It was a good day and I am looking forward to working with Allen Nordin, Fraser's new public works director who begins working here on September 18th. It has been a busy couple of weeks with a lot of construction management going-on. The pavers intend to move into Town next week - but their schedule will be driven by how much work the excavation subcontractor can get done. It seems that ever since the tanks at the Mustang were discovered the excavation has slowed considerably as .' Doc Susie and Elk Creek Drive have been very challenging. I have heard rumors that some people will be present at the next Board meeting to express their concerns about how slow the progress has been. I also expect that some people will be upset as for the first time the full size of the cul-de-sac "bulbs" is clearly evident and some old parking patterns are being upset. Speaking of next Wednesday, I will be wearing my yellow "flak jacket" vest as I antidpate a lively meeting. Jay Clough suggested to me a few weeks ago that we take the lead repladng corroded water service lines on Mill Avenue as he found his corroded several years ago. After thinking about his suggestion, I told him that since the service line is the homeowners responsibility this would be a project that homeowners could pursue but that the Town would not be leading this project. . Jay told me yesterday that he would like to address the Board regarding this issue. I'd like to start on Wednesday with a 6:00 study session, dinner will be served. During the study session we'll talk about Amendment 24, the proposed "growth management" amendment to the Colorado State Constitution. Thanks to Katrina for supplying the enclosed full text of the amendment. Please also look at the enclosed memo on the same topic. Additionally, we'll look at Amendment 21, also enclosed with a memo. . During the regular meeting, there are seven action items: . Pat and Christy Taylor's Final Plat; . Broken Wagon Wheel Estate's amended Final Plat; -- --- ~ /' . Action on a request for variance from the Fraser sign code from Moonshine . Liquors. See the enclosed materials. . Approval of the "pre-paid" tap agreement between KOELBEL and the Town relating to water infrastructure serving the east side of the Maryvale property. All I have included in the packet is the agreement, which is the product of several months of work by Rod McGowan, Ron McLaughlin, staff, and KOELBEL's "LLC" team. . Preliminary and final plat approvals for the Fox Run project. The plats are being combined at staff's suggestion: Jim Swanson and staff have been working with the Housing Authority's development team all summer as they work with all of the various site constraints - from topography to financing requirements. The Housing Authority has to have final plat approval by the first week in September to meet Colorado Housing and Finance Authority requirements (actually, the date was September 5th, but CHFA agreed to postpone receiving the approval until the first week due to the Town's meeting schedule). . A request from the Grand County Housing Authority to defer tap payments on the Fox Run project; and to waive the required subdivision improvement agreement and school impact fee. Please see the enclosed letters from GCHA and the School District on these issues. We deferred the water taps . for Wapiti Meadows and a similar agreement could be structured for this project's 53 affordable units if the Board chose to assist the GCHA in this manner. I believe that we could get the Town listed on the performance bond required by the Colorado Housing and Finance Authority for Fox Run's public improvements in lieu of a standard subdivision improvement agreement and will talk to Rod about this prior to Wednesday. . A resolution defining "valid development application" as used in proposed Amendment 24. As mentioned above, information about this is in the packet. During discussion items, we'll talk about the East Mountain wetland mitigation application. A memo and letter is enclosed for your review. Finally, we are looking for a gardener for a short duration and Katrina Larson has expressed an interest in the position. This would obviously be a potential conflict of interest but as it would be for a short duration, Katrina and I thought we'd bring this to you all for discussion. The Town Board previously discussed this case in light of the variance request. Since that time, the Zoning Board of Adjustment approved the variance requests (minimum lot size and setback reduction). Additionally, the Planning Commission has reviewed the Final Plat and recommends approval. Note that parking provisions for the existing apartments have been provided anda minor easement for access is included. RECOMMENDATION Pursuant to the Planning Commission recommendation, staff also recommends approval. Should the Board agree, the following is a suggested motion: I move that we approve the Taylor final plat. . ýÿ ---- TOWN OF FRASER . _/ ~ P.O, Box 120/153 Fraser Avenue Fraser, Colorado 80442 (970) 726-5491 FAX Line: (970) 726.5518 E-Mail: fraser@ rkymtnhLcom . Memorandum To: Town Board - From: Jeffrey L. Durbin, AI Date: August 31, 2000 Subject: Broken Wagon Wheel Amended Final Plat Request: Amended Final Plat Applicant: CB Jensen and AJ Jensen Location: Lots 1 and 2 of Broken Wagon Wheel Estates (Wapiti Dr at CR 8) Zoning: R-2 . The applicants are requesting approval of an amended final plat to accomplish a minor relocation of the lot line separating lots 1 and 2 of Broken Wagon Wheel Estates. The Zoning Board of Adjustment approved a setback variance to allow construction of a garage for each lot joined with a party wall on tne lot line. Aesthetically, this would provide the appearance of one structure with a common roof design joining the two garages. The Zoning Board of Adjustment in~luded a condition that a plat note be included stating that the garage exterior appearance will always remain to look like a single structure. RECOMMENDA nON The Planning Commission considered this request at the August 23, 2000 meeting and recommended approval with the condition that the plat note be included and that a party wall agreement with dispute resolution provisions be e.5tablished prior to building permit. Should the Board agree, the following motion is suggested: I move that we approve th,e amended final plat for Broken Wagon Wheel Estates subject to the following condition: 1. A plat note be included per Zoning Board of Adjustment conditions for . approval and that a party wall agreement with dispute resolution provisions be established prior to building permit issuance. .. .~ :;I.~; .. , "," t '. ., " ,; ,::,:.::i<:'..:'::..,, ",,:' ,".' .'" ~ . :":1.':. .' ~ ,- .,' TOWN OF FRASER, . This lowers the'sign and would cost some additional expense. Second,', remodel the' roof such that the sign could be located on a wall in that location. Attached is a picture of a vernacular architectural design that would locate a wall in the area where Scott hopes to place his sign, This, of c.ourse, causes some additio!1al ' . expense related to construction of a new roof . ýÿ - - --- , . . As I am new to the community, I hope to address this matter in a manner consistent with community philosophies, Code enforcement is only successful when the codes are well written, fair, and supported generally by the community. Thus I am seeking guidance and direction from the Board. The following are a series of options that are available: 1. Confirm the interpretation of wall/roof and require the sign to be relocated to a wall. The relocation could include remodeling the roof to include a wall that may allow similar sign placement. 