AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE N0. 2325-
1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA.
WHEREAS, it is the intent and purpose hereof to amend the Zoning Ordinance of
the City of Richmond, Indiana, to define Business Enterprise; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Com-
mission the 13th day of December, 1983, at which time remonstrances
were heard from all parties interested in or affected by this Ordinance;
and,
WHEREAS, the vote of the City Plan Commission was nine (9) to zero (0) in favor
of recommending the passage of Amended Ordinance No. 56-1983.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana,
as follows:
SECTION 1. That Article 13 of Chapter 154 of the Municipal Code shall be amended
as follows:
13.95 BUSINESS ENTERPRISE: The use of land or a structure for manufac-
turing, processing, wholsale or resale of products, an occupation or
employment which occupies time, attention, labor and materials, or
wherein merchandise is exhibited or sold, or where services are offered.
This definition shall not include all general sales, open to the public,
conducted from or on a residential premise in any residential zone as
defined by the Zoning Ordinance, for the purpose of disposing of personal
property including, but not limited to, all sales entitled "garage",
"lawn", "yard", "attic", "porch", "room", "backyard", "patio", "flea
market", or "rummage sale", such sales being limited in time to no
more than four (4) consecutive days; nor shall this definition include
offer of sales of motor vehicles from or on a residential premises,
said sales being limited to five (5) per year.
SECTION 2. This Ordinance shall be in full force and effect from and after its
passage and approval as by law required.

NANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE

shall be amended as follows:
13.95 Business Enterprise: The use of land or a struc-
ture for manufacturing, processing, wholesale or resale
of products. Also, the provision of services to customers
and/or clients.
This definition is not intended to include garage, yard or
porch sales which occur in residential areas for periods
of four (4) consecutive days, nor shall this definition
include the offering for sale of not more than five (5)
or fewer motor vehicles per year from a residential property.
SECTION 2. This Ordinance shall be in full force and effect from
and after its passage and approval as by law required.

Dear Mr. Mills, Members of Common Council and Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on Tuesday, Decem-
ber 13, 1983, at the request of the Common Council to consider an Amendment to
the Zoning Ordinance. The proposed amendment would add the definition Business
Enterprise to Article 13 of the Zoning Ordinance. The Plan Commission requested
the City Attorney to re -draft the wording of the proposed definition for purposes of
clarity, which means that Ordinance No. 56-1983 is being returned to Common
Council in an amended form.
The Plan Commission voted nine (9) to zero (0) to recommend the adoption of Amended
Ordinance No. 56-1983.
