Creek CSO BP 051 & 052 Local Storage Facility (Chain of Rocks Dr to Church Dr)
(11656) to serve the needs of residents of the area, and authorizing the acquisition of
said real property by purchase or by the institution of eminent domain proceedings.

The buyout/acquisition of properties in the area of Pardee Lane and Pardee Road in the City of Crestwood, Missouri to
allow for the area necessary to accommodate the construction of a sanitary storage facility. The effort will include the
acquisition of the property through negotiation and/or condemnation, if necessary, and securing the site. Through the
approval of this Board action, District staff will be authorized to negotiate with the property owner and purchase the
property included in the scope without further Board action. A real property acquisition consultant will perform all
negotiations and management of the property acquisition from the first contact with the owners through the closing. The
consultant will perform all services in accordance with the Code of Federal Regulations Uniform Relocations and Real
Property Assistance Act (49CFR Part 24, amended). The District will contract for any demolition, securing of the site, and
final restoration of the site under separate contracts through the Purchasing Division. All of these activities will be funded
from this appropriation. The development of the wet weather storage facility would be funded by a separate Board action.

The Missouri Botanical Garden has received a Nonpoint Source Implementation Grant from the Missouri Department of
Natural Resources under Section 319 of the Clean Water Act. The Botanical Garden will partner with MSD, under
Contract #11006, and Deer Creek watershed municipalities to continue a homeowner cost-share program to install plant-
based green infrastructure management practices. In addition, MSD will provide an estimated $160,000 in in-kind green
infrastructure-related improvements in the Denny, Pebble, and/or Monsanto-Sunswept Creek watersheds. Said
improvements are to be constructed as part of the Conway – Clerbrook Storm Channel (10348) project and/or the
Tealwood Drive & Beaver Drive Bank Stabilization (11222) project. This agreement provides reimbursement of up to
$207,500 to the Missouri Botanical Garden for costs related to the construction of green infrastructure. Section 319 funds
provided by the EPA amount to $687,042; nonfederal matching funds amount to $507,940; and other federal matching
funds of $20,000 for a total project cost of $1,214,982.

Additional Comments: The main goal of the Missouri Botanical Garden Deer Creek Watershed Initiative project is to
reduce impacts in the Deer Creek watershed by implementing green infrastructure technologies to improve water quality
stemming from nonpoint source pollution, with a focus on plant-based solutions. The project will use various techniques
to achieve the overall goal through implementation, demonstration, education, and planning efforts. The following
techniques will be utilized to achieve the overall objectives: decrease erosion, sedimentation and other nonpoint source
pollutants by capturing and infiltrating stormwater runoff on-site by utilizing volume-based hydrology approaches;
protection of streams and groundwater from chloride; reduce bacteria pollution in the watershed related to animal waste;
and reduce water pollution caused by yard waste and organic debris. In addition, this project will aid the District in gaining
performance effectiveness of green infrastructure.