2, Reconsider definition of roof, concluding that the current location is a wall, and thus in compliance with the sign ordinance, 3, Grant a variance pursuant to the new business section of the sign ordinance (see attached). This allows the board to grant a variance to the sign code for temporary signage for up to a two year period. If this was provided, I would suggest provision of a bond to ensure proper removal after the period expires, The consideration of this issue must also include a broader policy perspective. It is critical that a sign ordinance provide a "level playing field" among businesses. As in the Safeway/Fraser Drug discussions, a local competitor to this business is very interested in the outcome of this matter, . The removal of the old Liquor Barn sign must also be addressed to provide compliance with the sign ordinance. In addition to the limitation to only one ground sign, the prohibited sign section of the code specifically requires removal of signs erected by previous occupants, The owner of the Arby's site is currently in the process of removing the signage per town direction due to this provision. . ýÿ . . Perhaps they have changed since we opened our business, We are also aware of the fact that over the last several months you have been besieged with a variety of sign code variance requests, So therefore it is difficult for us to bring this burden to you once again, However we would . like to have the same competitive advantage as our new neighbor and as such are appealing to you to allow us a variance to place a sign on the roof of the Alco Center which would have greater visibility than the present signage which we are restricted to, We are only asking to be placed on the same playing field as that of our competition and hope that you will see this request in that light. We wish to continue to be a strong viable sales tax collection entity for your town and provide you the funding you need to continue to grow, We feel this is essential to our continued success and hope you will deliberate on it seriously and give a variance in our favor. On a more personal note, I am somewhat surprised that the town is comfortable having the introduction to your community be a giant liquor sign. Even if we were to be in the business in that location, I am not sure I would want the town of Fraser to be introduced with such signage to the initial visitor coming from the Winter Park direction, Perhaps some additional thought should be given to how this appears to the average traveler through our community and the immediate impact it might give one when entering into the town, If this is to become the focal point of the town of the future I think these types of display ads should be considered very carefully as to their visual impact to our town, Thank you very much for taking the time to consider this, Very Truly Yours, . Fox Run Apartments August 15, 2000 Page 2 The Board of Adjustment reviews criteria as established by the Zoning Ordinance for variances and approves or denies pursuant to specific findings relative to the request (rather than via some sort of mystic revealation), The Zoning Ordinance establishes the criteria for a variance as follows: The Zoning Ordinance establishes the criteria for a variance as follows: 1. That satisfactory proof has been presented to the Board of Adjustment showing that the present or proposed situation of a requested building, structure, or use is reasonably necessary for the convenience or welfare of the public. 2, That the variance which is requested would not authorize any use other than uses enumerated as a use by right of the district. 3. That an unnecessary hardship to the owner would be shown to occur if the provisions of the Zoning Ordinance were literally followed. 4. That the circumstances found to constitute a hardship either were not created by the owner, or were in existence at the time of passage of the Zoning . Ordinance, and cannot be reasonably corrected. 5, That the variance would not injure the value, use, or prevent the proper access of lighted air to the adjacent properties, 6. That the variance would not be out of harmony with the intent and purpose of the Zoning Ordinance, A parking variance would not be necessary iffewer units were proposed for the site, The housing authority, however, has considered this and indicated that the project would not be feasible, This site does present design constraints such as topography, wetlands, and snow management (which cannot impinge upon wetlands). The applicants have noted the reduced parking provisions for Wapiti Meadows, This project does provide a reasonable comparison for the proposed project. The Applicants will be present to discuss the project and variance in light of the six criteria noted above, Town codes require that the development provide 2 parking spaces for each 1 or 2 bedroom unit, and 3 spaces for each 3 bedroom unit. Four 3 bedroom units are proposed, the remainder being 1 and 2 bedroom units, The final plat approval (planning Commission) is contingent on the variance approval. . ýÿ . Fox Run Apartments August 15, 2000 Page 3 Site Issues As noted above, the site topography and wetlands pose design challenges to the development. Very minimal disturbance of the wetlands is proposed (only at the access). The site engineering has been designed to address the grade via some retaining walls and careful location of the street. Enclosed is a traffic study. Traffic generation has been a controversial issue related to this development. The County has requested a deceleration lane along CR 8, the primary access to the site. The second access to the site would be provided off Wapiti. This access is currently proposed to be a gated emergency access only, Staff prefers a full access at both CR 8 and Wapiti, Gated access poses challenges with snow management, emergency access, and community connectivity. We would recommend that the access not be gated, Land Use . The plan provides for one private drive that runs through the site providing access to seven buildings along with associated parking, laundries, office, etc, The plan complies with the 55% open space requirement and includes aspen and lodgepole pine landscape improvements, The Planning Commission should consider whether the plan complies with the landscape islands requirements. In consideration of the site design, and snow storage plan, staff feels that it appears to comply with the intent of this provision. The applicant must address trash areas-how will trash be collected? The architectural design submittals indicate vinyl siding and fiberglass composition shingles on the one and two story buildings, The one story buildings accommodate handicap accessible units, Fraser regulations provide that "building materials and colors should be predominately natural," Perhaps this will be addressed via building colors. .' ýÿ . . F ox Run Apartments August 15, 2000 Page 4 Engineering The engineering aspect of this project review includes two components, civil engineering (site design) and utility engineering (water and sewer), The town water system operator / sanitary district operator and our water and sanitary engineers have been reviewing the submittals, I will have a report from the engineers at the meeting, Generally, the plans are complete and well designed, There are some refinements/clarifications that will need to be addressed, For example, we need to clarify that no stormwater will be piped into the sanitary system, the height and location of fire hydrants must be clarified (also a fire district issue), and we may need some refinements to pipe sizing, Likewise, the Town Engineer has the submittals and is reviewing them in detail. The Town Engineer (and town staff) have had prior meetings with the consultants and I expect the significant issues to be addressed, Some refinements may be necessary, such as addressing a conflict between snow storage and hydrant locations (two minor .' conflicts), retaining wall detail submittals, and submittal