HomeMy Public PortalAbout05/06/75 CCM104 The Council of the City of Medina met in regular session on May 6, 1975 at 7:45 P.M. Members present: Mayor -Wayne Neddermeyer; Councilmen- Thomas Stevens, Donald DesLauriers, Arthur Theis, Robert Franklin; Clerk -Donna Roehl; Attorney -Richard Schieffer. Motion by Arthur Theis, seconded by Robert Franklin to accept the minutes of meeting of April 15, 1975 as presented. Motion carried unanimously 1. LIME ROCK BID Motion b; Donald DesLauriers, seconded by Thomas Stevens to accept bid of Willis Snyder Inc. for Items 4 and 5 (3/4" and 14" limerock) as presented at the April 15th'bid-letting. 2. INDEPENDENCE BEACH WELL QUOTES Engineer, Lyle Swanson, presented the following quotes for a 200 ft. test well: E.H. Renner and Sons-$1820.; Layne Minnesota Co.-$2520.; Keys Well Drilling Co.-$3420. Motion by Robert Franklin, seconded by Thomas Stevens to accept the low quote of E.H. Renner and Sons for drilling test well at Independence Beach. Motion carried unanimously Discussion as to procedures to follow if sufficient water is not obtained at 200 ft. Also Thomas Stevens asked to be notified when work is being done. Motion by Robert Franklin, seconded by Arthur Theis to authorize Thomas Stevens to be present when test well is drilled and a minimum of 200 ft. and a maximum of 250 ft be limits of test well. Mbtion carried unanimously 3. MC-COMBS-KNUTSON CONTRACT Discussion of contract presented by McCombs -Knutson and suggestion that amount of time to be spent by engineer be spelled out in contract. Members of council and attorney will study further. 4. MICHAEL SCHERER Application for platting code variance allowing Michael Scherer to purchase 5 acres from Meinrod Scherer has been reviewed and approved by Anne Dorweiler. Motion by Robert Franklin, seconded by Arthur Theis to approve Resolution 75-21, granting variance to Michael Scherer. Motion carried unanimously 5. TEXGAS Mr. Royce of Texgas Corp. appeared with plans to construct a 40' x 20' addition to present office building. City engineer has determined that a $1400.00 bond be posted guaranteeing blacktopping of 40' x 104' parking lot. Mr. Royce asked if there was another alternative rather than posting of bond. He also presented signed contract with blacktopping firm. Motion by Robert Franklin, seconded by Thomas Stevens to grant Texgas a building permit, according to plans submitted this date, provided a $1400.00 performance bond is posted or a certified check is placed in escrow or blacktopping is completed before building permit is issued. Motion carried unanimously 6. FLOOD INSURANCE Anne Dorweiler presented corrected maps that had been returned to her and suggested that Council could now go ahead with application to get into the program. Motion by Donald DesLauriers, seconded by Arthur Theis to adopt Resolution 75-22 pertaining to Medina participating in the National Flood Insurance Program and to carry out the objectives of the program. Motion carried unanimously Motion by Arthur Theis, seconded by Robert Franklin to adopt Resolution 75-23, stating that Medina has and does enforce a Uniform Building Code and that the Building Inspector and the Planning Commission will review and require all building proposals to minimize flood damage. Motion carried unanimously 7. C.O. DORWEILER Mr. Dorweiler discussed having the special assessments of Lawrence Koch deferred according to the 1974 Homestead Act. He explained reasons for the request and attorney advised that Council should set up a procedure to deal with this type of request and decide.by resolution or ordinance exactly what a hardship is. Attorney will investigate further and Mr. Dorweiler will supply the necessary documents at the May 20th Council meeting. 8. PRESENTATION OF HISTORY BOOKS Motion by Robert Franklin, seconded by Thomas Stevens to accept offer of C.O. Dorweiler of two history books which will be kept at the City Hall and will be made available to citizens of Medina. Motion carried unanimously 105 9. JOHN SPAETH Mr. Spaeth a member of the Elm Creek Conservation Commission explained a bill before the state legislature allowing cities in the Elm Creek Conservation area the authority to levy an assessment not to exceed 1 mill, if they so wish, for administration expenses connected with the Commission and also that Hennepin Co. shall provide certain facilities to the County soil and water district. Motion by Robert Franklin,seconded by Donald DesLauriers that Council go on record in support of the bill as presented by Mr. Spaeth. Motion carried unanimously Clerk was instructed to contact Mr. Salisbury Adams telling him of council action. 10. CURT EASTMAN Mr. Eastman requested that the city blacktop a 20' x 30' area in the city park at Medina- Morningside to be used for a basketball court. Motion by Thomas Stevens, seconded by Arthur Theis to have Leo Leuer meet with Mr. Eastman and determine cost and location and return to next council meeting with more information. Motion carried unanimously Arthur Theis, Recreation Director stated that he would also meet with Mr. Leuer and Mr. Eastman. 