HomeMy Public PortalAbout2006-093 (05-16-06)RESOLUTION NO. 2006.093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD OPPOSING H.R. 4437, BORDER PROTECTION, ANTITERRORISM, AND ILLEGAL IMMIGRATION CONTROL ACT OF 2005, AS CURRENTLY WRITTEN WHEREAS, H.R. 4437 amends the Immigration and Nationality Act to strengthen enforcement of the immigration laws, to enhance border security, and ;~ for other purposes, that include the enactment of the Border Protection, Antiterrorism, and Illegal Immigration Control Act of 2005; and WHEREAS, The national organizations that oppose H.R. 4437 include the Mexican American Legal Defense and Educational Fund (MALDEF), the National League of Cities and the National Immigration Forum; and WHEREAS, The National League of Cities opposes provisions in H.R. 4437 that violate the principals of federalism and place unfunded federal mandates on local governments; and further opposes the provision that gives state and local police officers the authority to enforce federal immigration laws, and cites this provision as an outright preemption of local laws, and declares that such a mandate would divert local enforcement personnel from their primary duty to protect the general public and would threaten the department's relationships in the immigrant community; and WHEREAS, The National Immigration Forum, has declared that many organizations have expressed opposition to the idea of having state and local police enforce federal immigration laws, and has documented that many police agencies support this policy viewpoint. r` NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: Section 1. The City Council of the City of Lynwood is strongly opposed to enactment of H.R. 4437, as currently written, and urges the United States Senate to reject it, or to amend it in order to address and satisfy the above expressed concerns. Section 2. That copies of this resolution be forwarded to U.S. Senator Barbara Boxer, U.S. Senator Dianne Feinstein, U.S. Congresswoman Linda Sanchez and a copy thereof filed in the official records of the City of Lynwood.