of additional topographic detail. We have discussed drainage plans recently, and I would point out that the proposed drainage plan is very thorough (unlike other recent project submittals), Additional erosion control measures should be in place as the site work is proposed for this fall, yet building construction would commence in the spring, The town has installed (on other sites) a haybale/silt fence detail that is very effective. The erosion control plan includes a tracking control detail that is appreciated by staff This detail, often overlooked, helps prevent construction operations from tracking mud onto the streets (a common problem). Due to the proximity of the stormwater release to the wetlands, consideration of an oiVsand separator should be provided. Additionally, we need to clarify a potential conflict between the grades of the detention area and the snow storage area in this location, Comments A landscape plan is included, Plantings are composed of both aspen and lodgepole pines, We should discuss the landscape island requirements of town codes, the intent seems to be addressed, Additionally, we would recommend additional plantings along CR 8, This would help with wetland preservation and would be more consistent with the character of development along the CR 8 corridor, The plans should also indicate the proposed .' revegetation plan (recommend native plantings), . . . Fox Run Apartments August 15, 2000 Page 5 The plat includes a minor typo referencing the town board in the planning commission certificate. This shall be corrected prior to signatures, Recommendation Overall, the applicants have provided a thorough submittal that provides a functional site design for a difficult site, The Zoning Board of Adjustment consideration of the parking variance is primary, This consideration will impact Planning Commission consideration of the site plan. There are engineering issues that require some refinement, however, these could be accommodated by a conditional approval, The Zoning Board of Adjustment and Planning Commission should be prepared to hear public comment at the public hearings, ZONING BOARD OF ADJUSTMENT Should the Zoning Board of Adjustment seek to make a motion for approval of the .' parking variance, the following is a suggested motion: I move that we make the following findings relative to the variance request for Fox Run: 1. That satisfactory proof has been presented to the Board of Adjustment showing that the present or proposed situation of a requested building, structure, or use is reasonably necessary for the convenience or welfare of the public. 2. That the variance which is requested would not authorize any use other than uses enumerated as a use by right of the district. 3. That an unnecessary hardship to the owner would be shown to occur if the provisions of the Zoning Ordinance were literally followed. 4. That the circumstances found to constitute a hardship either were not created by the owner, or were in existence at the time of passage of the Zoning Ordinance, and cannot be reasonably corrected. 5. That the variance would not injure the value, use, or prevent the proper access of lighted air to the adjacent properties. 6. That the variance would not be out of harmony with the intent and purpose of the Zoning Ordinance. I further move that we approve the parking variance request. . ýÿ . , . . . . Fox Run Apartments August 15,2000 Page 6 PLANNING COMMISSION A number of issues are addressed in the report above that mayor may not require conditions. Some may not be appropriate given the nature of the project, it's primary goal being affordable housing, an important goal for the valley, Should the Planning Commission feel that the final plat merits approval (subject to ZBA action), the following is a suggested motion: I move that we recommend approval of the preliminary andfinal platsfor Fox Run Apartments subject to the following conditions: 1. Compliance with the requirements of the Town Engineer and WaterlSanitary Engineers. 2. Provision of trash enclosures. 3. Provision of additional landscaping along the north side of the access drive off CR 8. . 4. Address architectural materials and colors? 5. Mr. Chuck Reid Town of Fraser Page 2 unrestricted units in the project. We are asking that the Town approve that recommendation. In regard to the Subdivision Improvement Agreement CHFA requires that a performance bond be provided to cover the construction costs of the project including water line improvements, ingress/egress and landscape. Based on my understanding, the Housing Authority as developer is required to post a bond with the Town based on 1% of the cost ofthe improvements. In order to reduce additional costs to the project, I am proposing that the Town of Fraser be liste~ on our bond permitting you to draw on it should the need arise'. P,O Box 120 / 153 Fraser Avenue Fraser, Colorado 80442 (970) 726-5491 FAX Line: (970) 726-5518 E.Mail: fraser@rkymtnhi.com l\IlEMORANDUM To: Mayor Soles and Fraser Trust~ From: Chuck Reid and Jeff Durbin Date: August 31, 2000 Subject: Amendments 24 and 21 Attached are copies of Amendment 24 and 21, the growth management and tax reduction initiatives that Colorado voters will consider this fall. Amendment 24 . If passed, this initiative could have huge implications for the future of undeveloped property in Fraser. The initiative would add an article to the Colorado Constitution that would require Fraser to identify "committed areas" -- areas in which development is allowed, A committed area is defined as an area in which one of the following three paraphrased alternatives (emphasis added and format changed) is met: (1) all of the land is contained within a recorded subdivision or townsite, , , AND at least 50 % of the lots in such subdivision or townsite (1) have had permanent, primary structures constructed on them OR (2) have had central water and sewer services extended to them AND all lots are or shall be served by central water and sewer, , , (2) a valid development application", the approval of which would result in development that shall be served by water and sewer." has been submitted (by September 7 or 13,2000), (3) the land has been identified by the local government as an area for development", and it directly abuts. ..(an existing committed area).., along 100% of its perimeter, or along 50% of its perimeter (with the other 50% being permanently protected open space, federal lands or bodies of water), The initiative also calls for voter approval of future "growth areas," For Fraser's purposes once a growth area is approved by voters and adequate infrastructure is constructed, the area would become "committed," . --- . . . Page Two Amendments 24 and 21 Fraser's Position & Strategy If the initiative is passed the Town Board will need to identifY Fraser's committed areas, Based upon the initiative's definition, the enclosed draft map shows the parts of Town that would qualifY as committed today, However, as Section 2(B) of the initiative states, if the Town receives a "valid development application" for any of the parcels of land shown on the map, this land would be included in the committed areas, A valid development application is further defined in the initiative as: "an application that substantively meets all of the rules for submission applicable to a proposal and that has been accepted as timely and complete by the local government, , , " At recent CML meetings, it has been evident that individual municipality's will have dramatically different interpretations of what constitutes "an application that substantively meets all of the rules for submission," One city is actually mailing developers a "fill-in-the-blank" form that the city is then accepting, along with a development fee check, as a valid development application, Another city is only allowing