Home My Public Portal AboutResolutions-2011- 33CITY OF TIFFIN RESOLUTION 2011- 33 A RESOLUTION AUTHORIZING THE'CONTRACTOR FOR THE TREE AND HOUSE REMOVAL FOR 251 & 301 W MARENGO RD FOR THE IRELAND AVENUE EXTENSION PROJECT WHEREAS: the Engineer has found it necessary to remove houses, trees, bushes and brush from city owned lots in order to continue with the Ireland Avenue Extension Project and has requested the City to clear the properties of`trees and structures. WHEREAS: the City Council has reviewed the proposals submitted by contractors for the removal of the designated trees and two houses on city owned lots at 251 and 301 W. Marengo Rd for clearance for the Ireland Avenue Extension Project. NOW THEREFORE, BE IT RESOLVED by the City Council of Tiffin, Iowa, that the City Council approves the proposal submitted by Contractor: Neuzil & Sons Inc. for the amount of $23,909.00 as the lowest most responsible responsive contractor for the removal of houses; trees, bushes and brush; and also includes the fill dirt and compaction of the soil in preparation of the grading for the Ireland Avenue Extension Project as indicated and detailed on the bid proposal forms. Contractor will begin work as soon as possible per the specifications as indicated in the proposal documentation and contract. THERFORE, BE IT RESOLVED by the City Council of Tiffin, Iowa that the City Council approves to use - TIF Funds for this Project'as the project is located in an Urban Renewal Area. THEREFORE, BE IT RESOLVED, BY the City Council of Tiffin, Iowa to, authorize the Mayor and City Clerk to sign all necessary notices, documents, and forms of contract, as required and necessary to execute such contract. FOR 2010 CITY STREET IMPROVEMENTS FOR HARDING CONCRETE WHEREAS: the City Council of Tiffin, Iowa has been requested by Harding Concrete'to allow the acceptance - of a Four Year,Street Repairs Maintenance Bond to cover 2010 Street Repairs. The'2010 Project -has been completed and final acceptance of the project has been accepted by the Public Works Director and'the' Building Official. , WHEREAS: Zoning Ordinance 2007-287 Design Standards Streets'5.01 Subsection,E. state that "A five-year 'Y(5) maintenance bond covering defective materials and workmanship is required for all street improvements." THEREFORE: The City Council may by resolution grant the acceptance of a maintenance bond of less than ' five years: It is understood that the requirement of a five year maintenance bon_ d or letter of credit creates a financial hardship upon the contractor, Harding Concrete. THEREFORE„•BE IT RESOLVED: the City Council of Tiffin, Iowa approves and allows the Mayor!and City Clerk to accept'a four year maintenance bond to cover the materials and workmanship of Harding Concrete. RESOLUTION NO. 2011-29 H RESOLUTION FOR APPROVAL TO ALLOW FOUR YEAR MAINTENANCE BOND ., FOR 2010 CITY STREET IMPROVEMENTS FOR HARDING CONCRETE w WHEREAS: the City Council of Tiffin, Iowa has been requested by Harding Concrete to allow tFie acceptance of a Four Year Street Repairs Maintenance 'Bond to cover 2010 Street Repairs. The 2010 Project has been completed and final acceptance of the project has been accepted by the Public;Works Director and the ' Building Official. A �` WHEREAS: Zoning Ordinance 2007-287 Design Standards' Streets 5.01' Subsection E. state that+"A five-year' (5) maintenance bond covering defective materials and workmanship is required for all street improvements." THEREFORE: The City Council may by resolution grant the acceptance of a maintenance bond of less than five years. It is understood that the requirement of a five year maintenance bond or letter of credit creates a financial hardship upon the contractor, Harding Concrete. Y THEREFORE, BE IT RESOLVED: the City Council of Tiffin, Iowa approves and allows the Mayor and City Clerk to accept a four year maintenance bond to `cover the materials and workmanship of Harding Concrete.