11. PUBLIC SAFETY COMMUNICATIONS Discussion of information regarding organization of a public safety communication system, for Hennepin County using the universal 911 emergency telephone number. Motion by Robert Franklin, seconded by Arthur Theis to adopt Resolution 75-24, concerning participation in planning a county -wide public safety communications system. Motion carried unanimously 12. LICENSES Motion by Thomas Stevens, seconded by Donald DesLauriers to grant the Hennepin Co. Park Reserve District and Clifton French, Superintendent an On -Sale, Off -Sale Non -Intoxicating Malt Liquor license for the remainder of the 1974 licensing period. Motion carried; Robert Franklin, abstaining. Motion by Thomas Stevens, seconded by Robert Franklin to grant an On -Sale Intoxicating Liquor license to Harold Glampe doing business as Harold and Dwaines Inc. Motion carried unanimously Motion by Robert Franklin, seconded by Donald DesLauriers to grant and Off -Sale Intoxicating Liquor license to Harold Glampe doing business as Harold and Dwaines Inc. Motion carried unanimously Motion by Robert Franklin, seconded by Arthur Theis to grant an Off -Sale Non -Intoxicating Malt Liquor license to Phyllis Berg of Hamel Superette. Motion carried unanimously Motion by Arthur Theis, seconded by Donald DesLauriers to grant an Off -Sale Intoxicating Liquor license to Joseph H. Senescall of Joe and Irene's Bottle Shop Inc. Motion carried unanimously Motion by Donald DesLauriers, seconded by Thomas Stevens to grant the Hennepin Co. Raskob doing business as Medina Recreations Inc. Motion carried unanimously Motion by Thomas Stevens, seconded by Robert Franklin to grant a dance permit to Patricia R. Raskob doing business as Medina Recreations Inc. Motion carried unanimously 13. REVENUE SHARING Discussion of Planned Use Report to be filed before June 24, 1975 and the best use for the $11,330. we are scheduled to receive. Motion by Thomas Stevens, seconded by Donald DesLauriers to apply amount we receive toward the construction of a new maintainence building. Motion carried unanimously 14. HENNEPIN COUNTY ROAD APPORTIONMFENT FOR 1975 Road Superintendent Leo Leuer and Donald DesLauriers will check the roads arid report as to best use for this years apportionment of $ 4362.16. 15. NORTHWESTERN BELL TELEPHONE Motion by Donald DesLauriers, seconded by Arthur Theis to Grant Northwestern Bell Telephone Co. permission to bury cable on Willow Drive north of Pioneer Trail as per request No. 4872. Motion carried unanimously 16. VANDALISM Discussion of vandalism to a police officers auto and whether or not it would be appropriate to post a reward for such actions. Attorney stated that only contributions on an individual basis may be applied and not city funds. 107 17. COURT COSTS Motion by Thomas Stevens, seconded by Robert Franklin to pay Joseph and Harriet Holasek and Land and Resource Development Company court costs in the amount of $331.90. Motion carried, Donald DesLauriers abstaining. 18. BILLS Attorney stated that the request from North Shore Community Council is considered a donation and cannot legally be paid. Motion by Thomas Stevens, seconded by Robert Franklin to pay bills except to North Shore Community Council. Order checks-$14208.78; Payroll-$4783.28. Motion carried unanimously 19. LAND AND RESOURCE DEVELOPMENT COMPANY Attorney informed council of meeting he and Anne Dorweiler had with Mr. Nolan of Land grid Resource Dev. Co. and Mr. and Mrs. Holasek. Mr. Nolan wished information regarding pro- cedures necessary for building a 29 unit mobile home park. Also if he could develop the other portion of the farm. He was informed that he had to plat and secure a land alteration permit. Building Inspector states that he cannot issue any building permits until he has received some structure plans which Mr. Nolan says he will provide. 20. INSURANCE Attorney will secure specifications for discussion at the May 20th Council meeting. 21. TRANSPORTATION STUDY Emil Jubert reported on meeting he had attended and stated that other municipalities had council members attending these meetings. Donald DesLauriers stated he would attend if at all possible. Motion by Robert Franklin, seconded by Arthur Theis to refer study to Planning Commission and get some direction from them. Motion carried unanimously 22. FINANCIAL CONSULTANT CONTRACT Discussion of two contracts presented by Ehler's and Associates. Robert Franklin suggested that the two part contract would better suit us. Clerk was instucted to contact Mr. Ehlers and find out what we owe them under part 1 of that contract for work they have now completed. 23. SUBURBAN NURSING SERVICE Motion by Donald DesLauriers, seconded by Thomas Stevens to appoint Arthur Theis delegate to the upcoming meeting of the Suburban Nursing Service. Motion carried unanimously 24. LOT SIZE ORDINANCE Members decided to act on this after the Comprehensive Plan is adopted. 25. MINNEHAHA CREEK WATERSHED Lettor from Engineer stating that some money is available for cleaning and removing debris from water courses in the Minnehaha District. 26. METROPOLITAN LAND USE BILL Motion by Robert Franklin, seconded by Arthur Theis to instruct Clerk to send letters to George Pillsbury and Salisbury Adams objecting to Sections 6; 9; 10; 11; 12; 14; and 15 of the bill. 108 27. BICENTENNIAL Arthur Theis suggested ideas as to what Medina could do for the BiCentennial. He presented a Bicentennial flag the city had purchased and a certificate stating we are members of the BiCentennail Planning Commission. 28. TAX AND HALL RENTAL COMMITTEE Robert Franklin suggested that perhaps each council member could select one person to act on a tax study committee and another group to secure another renter for the remainddr-of the City Hall lower level. 29. CITY HALL SIGN Motion by Robert Franklin, seconded by Thomas Stevens to have Donald DesLauriers design a suitable City Hall sign to be placed near County Rd. 24.