final development plats to be considered a valid development application, Early on in Fraser staff's analysis of this initiative Rod McGowan stated that only the court's will define what exactly constitutes a valid development application, . but without further definition, this definition may fall under the guise of a "local control issue" and the courts may defer to the range of locally created definitions, So, what is to be done? One key issue needs to be discussed now: while we have not yet had a flood of development applications, we need to determine what constitutes a "valid development application" for the Town of Fraser, We could define a valid development application as any of the following: (1) a sketch plan that "substantively meets all the rules for submission"; (2) a planned development plan that "substantively meets all the rules for submission"; (3) a preliminary plat that "substantively meets all the rules for submission"; (4) a final plat that "substantively meets all the rules for submission"; (5) a development permit that "substantively meets all the rules for submission"; (6) a petition for annexation that "substantively meets all the rules for submission" a, with land use application; or any and/or combination of the above, Or, we could define a valid development application as only a final plat that "substantively meets all the rules for submission," One community has taken this approached based upon the language, "that leads to development." Fraser codes, like many others, require certain steps in the development review process, if you want to subdivide, you must first start at the sketch plan stage Based upon this process, some communities use the "in the loop" concept - each decision . along the process is equally important to ultimate development of the property, . . Page Three Amendment 24 and 21 From statT's perspective, Fraser could be a classic judicial "litmus" case due primarily to the Maryvale property, In Maryvale's case, the Town has a contractual zoning agreement, the amended annexation agreement, tor a large parcel ofland that is incorporated into the Town's boundaries but which may not meet the (tinal judicial) definition of a "committed area," If the Maryvale property (along with Victoria Village; unplatted Forest Meadows property; Pine Tree Plaza, Fraser; Fox Run; and the Bradley parcel) is not identitied as "committed," these areas could, if the Town Board directed, be identified as potential "growth areas" which would then be subject to a vote of the Fraser electorate as to whether or not they should become committed areas, (One area that staff has not discussed is the impact this amendment could have on the Sumrall and Emory [Moonshine Liquors] properties as they are within the incorporated boundaries and have existing uses but are not served by central water and sewer.) If the Board chose not to identifY the above properties as "committed" the Town will face litigation (if the initiative passes) as conversations with KOELBEL have identified that they believe that an approved Planned Development Plan qualifies as a valid development application and are willing to litigate the issue, (This information is passed along as information: it should not, in any way, be considered a threat or adversarial posturing taken by KOELBEL. They are . simply in the same situation as many land development companies throughout Colorado), Even property owners like Chas McConnell could be faced with financial loses that would lead to litigation, Staff's Recommendation The community faces a difficult decision, On one side, identifYing the areas identified above, or some of the areas identified above, as committed "saves" the Town from potential litigation and follows the Grand County master growth plan, On the other side, the Town could restrict development to areas currently served by central water and sewer - basically Fraser's existing built upon boundaries along with East Mountain Filing # 1 and "strip" development adjacent to the water and sewer lines serving Filing #1, Staff has prepared two resolutions for your consideration, One resolution identifies any land use application that "substantively meets all the rules for submission" as a valid development application, The other resolution states that properties with a "substantively complete" final plat be identified as valid development applications, Staff recommends approval of the resolution which identifies any land use application which "substantively meets all rules for submission" for the following reasons: . Fraser, and adjoining Winter Park, have been identified in the Grand County master growth as areas in which development should occur. . Fraser's contractual agreement tor the Maryvale property does create an interesting twist to the detinition of a "committed area", one that, again, as Rod McGowan stated will only . be determined by the Courts . In 1953, the citizens of Fraser incorporated as a Town and, as Stich and implicitly, expressed a desire that development should occur within the Town's boundaries and within the Town's land-use regulations, . . . Page Four Amendments 24 and 2 I Having said this, statf also is very willing to follow the Board's direction to limit our committed area to areas currently served by central water and sewer service (or areas approved to be served by central water and sewer service) and to do our best to prepare Fraser for the imminent legal challenges that this decision would create, Amendment 21 While many eyes (and a lot of election dollars) will be on Amendment 24, Amendment 21 poses a dramatic change in the way local governments operate in Colorado, Amendment 21 would reduce each tax that appears on your "tax bill" by $25 annually, and increasing annually by $25, Attached is a copy of Chuck and Debi Reid's most recent "tax bill," If Amendment 21 passes, each separate taxing entity's assessment would be reduced by $25 in 2001. In 2002, each assessment would be reduced by $50; in 2003, by $75; ad infinitum, Eventually, all of these taxes would "go away," The proposed amendment does not say how these entity's revenues would be replaced, Some analysts believe that bonded indebtedness would not be effected by this amendment, a view that is not shared by all analysts, . While passage of the amendment would not be catastrophic for Fraser (assuming the analysts that believe bonded indebtedness is not effected are correct) due to our minimal reliance on property tax, the amendment poses grave danger for special districts such as the East Grand Fire Protection District, the Library District, the School District, and the water conservancy districts, Districts such as the Fraser sanitation District could probably survive simply by raising fees, Staff believes that this amendment would undermine many "quality of life" enhancements that a community chooses to make, While we do not recommend taking any formal action, we believe that we have an obligation to discuss the potential impacts of this amendment with as many people as possible - it is simply a bad idea that takes away the concept of local control. . . THE RESPONSIBLE GROWTH INITIATIVE (FINAL VERSION SUBMITIED TO THE SECRETARY OF STATE ON 4/21100) ARTICLE XXVIII CITIZEN MANAGEMENT OF GROWTH fiE IT ENACTED BY THE PEOPLE OF THE STATE OF COLORADO: The constitution of the state of Colorado is hereby amended BY TH E ADDITION Or- A NEW ARTICLE 10 read: Section I. PURPOSE. The people of Colorado find that rapid, unplanned and unregulated growth through development and subdivision of land is a matter of statewide significance and concern, because it is causing serious harm to public health, safety, and welfare by consuming large tracts of open space and farm and ranch lands, scenic vistas and archal:ological and historic sites; imposing unfair tax burdens on existing