Buford aye During closed session the Board discussed the status of the negotiation sessions with employee groups §610.021(9), RSMO 1988 SUPP. No votes were taken on this issue. The Board also discussed with staff and outside counsel legal confidential and privileged matters related to the Stormwater Rate case and the EPA case §610.021(1), RSMO 1988 SUPP. Buford aye - - - - Upon motion made by Mr. Visintainer, seconded by Mr. Ross, the Journal of the June 10, 2010 meeting was approved by unanimous voice vote. - - - - The Chair had no comments. - - - - Mr. Visintainer reported that the Program Management Committee met on June 29, 2010 at 7:00 a.m. The meeting was attended by Trustees Berry, Visintainer, and Ross. The minutes of the June 1, 2010 meeting were approved. The agenda items to be introduced tonight were presented and discussed, including a detailed discussion regarding the following items: Item 20 – Coldwater Sanitary Relief – This is the second time this project was bid. During the first solicitation, the low bid of $5.9 million was found non-responsive to MSD’s MWBE policy. Per Resolution No. 2474, instead of accepting the second low bid of $7.2 million, all bids were rejected and the project was re-bid. The resulting appropriation request is $1.6 million below budget. Items 21 through 30 – General Service Contracts – These 10 contracts are used to supplement internal staff by providing expertise in areas not available within the District and to provide resources during peak load periods or for unplanned projects. Total MWBE participation for these projects is 48%. Staff then gave a detailed presentation on the use of contracted field investigation and planning resources by reviewing the CSO Parkridge projects. Staff described the field services used including Inflow and Infiltration investigation and the use of CCTV and flow monitoring. Staff demonstrated the cost effectiveness of using these resources and described the additional benefits of information on existing MSD asset condition. During and after the presentation, staff answered questions from the Committee regarding field procedures, public response, and benefits of the work done. The meeting was adjourned at 8:05 a.m. - - - - Mr. Feldhaus reported that the Stakeholder Relations Committee met at the District’s Headquarters on June 17, 2010, at 7:30am. In attendance were Trustees Feldhaus and Visintainer, as well as District Directors and staff. Mr. John Lodderhose brought forth a discussion regarding the Storm Water Educational Radio Ads. This project will consist of the development and airing of five (5) different storm water educational radio ads as required by the District's Phase II Storm Water permit. The ads will be broadcast on four (4) different radio stations in the St. Louis for a total of over 400 spots. A motion was made by Mr. Visintainer to present this issue before the full board and said motion was seconded by Mr. Feldhaus. This is Item number 31 on the agenda. - - - - The Executive Director reported that The District Charter requires that a Plan Amendment Commission be created every ten years for the purpose of reviewing the Charter for potential revisions. For the past year, a commission of twelve citizens from St. Louis City and County has been in place and has reviewed the District Plan from cover to cover. The report is available to the public by visiting the District’s website at www.stlmsd.com. Tonight we have one of our Plan Amendment Commissioners, Ms. Susan Gamble, to give a brief report on the Commission’s findings and answer any questions the Board may have. Ms. Gamble reported that she is one of twelve Commissioners to serve on the MSD Charter change Committee that met on a monthly basis from July, 2009 through May, 2010. The Commission approached the Charter Change Review by going through each section on a page-by-page basis. Some of the significant recommendations for change are: removal of the legal boundary descriptions included in the Charter and make them available upon request; streamline the sub-district creation process and make the process more equitable so that the District does not incur costs for a sub-district that is not approved by a majority of the impacted residents; removal of the Professional Engineer requirement for the Executive Director position; allow for payment of Trustees to attend committee meetings; change certain procedures in the Rate Commission process; broaden the group of employees that are considered unclassified; modernize the form of the public notice process, and make references gender neutral. The Executive Director continued by informing the Board that this spring residents of the Dog Town neighborhood experienced several occurrences of basement backups related to heavy rains. This is an unusual situation, different than what the District usually confronts in that this area has experienced significantly increased problems over a very short period of time. We are working with area residents on solutions to prevent backups in addition to investigating the condition of our numerous sewers that serve the