Home My Public Portal About2006-065 (05-02-06)RESOLUTION NO. ~nn~ nF~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REPEALING AND RESTATING THE LYNWOOD CIV[L PENALTY SCHEDULE (EXHIBIT 1 OF RESOLUTION NO. 21104.128) FOR THE PURPOSE OF INCREASING THE PENALTY .AMOUNTS FOR CERTAIN PARKING VIOLATIONS WHEREAS, Section 40203.E of the California Vehicle Code authorizes a city to )) establish as civil penalties the amount of fines for parking violation citations issued under itsjurisdic[ion; and WIiEREAS, Section 402035 of the Califomia Vehicle Code authorizes issuing agencies within the same county to standardize their parking penalties to the greatest extent possible: and WHEREAS, on or about January 18, 1994, the City of Lynwood originally established its parking fines and Civil Penalty Schedule by adopting Resolution No. 94-12; and WHEREAS, Resolution No. 94-12 provided for annual review of the fines listed in the Civil Penalty Schedule; and ~~'HEREAS, on July 27. 2004 the City Council of the City of Lynwood increased its parking penalty fine amounts by adopting Resolution No. 2004.128; and WHEREAS, parking penalty fees were recently reviewed as part of a comprehensive cost of services study performed for the City of Lynwood by Pacific Municipal Consultants ("PMC"); and r- WHEREAS, the results of the PMC study determined that an increase in the penalty amounts for certain parking violations in the City of Lynwood was required in - order to achieve standardization: and WHEREAS, the City has published a notice of public hearing on the proposed increase to the parking penalties, and held the required public hearing. NOV1', THEREFOKE, THE CITY COUNCIL OF THE CITY OF LV'NWOOD DOES RESOLVE AND DETERMINE A5 FOLLOWS: Section 1. Exhibit I of Resolution 2004.128 (The Lymvood Civil Penalty Schedulej. which last established the civil penalties for parking violations in the City of Lynwood, shall be repealed in its entirety and the City of Lynwood Parking Civil Penalt~~ Schedule. attached hereto as Exhibit "A" is hereby adopted in its place.