residents; overburdening police protection, emergency services, schools, roads, water supplies, and other public facilities and services; creating increased levels of traffic congestion; causing unhealthy levels of air and water pollution; harming wildlife, biodiversity and ecosystems; ana impairing the ability of cities, city and counties, counties, and towns to maintain community character and protect neighborhoods. The purpose of this article is to require citizen management of growth, by providing voters with information concerning growth impacts, by providing voters with control over growth areas in their communities, and by requiring coordination among local governments with respect to proposed growth areas. This article shall pre-empt any inconsistent provision of this constitution, state statute, local ordinance, or other provision of law. Section 2. DEFINITIONS. (c) the land has been identified by the local government as an area for development or redevelopment and it (i)directly abuts, except for intervening dedicated public streets or roads, areas meeting the criteria of paragraph(a) of subsection (2) hereof along 100% of its perimeter, or along at least 50% of its perimeter, and by permanently protected open spaces, federal lands, or bodies of water along the remainder of its perimeter. (3) "DEVELOPMENT" means commercial, residential, or industrial construction or other activity which changes the basic character or the use of the land so as to permit commercial, residential or industrial . construction. "Development" shall not include the construction, operation, maintenance, repair, or replacement, of facilities for telecommunications, public utilities, mining of minerals and construction materials, oil and gas exploration and production, or for the diversion, storage, transportation, or use of water within the state of Colorado. WHEREAS, Article 5.0 of said annexation agreement provides broad guidelines for the development of the domestic component of the water system serving the Property; and WHEREAS, this agreement provides details for some of the guidelines relating to Section 5,0 of the 1998 annexation agreement; and WHEREAS, Fraser's plant investment fee includes, or will soon include, a system development fee and a water resource fee; and WHEREAS, the Individuals all own property described in Exhibit" A", which is a part of the Property and which shall be considered bound by, burdened and benefited by this Agreement; and WHEREAS, the Maryvale Commercial and Residential Metropolitan Districts have been formed to provide services to the Property described on Exhibit "A", but Districts presently do not have the facilities necessary to provide water treatment to the Property and are entering into this Agreement as a methodology for providing service to the Property encompassed in their Service Plan; and . . WHEREAS, Section 5.6 of the amended and supplemented annexation agreement states that "Fraser will be responsible for the planning and construction of the Water Regional Facilities necessary for the Domestic Component of the water system." Furthermore, "As a condition ofFPDP (Final Plan Development Plan) or subdivision approval, Developer shall prepay to Fraser sufficient water plant investment fees, at the rate then in effect, to fully cover all estimated costs of such Water Regional Facilities" . NOW, THEREFORE, in consideration of the premises, the mutual commitments, covenants and agreements herein contained, and for other good and valuable consideration, the receipt and adequacy which is hereby irrevocably acknowledged by Developer, Districts, Individuals, and Fraser, their successors and assigns, the parties agree as follows: 1. Should the Town hereafter amend its Code to allocate its tap or plant investment fee between a system development fee and a water resource fee, Property within the Districts shall only obligated to pay to Fraser the system development fee portion of the plant investment fee in recognition of the water right dedication requirements of the Amended Annexation Agreement for the Property. 2. Developer has submitted a Final Plan Development Plan and subdivision plat, titled "East Mountain Filing # 1, that will require the construction of certain Water Regional Facilities (which will be designed and built in contract phases), more .' specifically listed below with current estimated engineering design and construction costs: Contract Number Description of contract work Estimated Cost Well pumps, raw water collection lines, control 1 system, treatment and pumping station $596,750 Intermediate (yellow to green zonel) BoosterlPRV 2 station with controls $195,300 Water Storage Tank (east side green zonel) 3 estimated as 500,000 gallon pre-stressed buried concrete $537,500 4 Booster Pumping Station (green to red zonel) with standing generators and controls $271,250 Total $1,600,800 I Based on Town of Fraser Master Water Plan, 1995, McLaughlin Water Engineers The engineering design of contracts 1 through 4 above are based upon the East Mountain Filing # 1 Final Plan Development Plan and subdivision plat, and are intended to serve the East Mountain Filing #1 subdivision and other subdivisions as may be approved by the Fraser Town Board. The approval of this agreement does not insure that contracts 1 through 4 will provide all of the Water Regional Facilities necessary to serve all of the Property. . ýÿ . 3. Prior to the recording of the East Mountain Filing # 1 final plat Developer agrees to prepay Town the estimated engineering design and construction cost of contracts 1 through 4 above and will receive credit for a corresponding number of plant investment fees at the rate in effect at the time the payment is made. If, from time to time during the design and construction of such Water Regional Facilities, the revised estimates or actual costs of contracts 1 through 4 exceed the amount paid by Developer, the Town may bill the Developer for any such excess costs and the Developer shall pay the same within sixty (60) days of such billing. Any such additional payments shall be credited to the Developers "prepaid account" balance at the applicable plant investment/system development fee rate in effect at the time payment is made. All pre- paid plant investment fees shall be accounted for in a "pre-paid tap account" by Fraser. Any taps in the pre-paid tap account shall not expire. A plant investment fee shall be equivalent to one single family equivalent "tap". Fraser agrees to use reasonable efforts to cause said Water Regional Facilities to be designed and constructed for a reasonable cost. Fraser's use of the design services of McLaughlin Water Engineers, or other competent professional engineering services, and the selection of the lowest responsible bids for contracts 1 through 4 through Fraser's usual competitive bidding procedures, shall be deemed to satisfy such requirement of reasonable efforts, absent fraud or bad faith by Fraser; provided however, that the foregoing shall not preclude Fraser from utilizing other reasonable methods and procedures to cause the Facilities to be designed . and constructed for a reasonable cost. 4. Districts have the right to charge plant investment fees, as allowed by statute and/or Service Plan, within the District for the purposes of recouping their capital investment in the Town's water plant. 