area. We will be holding a follow-up meeting with our customers later in the month to communicate what we have learned. We have included this issue as an item on our next Stakeholders Committee agenda. - - - - Mr. Tom Sullivan addressed the Board and raised questions about the District’s handling of a sewerage release into the Mississippi River near the Jefferson Barracks Pump Station. The Board indicated that Mr. Theerman had kept them informed. Mr. Theerman indicated that two crews worked around the clock to resolve the issue, but there was a breakdown in the internal communication that resulted in not informing the Department of Natural Resources on a timely basis. Mr. Theerman emphasized that this is not MSD’s style of handling situations of this nature and he has apologized to the appropriate individuals at the Department of Natural Resources about this issue. - - - - CONSENT AGENDA ADOPTION OF PROPOSED ORD. NO. 190-10 (ORDINANCE NO. 13108) APPROPRIATING $2,000,000.00 FROM THE SANITARY REPLACEMENT FUND TO BE USED FOR COSTS ASSOCIATED WITH THE ACQUISITION OF NECESSARY PROPERTY RIGHTS FROM EASEMENT ACQUISITION FOR COMBINED/SANITARY PROJECTS (FY 2011) (10584) THROUGHOUT THE ENTIRE DISTRICT. ADOPTION OF PROPOSED ORD. NO. 191-10 (ORDINANCE NO. 13109) APPROPRIATING $400,000.00 FROM THE STORMWATER FACILITIES FUND TO BE USED FOR COSTS ASSOCIATED WITH THE ACQUISITION OF NECESSARY PROPERTY RIGHTS FROM EASEMENT ACQUISITION FOR STORMWATER PROJECTS (FY 2011) (10586) THROUGHOUT THE ENTIRE DISTRICT. Plan Approval Cornell Ave. #8360 Storm Sewer (Rain Gardens) (10559) This project, located east of Interstate 170 and north of Delmar Boulevard in the City of University City, is to relieve yard flooding. This project is in the Fiscal Year 2011 Budget and the estimated construction cost is $39,000. West Watson Road-Nanell Lane Phase II (10138) This project, located north of Highway 30 and east of Rott Road in the City of Sunset Hills, is to upgrade a substandard pump station. This project is in the Fiscal Year 2011 Budget and the estimated construction cost is $194,000. Wharf Street Pump Station Replacement (P-110) (WW) ( 10049) This project, located along Leonor K. Sullivan Drive from Popular Street to Laclede's Landing Boulevard in the City of St. Louis, is to relocate controls for a pump station above flood levels to alleviate bypasses during flood stage of Mississippi River. This project is in the Fiscal Year 2011 Budget and the estimated construction cost is $433,000. Sky Crest - Maple Grove Channel Improvement (GCMC-120) (10058) This project, located west of Sky Crest Drive and south of Meadowfern Drive in the City of Crestwood, is to reduce streambank erosion at rear property lines. This project is in the Fiscal Year 2011 Budget and the estimated construction cost is $470,000. Motion made by Mr. Berry, seconded by Mr. Visintainer, that the Consent Agenda be adopted. The work to be done under Contract #10415 consists of the construction of approximately 6,699 lineal feet of pipe sewers varying in size from 10-inches to 90-inches in diameter and appurtenances. This construction is the third phase of a three-phase improvement program. The purpose of this project is to alleviate excessive infiltration causing overloaded sanitary sewers. This project consists of the review and analysis of existing complaint data, review and analysis of existing identified projects, development of project definitions and preliminary studies for the CIRP, and additional planning services as needed throughout the District as a supplemental to an ongoing internal stormwater planning effort. This contract is for a total maximum contract amount of $250,000.00. Projects will be issued by letter agreement per individual scopes of services. Proposed Ord. No. 07-11 was presented and read. This ordinance authorizes the District to enter into Contract #10412, for one year with one option year, with Sabur, Inc. for surveying services associated with the design of sanitary and stormwater projects. Services provided include land surveys, property strip maps, and easements for projects to be completed either in-house or by design consultants. Additional general surveying services will be provided on an as needed basis for legal research, legal descriptions, topographic and land surveys for District facilities, and other requirements of the various District departments. Work will be assigned on a project-by-project basis. This contract is for a maximum contract amount of $200,000. Motion by Mr. Feldhaus, seconded by Mr. Ross that proposed Ord. This project will consist of the development and airing of five (5) different storm water educational radio ads as required by the District’s Phase II Storm Water permit. The educational ads will include information on: rain gardens, road salt, pet waste, yard waste and kitchen grease disposal. The ads will be broadcast on four (4) different radio stations in the St. Louis area for a total of over 400 spots. The objective of the program is to educate the public about storm water pollution and the things that the public can do to improve water quality.
