HomeMy Public PortalAbout2006-094 (05-30-06)RESOLUTION NO. ~nne_nga A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING OPPOSITION TO SB 1778 (ALARCON) ON LANDFILL COVER AND ESTABLISHING A POLICY TO OPPOSE MEASURES THAT WOULD LIMIT LOCAL JURISDICTIONS DISCRETION AS TO HOW TO BEST ACHIEVE AB 939 DIVERSION GOALS WHEREAS, the Integrated Waste Management Act of 1989 (AB 939) r; placed aggressive waste diversion. mandates on local governments to achieve 50 ~ ~ percent waste diversion by the year 2000 and delegated discretion to local - government as to how to best comply with the law; and WHEREAS, state law clearly establishes that the use of a waste product, such as shredded green waste, for construction and operation of a solid waste landfill, including the use of green waste as alternative daily cover, constitutes diversion through recycling and is not considered disposal; WHEREAS, the City has taken the initiative to implement separate green waste collection and rely upon the recycling of green waste for alternative daily cover for a significant portion of its waste diversion compliance; and WHEREAS, from time to time, the Legislature has considered proposals to eliminate waste diversion credits for green waste alternative daily cover programs including Senate Bills 411 and 1778 by Senator Richard Alarcon; and WHEREAS, these proposals would severely limit the discretion local jurisdictions are afforded by AB 939 and would require them to invest substantial additional resources in developing new programs to replace those green waste alternative daily cover programs. ~~ NOW, THEREFORE the City Council of the City of Lynwood does hereby i find, determine, order and resolve as follows: Section 1: That the City strongly supports the continuation of waste diversion through recycling for green waste alternative daily cover programs under AB 939 and opposes measures or efforts that would limit local jurisdictions discretion as to how to best achieve AB 939 diversion goals. Section 2: That the City Council authorizes the Mayor to communicate this policy position to members of the Legislature, the Governor of California and administrative agencies, as necessary.