5. No later than October 1 st, annually the Town shall advise the Districts of the Town's plant investment fee for the next calendar year. Reciprocally, no later than October 31 st annually, Districts shall advise the Town of the next calendar year's plant investment fee for taps sold within the Districts for the next calendar year. Property owners within the Property requiring a tap shall, prior to the time a building permit is issued from the Town, pay to Districts the tap fee set by the Districts, which fee shall encompass the Fraser plant investment fee. Upon collecting such fee, the Districts, shall remit the following to the Town: a) if prepaid taps are available in the prepaid tap account, Districts shall give a Plant Investment Fee Voucher ("Voucher") to the building permit applicant who shall be required to present the Voucher to the Town before a building permit is issued. The Districts shall provide an accountin~ to the Town of the number of Vouchers issued quarterly March 31st, June 30 ,September 30th, and December 3 1st. Any taps for which Vouchers are issued shall be deducted from the pre-paid tap account. . ýÿ . b) if no prepaid taps are available in the prepaid tap account, Districts will remit the then applicable plant investment fee assessed by the Town, to the Town, on a quarterly basis for any taps sold to Property owners within Maryvale in the preceding quarter (accounting shall occur quarterly in March, June, September, and December, and funds remitted to the Town within 30 days from the end of each quarterly period). Districts and the Developer have a "Pre-Inclusion Agreement" with the Fraser Sanitation District dated May 9, 2000. Section 14 of said Pre-Inclusion Agreement specifies that the Town of Fraser shall collect service and plant investment fees for the Fraser Sanitation District and that the "Districts shall enter into an agreement with the . Town" related to the same. This Supplemental Agreement shall serve as the agreement referenced in Section 14 of said Pre-Inclusion Agreement. Nothing herein shall be construed to alter, amend, replace or derogate the terms of the Pre-Inclusion Agreement between Fraser Sanitation District and Developer, Individuals and Districts. 7. Developer and/or Districts shall be responsible for design and construction of all other components of the domestic municipal water system as provided by the Subdivision Improvement Agreement for East Mountain Filing # 1. Any default under said Subdivision Improvement Agreement shall also constitute a default under this agreement. 8. As the Town will be required to operate the water plant after its construction and may not have the benefit of actual users (paying water service charges), Developer and Districts agree to an annual supplemental payment based on the number of taps using the infrastructure itemized in Section 2 of this agreement. Said payment shall be: Up to 100 single-family equivalent taps: $30,000 101 to 200 single-family equivalent taps: $20,000 201 to 300 single-family equivalent taps: $10,000 . ýÿ . and shall be paid annually by January 15th, until 300 single family equivalent taps (using the infrastructure itemized in section 2 of this agreement) have been purchased. At that time, the annual payments shall cease. 9. Fraser will assess the Property with the same mill levy as is assessed within the remainder of the Town of Fraser. Districts may assess an additional mill levy to recoup capital investment and (consistent with the Service Plans) may assess an additional mill levy to provide funds due to Fraser under this Agreement in the event of any default. 10. In the event of a default by any party to this Agreement, notice shall be given to the defaulting party in writing as provided in Paragraph 11. He is still structuring it so the town tap fee is being paid twice, once as a prepaid tap issued to the developer under the Agreement, and then again to the lot owner at building permit, presumably at a higher rate with the diffence going to the Developer/Districts. I could see this as being viewed as unfair by the lot owners, and potentially subject to legal challenge as a double tax/fee. I still do not see why they cannot recoup their costs through the Districts own fees, and I would suggest the following as yet another alternative. Let me know what you think. 5. No later than October 31st annually, Districts shall advise the Town of the next calendar year's plant investment fee for taps sold within the Districts for the next calendar year. Property owners within the Property requiring a water tap shall, prior to the time a building permit is issued from the Town, pay the applicable tap fee in accordance with the following procedure: a) if prepaid taps are available in the prepaid tap account, the Dis shall collect the tap fee set by the Districts directly from the property ~ owner. To the extent allowed by law and the Districts Service Plans, such 'District tap fee may include charges to recoup the amounts paid to Fraser for prepaid taps pursuant to Paragraph 3 hereof. Upon collecting such tap fee, the Districts, shall give a Tap Fee Voucher ("Voucher") to the building permit applicant who shall be required to present the Voucher to the Town before a building permit is issued. The Districts shall provide an accounting to the Town of the number of Vouchers issued quarterly March 31st , June 30th , september 30th , and December 31st. Any taps for which Vouchers are issued shall be deducted from the pre-paid tap account. Town shall establish a building permit application process that requires submission of a Voucher from a building permit applicant before any building permit requiring a plant investment fee under the Town Code is granted. b) if no prepaid taps are available in the prepaid tap account, th e shall collect all applicable tap fees from the property owner, including any District plant investment fees and Fraser's own plant investment fee/system development fee, in Fraser's normal building permit process. Fraser will remit the plant investment fee assessed by the Districts, if any, to the Districts; which accounting shall occur quarterly in March, June, september, and December. All plant investment fees/system development fees assessed by Fraser, while there is no positive pre-paid tap account balance, shall be retained by Fraser. Fraser shall charge the Districts an administrative fee that covers the cost of collecting and remitting the Districts' plant investment fees. This administrative fee shall be agreed to annually by the Town and Districts and shall be based solely on cost recovery. . I of 1 9/2/00 9:40 AM ýÿ ~ l. TOWN OF FRASER . "Icebox of the Nation" P.O. I did not include the entire application as it is about 80 pages - if you would like a copy, please let me know. . KOELBEL has submitted three access alternatives to development east of the river: . One has two, two-lane bridges (as approved in the East Mountain Filing #1 Final Plat) and meets specifications provided by Jim Swanson, Fraser's Town Engineer; . One has two, one-lane bridges (as approved in the East Mountain Filing #1) but does not meet Jim Swanson's specifications; . One has one, two-lane bridge and a secondary access through High Country Haus. KOELBEL has identified the third option as their "preferred" option to the Corps of Engineers as it has the least wetland impact of the three options, and it better meets the spirit and intent of Fraser'.s "second access" requirement. From an emergency access standpoint, I also prefer the separated second access, but this brings-up a list of other issues: . Emergency access through a private street system grid, in a different Town; . Emergency access over an existing, and possibly, sub-standard bridge in a different Town; . Another gated emergency access; and . The political issues of the above. The Corps is requesting written comment on the application by September 18, 2000. I will need Board direction on which alternative you prefer. . . The public review process was initiated on August 18, 2000. The Corps of Engineers seeks public comment during this period. We respectfully ask the Town to provide a letter to the Corps of Engineers in support of the application, If the Town has any questions or concerns regarding the application that could hinder its ability to respond in a positive manner please contact me to discuss these matters. With regard to the preferred alternative for the Fraser River bridge crossing please consider the following. The East Mountain Filing 1 plat's approval was conditioned to Maryvale Village LLC providing two one-way bridges across the Fraser River. In subsequent meetings with the Town engineer it was required that the bridges needed to be designed for two-way traffic in an emergency, with two 12' lanes, 4' shoul,-l~rc: a"d ::> ?' g' ,....