begin working on
Monday to install the main lines throughout the City. Director Prouse continued and said there
are many flags that have been placed around the City that indicate utility lines and other
markings for the fiber project. He then said communication with Direct Communications has
been less than ideal. Clerk West stated she will contact them tomorrow.

STAFF REPORTS: Director Prouse stated they have started street sweeping around the City.
Clerk West reported the Easter Egg Hunt went well and was well attended. She and Rylea have
started discussing potential improvements. Clerk West also suggested doing a "City Budget
Tour" after the June Council Meeting to help the Council get familiar with items that may need
to be addressed on the budget. Council Member Wadsworth suggested doing this prior to the
Council Meeting. Council President Geray is not opposed to this idea, but also encouraged the
Council Members to ride along with Director Prouse to familiarize themselves with the facilities.
Clerk West also reported the discussions with Bonneville County Planning &Zoning on the Area
of Impact Agreement are still going and the City will attend another work session with them on
May 3rd
Deputy Randall reported the total incidents were down last month. He continued and stated they
are currently working on outstanding warrants. He then introduced Deputy Davies as the new
Iona Deputy with BCSO.
Council Member Thompson reported Representative Wheeler will be hosting a Town Hall this
Saturday at the Iona City Building to discuss important topics with the local community.
Council Member Mann stated he drafted a letter and attended the Ammon City Council Meeting
to discuss the City of Iona's desire to acquire the Iona Cemetery in our Area of Impact. He
continued and stated they said they are open to that discussion. He also mentioned he has
received complaints about the goat heads on Denning Avenue, next to the school causing
problems with bike tires. Director Prouse stated he has already taken care of this with the street
sweeper.
Mayor Gubler stated there will be a meeting tomorrow evening at Iona Bonneville Sewer District
for judicial review for the new plant they are looking to build. Clerk West confirmed the meeting
is scheduled for 6:00pm. Mayor Gubler also reported the City will soon be getting the new fuel
tank placed at the new water tank site. He then thanked the City employees for the great job done
at the Easter Egg Hunt. Mayor Gubler also thanked Council Member Mann for his efforts with
the Iona Cemetery and the Area of Impact with the City of Ammon.
