SECOND PARTIAL RELEASE OF THE PERFORMANCE ~UARANTEE FOR
BROWN'S MEADOW SUBDIVISION
WHEREAS, Brownell, Inc., developer of Brown's Meadow Subdivision
has requested a second partial release of the $167,000 performance guaran-
tee for public improvements for that subdivision; and
WHEREAS, Council has previously reduced this guarantee to $].10,720.90;
and
WHEREAS, $153,800.00 of public improvements have been completed in ac-
cordance with town standards; and
WHEREAS, this partial release is not an indication that the public fa-
cilities are accepted for maintenance and Brownell, Inc. is solely responsible
for the condition of those improvements until such time as they are accepted:
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia
as follows:
The performance guarantee in the form of a set aside agreement is re-
duced to $13,200.00.