~rl rail aroa (35'\ ThiS s"I' ,ti""r: ;'" 0,.,0 ,"~ th", "'I+ernatives __ __ .. _ _ .....0'.... .'_ /' ,1.1 \wi_..."""" II submitted in the permit application, The Corps of Engineers and EPA are requiring a least impact solution and requested that we provide an alternative that had two one-lane bridges. After further analysis of this request, Maryvale Village LLC developed a third "preferred" alternative that we believe responds to the Town's condition for emergency access to the development area east of the Fraser River, and the Corps of Engineers and EPA's preference for least impact. The preferred alternative provides for a new, two-lane bridge crossing of the Fraser River while maintaining the existing bridge for pedestrian, bicycle and emergency vehicle access. . In addition, recognizing the need for emergency, secondary access east of the Fraser River we have noted in the 404 permit that we have a legal right to access through the Hi Country Haus property, which provides access across the Fraser 1:1 AI I ':1,\11 :;'\II'.;'(;Or'J::llilJ':II')~I'II\rllll,1 '/11(il'MI NI ,1'1<01'1 1II'(!ItlAIIAl;1 IAI ~II'III'/I',lr'~1 I'II','II'I:,III!A~II,I ---- ( t '. CA 95814-2922 In reply, please refer to the Public Notice Number TO WHOM IT MAY CONCERN: SUBJECT: Application for a Department of the Army permit under authority of Section 404 of the Clean Water Act (CW A) and for water quality certification under Section 401 of the CW A to discharge 7,100 cubic yards of clean fill material into 3.32 acres of wetlands adjacent to the Fraser River and its' tributaries and 0.46 acre of aquatic habitat of a man- made pond, and to temporarily impact 0.99 acre of wetlands for the construction of utility lines for the construction of residential and commercial development known as Maryvale East, as shown in the attached drawings. APPLICANT: Jack Bestall, Maryvale Village, LLC, Post Office Box 149 '. 78622 Winter Park Drive, Winter Park, Colorado 80482 LOCATION: The project is located between the Towns of Fraser and Winter Park along . the Fraser River and the hillside east of the river in Sections 20, 21, and 28, Township ,1 South, Range 75 West, Grand County, Colorado. PURPOSE: The purpose of the project is to construct a residential and commercial development with a mix of single family and multi-family units including approximately 80 employee housing units and commercial space including retail, office and restaurants. PROJECT DESCRIPTION: The applicant is proposing approximately 750 residential units on the 443 acre Maryvale East property including 110 single-family lots, and a combination of other single family detached lots, attached homes, townhomes and mountain cottages. The majority of the residential units will be constructed on the forested hillsides east of the river which comprises the bulk of this acreage. An access road is proposed across the Fraser River floodplain with a bridge spanning the river. This main access road impacts 0.88 acre of wetlands. Three other road crossings of wetlands on the hillside to access residential lots impact 0.14 acre of wetlands adjacent to tributaries to the Fraser River. The applicant also proposes to contour an existing 3 acre pond that was constructed in the past for water storage. The proposal includes filling 0.46 acre of this pond to reshape the edges to create a more natural appearance (the pond is currently rectangular in shape) and create wetlands in the shallow water to enhance habitat for the local moose population. The project also proposes to establish a better diversion point and headgate to supply the pond from the Fraser River. A drop structure is proposed in the river to deliver water to the proposed headgate which supplies the ditch feeding the pond. The proposal also includes the construction of a commercial center along the U.S. Highway I. 40 frontage including 55,000 square feet of office and retail space, a 110 unit lodge and 80 ýÿ CESPK-CO-R Public Notice Number 200075318 .. . residential units. This commercial development impacts 2.24 acre of wetlands in the . northwest portion of the site along Highway 40. AL TERNA TIVES: The applicant provided development alternatives which created greater wetland impacts than the proposal. The applicant considered several alternatives for the main access road across the river and adjacent wetlands. There is an existing one-lane road and bridge over the river as shown on the attached drawings, however, the applicant cannot use this bridge and road for access due to the severe turn (approx. 90 degrees) to the south the road makes on the east side of the river. The applicant, and the town, claim they need two access points for the development across the river for safety reasons. They originally proposed two new bridges, one in the location of the old bridge and the other in the location of the current proposal. These would be single lane bridges and created equal or slightly greater wetland impact then the proposed design. This alternative was rejected due to similar wetland impact and increased cost (building a second bridge). The current plan will construct a two lane bridge at the new location and maintain the existing bridge as a pedestrian and bike crossing. The safety issues for fire and ambulance entrance can be answered in that if the new bridge is blocked or damaged, the old bridge can handle emergency access. Both the Town and the developer want two access points for safety reasons in the event one of the bridges is blocked. The access road, between the river and Highway 40, impacts wetlands along a separate alignment from the existing access road. To reduce wetland impacts we questioned why chose a separate alignment and not use the existing alignment. The angle to reach the new bridge from the access road would be too severe for safety standards, and if they decreased the angle they would impact a beaver pond complex on the river that we required them to avoid with their original plans. The narrow ~xisting access road would need to be widened . which would create the same level of wetlands impacts as the proposed alignment due to the fact the proposed alignment takes advantage of upland inclusions within the wetland. The widening of the access road would impact the beaver pond. Although referred to as the commercial development area, this pod contains a mix use of commercial and residential, primarily employee housing units. Alternatives for the commercial development (2.24 acres) include limiting the size of the commercial development, eliminating all commercial development from wetlands, and moving the access roadway for the commercial areas that is situated east of the development pods. The current alignment of this access road places the road in wetlands along the edge of the major wetland complex adjacent to the Fraser River. According to the applicant, the town is requiring a looped road with two points of access to the highway and the town does not want the road to parallel the highway. The applicant's alternative claims that the proposed development and 2.24 acres of wetland impact are the minimum necessary to make the project economically viable. Area 14 E in the commercial development creates 2.18 acre of impact. According to the applicant, this area must have 30,000 square feet of commercial space and 80 residential units to make the project economically feasible. Alternatives to reduce wetland impacts are further limited by height restrictions of 35 feet, hence the buildings can not be higher to reduce the footprint. An alternative for the commercial development would be to maximize use of the uplands by bringing an access road into the eastern area of uplands, impacting the small isolated wetland in this area with development (use Figure 6). Then the access road loops between the two wetlands to gain access to the western area of uplands and continues the access loop back out to the highway. A small driveway could cross the narrow wetland in the northern portion of this area to gain access to the upland development area on the northern edge to . 