HomeMy Public PortalAbout060-1983 - Amending Chapter 154 - Zoning - 4815 Woodside DriveGENERAL ORDINANCE NO. 60-1983 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325- 1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 4815 WOODSIDE DRIVE FROM C-4 GENERAL, BUSINESS DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as C-4 General Business District the property located at 4815 Woodside Drive; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from C-4 General Business District to M-2 General Indus- trial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Can - mission the 25th day of October, 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was ten (10) to zero (0) in favor of recommending the passage of Ordinance No. 60-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to M-2 General Industrial District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. LAND DESCRIPTION: Being a part of the Southwest Quarter of Section 36, Township 14 North, Range 1 West in the City of Richmond, Wayne County, Indiana, and being two (2) parcels, and being more particularly described as follows: FIRST PARCEL: Beginning at an iron rod set on the centerline of the Woodside Drive (formerly United States Highway Number 40), said point being more particularly described as follows: Commencing at a copper - weld monument found at the northwest corner of the Southwest Quarter of said Section 36, and running thence, south along the west line of said Southwest Quarter, as established by the Wayne County Surveyor, 863.26 feet to the intersection of said line with the centerline of said Woodside Drive; thence south 74 degrees, 35 minutes and 50 seconds east, (assuming said west line to run north and south), along the cen- terline of said Woodside Drive, 326.77 feet to an iron rod set and the beginning point of this description: and running thence, from said beginning point, north 1 degree, 21 minutes and 50 seconds west, 250.96 feet to an iron rod found; thence south 74 degrees, 31 minutes and 50 seconds east, 128.50 feet to a point, witness an iron rod found; thence south 00 degrees, 04 minutes and 20 seconds east, 169.25 feet to an iron rod set in the centerline of said Woodside Drive; thence north 74 degrees, 35 minutes and 50 seconds west, along said centerline, 259.00 feet to the place of beginning, containing an area of 1.324 acres. And also: SECOND PARCEL: Beginning at an iron pipe set on the south right -of --way line of said Woodside Drive at its intersection with the west line of the Southwest Quarter of said Section 36, as established by the Wayne County Surveyor, said point being described as follows: Commencing at a copperweld monument found at the northwest corner of said Section 36, and running thence, south, along the west line of said Southwest Quarter as presently established, 863.26 feet to a point in the center- line of said Woodside Drive; thence continuing south, along the west line of said Southwest Quarter as presently established, 51.86 feet to the beginning point of this description: and running thence, from said beginning point, south 74 degrees, 35 minutes and 50 seconds east, (assuming the west line of said Southwest Quarter to run north and south), along the south right-of-way of said Woodside Drive, 656.28 feet to a point, witness an iron pipe found 0.43 feet southeast thereof; thence south 15 degrees, 42 minutes and 06 seconds west, 202.51 feet to an iron pipe found on the northward right-of-way of United States Highway Number 40; thence south 74 degrees, 09 minutes and 06 seconds west, along said northward right-of-way, 329.04 feet to a point, witness an iron rod found 1.56 feet north and 4.12 feet east; thence north 55 de- grees, 30 minutes and 54 seconds west, 316.95 feet to an iron pipe set on the west line of said Southwest Quarter as now established, thence north, along said west line, 280.08 feet to the place of beginning, containing an area of 4.308 acres. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Cason, Sr. and Claude T. Cason, Jr., Owners; Gregg M. O'Maley, Agent, requesting to rezone from C-4 General Business District to M-2 General Industrial District two (2) parcels generally located at 4815 Woodside Drive. Eight (8) notices of public hearing were sent to surrounding property owners with one (1) returned in opposition to the request. During the public hearing, the Plan Commission determined the following: 1. The use of the property has historically been industrial. 2. One of the subject parcels is contiguous to an existing M-2 Zoning District so the rezoning request represents a logical extension of an existing district. 3. The rezoning of the property to M-2 would be compatible with existing zoning and land use of the general area. 4. The rezoning would not adversely affect adjoining property.