2 J ~ , . CESPK-CO-R Public Notice Number 200075318 . build at least two or three of the buildings as shown. This alternative will reduce the wetland impact for the commercial area substantially, while still allowing some development. . The square footage of space in the proposal would not be attained. Another major impact from this proposal, although temporary, is the sewer line across the Fraser River wetland complex. This line connects the residential developments east of the river with the main line that runs parallel to Highway 40. AREA DESCRIPTION: The project is located in the Fraser River valley and adjacent hillsides ranging in elevation from a low of 8,590 feet along the river to 9,200 feet above msl. The 443-acre property includes a 1.3 mile reach of the river and it's adjacent wetlands, and forested hillsides east of the river which occupy the bulk of the property. The property also contains the Cozen's Museum, a small museum commemorating the historic r~ching in the Fraser Valley, and a small catholic church and cemetery. The forested hillsides are dominated by lodgepole pine (Pinus contorta) including stands of aspen (Populus tremuloides) with small sage and grass meadows. Two drainages are located east of the river each containing narrow bands of adjacent wetlands. The wetlands vary along these drainages from willow shrub wetlands with a sedge understory to forested systems with a grass understory (Calamagrostis canadensis). These areas are typically seasonally very wet in the spring and early summer, drying up later in the growing season. The Fraser River is a meandering freestone stream in this reach influenced by beaver dams. The adjacent wetlands occupy 55 acres of the valley bottom at widths of up to 600 feet. This complex contains high quality wetlands providing a variety of functions at a high rate. The wetland is dominated by a diverse composition of willows including SaIix monitcola, S. . boothii, S. geyeriana and S. bebbiana. The understory includes Canadian reedgrass . (Calamagrostis canadensis) with beaked sedge (Carex utriculata) in the wetter habitats. Other shrubs found include bog birch (Betula glandulosa), honeysuckle (Lonicera involucrata), shrubby cinquefoil (Pentaphyloides floribunda) and silver sage (Artemsia cana). Trees found in and on the margins of the wetland include aspen, engelman spruce (Picea engelmannii), Colorado blue spruce (Picea pungens) and lodgepole pine. ADDmONAL INFORMATION: The applicant is proposing to mitigate wetland impacts on the Maryvale West parcel which is just across Highway 40 from the East parcel. The west parcel is a 500 acre property with a large broad meadow and forested hillsides west of the railroad lines. Leland Creek crosses the meadow on the south end of this property and it appears that Leland Creek was straightened many years ago for the agricultural practices on this ranch. The applicant proposes to restore a more natural channel for Leland Creek and create 6.64 acres of wetlands along that channel. The applicant also plans development on the west parcel including hotels, residential units and an 18-hole golf course. The western parcel development is not connected to the Maryvale East development as no part of either development is contingent on one plan proceeding. The' applicant claims they would build Maryvale East whether or not they ever build the western development. The western development will most likely have wetland impacts due to the acreage of wetlands on that property. Planning for the western parcel has been delayed due to revisions in the wetland delineation required this spring. The original delineation approved for the previous owner was incorrect omitting wetlands in the central and lower portions of the meadow. . 3 ýÿ ---- CESPK -CO- R Public Notice Number 200075318 , The applicant has requested water quality certification from the Colorado Department of . Public Health and Environment, Water Quality Control Division in accordance with Section 401 of the Clean Water Act. Written comments on water quality certification should be submitted to Mr. Phil Hegeman, Planning and Standards Section, Colorado Department of Public Health and Environment, Water Quality Control Division, 4300 Cherry Creek Drive South, Denver, Colorado, 80222-1530, on or before September 18, 2000. The Colorado Department of Public Health and Environment, Water Quality Control Division also reviews each project with respect to the anti-degradation provision in state regulations. For the project which is the subject of this public notice, the Colorado Deparnnent of Public Health and Environment, Water Quality Control Division has preliminarily determined this project will cause only temporary changes in water quality. For further information regarding anti-degradation provision, please contact Mr. Hegeman at the Colorado Department of Public Health and Environment, Water Quality Control Division, telephone (303) 692-3518. The State Historic Preservation Office (SHPO) was contacted due to the historic nature of the Cozen's ranch structures on site. They informed us that the Cozen's Ranch House is listed on the National Register of Historic Places.' The SHPO will provide comments on how this feature should be protected in this development. The applicant does not intend to disturb this structure and wishes to incorporate protection of the structure into the development. It appears that this project will not affect the Cozen's Ranch House. The proposed headgate and drop structure to feed the pond will maintain the evaporative loss in the pond and the average annual depletion of water from the Upper Colorado River Basin. This historic depletion may affect the endangered fish species in the Colorado River and we have initiated consultation with the U. S. Fish and Wildlife Service on the 3.56 acre- . feet of evaporative loss from this pond. Boreal toad surveys have been completed this summer and neither toads nor tadpoles were found. The District Engineer has made these determinations based on information provided by the applicant and on the Corps' preliminary investigation. Interested parties are invited to submit written comments on or before September 18, 2000. Any person may request, in writing, within the comment period specified in this notice that a public hearing be held to consider this application. Requests for public hearings shall state, with particularity, the reasons for holding a public hearing. The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership, and in general, the needs and welfare of the people. For activities involving 404 discharges, a permit will be denied if the discharge does not comply with the Environmental Protection Agency's Section 404(b) (1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be or . 4 .. CESPK-CO-R Public Notice Number 200075318 . granted unless the District Engineer determines it would be contrary to the public interest. . The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Written comments on this permit application should be submitted to the District Engineer at the address listed above.
